  1. my understanding of POA - is you can have an ordinary one to deal with issues - ie you give someone the POA due to illness - it is limited to the issue and can be time limited - it can end or you can renew it.
  2. The POA is not registered - it just normal one. It has been witnessed by a 3rd Party. I have a copy of the Property Register. Which part are wanting to see. It says the Airspace above my address - marked in red on the plans. It says the party is ourselves and A Shade Greener F12. There is a registered Charge and the Proprietor is US Bank Trustees Limited. my partner signed all the documents with a shade greener also
  3. POA is between myself, my partner and granting our son POA to deal with A Shade Greener. My partner is joint owner of the property. it is for a limited time but can be changed or amended as needed. I have invoices from builders and solar panel removers
  4. Letter before claim is dated 13/06/23 this was replied to by email on 25/06/23 - with an invoice attached and a request to send any further correspondence to my son. They did reply asking for proof of POA which was sent later on. The email requested that payment be made and they we would talk about the lease . It also stated that we didn't have a valid lease with them as it had been changed after it was signed. In their recent letter of January 2024 but dated 2023 they have accused me of blackmail. I really couldn't understand this as my letter of 9/10/22 made it very clear they would be taken down and i would be asking for payment as they had clearly caused the damage to the roof.
  5. I am assuming LOC is letter of compliance - it was dated 3/11/22 It was a reply to my letter of 9/10/22. I did not reply. As my letter clearly stated that if they didn't take them down in a reasonable time I would. I have issued an invoice on 25/06/23 and letter asking for my son to have POA due to serious illness there was a delay in sending it hence the gap. Can they just change the name on the lease - as they have and should the Land Registry have accepted that way
  6. yea i have read some of the posts about a Shade Greener. But didn't think they apply with this case. They have damaged the property and are not willing to take any responsibility for that.
  7. 13 August 2014 entered it a lease with A Shade Greener (F11) LLP with regard to solar panels and leasing the airspace above my property. This is signed by myself and A Shade Greener 22 November 2022 got a copy of lease from Land Registry which has now been changed to A Shade Greener (F12) LLP. It has been changed by ink and initialled. I was not told about this. They have also registered a Legal Charge against the property. I am in dispute with this company over damage to my property. 1st contacted them in November 2018 due to leak at the property caused by the installation of the solar panels mainly around a stack. I refused to pay towards the removal of the panels as they wanted over £2k and I would still have to provided scaffolding as well as pay for repairs. I would only get £1K back. Talking to a roofer who said he could fix the roof by cementing the ridges as this would stop the water going underneath the roof tiles and panels and reaching the stack. He did say the panels will have to come off and the stack would need to be reinstated. This was done and the leaks did stop. In October 2022 – the stack has started to show water ingress again as well as the eves at the beginning of the roof. I again telephoned A Shade Greener again they requested £1k for temporary removal of them and the date would be after Easter 2023. It was agreed after some time that I would send some pictures in and even suggested that maybe just the lower panels would only be needed to be removed. This was sent to the roofing team who had a rapid response team. I got a telephone 2 days later saying they would not be getting the roofing team and all the panels would need to come off. Again this would cost be over £2k with only £1k returned when they went back on. I was also told that the roofing manager was going to make the decision that the panels will never be taken off as I tried to argue the case for them to be taken down and the leak was due to the panels. In the end I sent them a letter stating they had 28 days to removed them or I would and claim the money back from them. I did remove them and damage was caused by them cutting the stack and squashing the panels on top of it. I have photographs that clearly show this. This was November 2022. Due to serious illness I never got round to taking them to court . I signed power of attorney over to my son to deal with this. A shade Greener response was to issue a letter before action calling me a liar, saying that I cancelled the rapid response team, and accused me of false and malicious slander. They are now claiming for Total Losses of £20K. My questions are 1. Can they just change the name on a lease by changing it and initialise it? Do they still have a valid lease? Can I still take them to a small claims court to recoup the roof repairs, scaffolding and removal of the panels ( Cost over £2.5K) and ask for removal of the lease and legal charge due to the damage done to the property and them changing the names on the lease. Any advice would grateful received.
