  5. Hi everyone, I am posting this because I will need help to take Evri to court for lost of parcel. They have not yet acknowledged they lost it, but I am anticipating that it is lost. This is the email I will be sending tonight if they don't reply to a preceding court claim email I sent directly to the CEO after his assistant replied to me earlier in the month. Capitol House, 1 Capitol Close, Morley, Leeds, LS27 0WH Letter before court claim. To whom it may concern, Dear Sir or Madam, Re: P1234567, Q12345678, H00MTC123456... [Incident: xxxxxx-xxxxxx] I recently sent a parcel via your courier network on the 24th of July 2023 and the parcel has not been delivered or returned to me yet. See attached pictures. So it has been 1 month and 21 days as of today 14 of August 2023 that I have used your service to send my parcel. The item progressed through your network until it was stopped due to unpaid custom charges apparently. Searching on Evri.com led me to Global Eco application which said the item has been returned since the 1st of August 2023. See attached pdf for Global Eco information. I must say that the item has been paid in France and was a return to the manufacturer. Custom taxes have already been paid here in the UK. So no taxes should be due. Also, I have never received any communication from Evri about the need to pay any taxes at all. If it was not because I am careful, I would have never known that my parcel haven't been delivered. After which point the item seems to be “missing”, since the 1st of August 2023 as no activities have been registered on the tracking system. Case number with Ref: xxxxxx-xxxxxx was raised for the item by the assistant of Evri CEO. The item cost £90 (depending on the Euro to Pound Sterling exchange Rate), which include shipping by the company Xxxx. To say that the maximum compensation could be £20 due to the level of cover I chose within your standard compensation would be unfair and amounts to an attempt to restrict your liability because I did not have to pay additional parcel cover. Your Terms & Conditions are therefore contrary to section 57 of the Consumer Rights Act 2015. The Act also requires that the service you provide should be carried out with reasonable care and skill. By losing my parcel you have failed in that duty and I am therefore seeking full compensation for the loss of my Shoes. Should you fail to resolve my issue in full, I will issue a county court claim for the full amount in 14 days without further communication to you. Any additional cost in pursuing the claim will also be added to the total outstanding, and will be added to the claim. If I do not receive a satisfactory response from you within 14 days of the date of this letter, I intend to issue proceedings against you in the county court without further notice. This may increase your liability for costs. I refer you to the Practice Direction on pre-action conduct under the Civil Procedure Rules, and in particular to paragraph 13-16 which sets out the sanctions the court may impose if you fail to comply with the Practice Direction.
