  1. Thought I was clear of the threat stage as I heard nothing back from them for a while, but since Christmas I've had 3 letters. The first two were exact word-for-word copies of each other but dated two weeks apart saying that I still have not paid the debt and I have 7 days to pay before court action commences. Thought that woud be the end of it, but I've got another letter yesterday that says: "Despite our previous correspondance you have failed to make payment or satisfactory grounds of appeal to the above appears which remains outstanding, therefore you have left us no option but to carry out full recovery procedures in which you incur additional charges. OUR RECOVERY AGENTS HAVE NOW BEEN GRANTED APPROVAL TO COMMENCE RECOVERY PROCEDURES WITHOUT FURTHER WARNING You have 7 days from the date on this notice to pay all outstanding amounts in full to prevent further action. When will they give up?
  2. I'm in the (hopefully) final stage of dealing with LDK and EDRS now. Got a ticket back in August 2010 on private land, ignored all three letters from LDK, was then passed to EDRS services. Ive had three from them in total, all three neglect to include my first name or initial, simply "Mr Barker" as if they are in someway trying to disassociate themselves from me in regards to me complaining about them, but still reaching me and getting me to pay the money! The first two letters were actual duplicates of each other, sent 2 weeks apart with 2 different date stamps on, saying that I need to pay them and failure to do so will lead to court action. The third letter was received on Saturday saying that its my final warning and it must be paid within 7 days otherwise court action will commence. After a bit of digging around when I got the first letter, I cant help but notice that their address is based in London, N12 0DR.... take a look on Google Streetview, tell me what you see at the supposed address of 2 Woodberry Grove ....... ironically, I see a car park! Number 4 Woodberry Grove is Finchley Christian Spiritualist Church, number 6 onwards are houses, and a CAR PARK where number 2 should be! All my post from them comes stamped from Milton Keynes, Who registered ETHICALDEBTRECOVERY.COM? Someone called Melissa Costello....... based where? You've guessed it, Milton Keynes. I have a similar situation I hope someone can advise me on... again, with Provident Loans My partner lived at home with his mum up until last summer, and has since moved out with me to a different town. His mum is the normal dodgy type of person, fiddling the benefit system, up to eyes in debt, and my partner has broken away for a fresh start. Everything has been ok for the past several months until he started getting letters at my address here, one addressed to him and one to his mum, identical letters from provident loans saying that he has not paid his agreement ect ect. He assures me that he has not taken anything like this out, and to be honest he would never have any need to either. After he spoke to his mum, she said that she took it out in his name too because she couldnt get the credit for it, and to just ignore the letters. The letters unfortunatly keep coming.... Now my questions is, how have they suddenly decided to start sending the letters here? Both for him and his mum? Am I wrong in assuming that his mum has got sick of getting the letters and gave them my address to send them to? I have said that he has to either tell her to sort it out, or call the company and tell them that he has nothing to do with it and tell them that his mum has taken it out without his consent. He is not happy, but would rather leave it for her to sort out as with it being his mum and all, doesnt want to get her into any trouble. But I dont believe that she will do anything about it, and can see myself having to phone them shortly, as I dont want any sort of debt associated with my address, and definately no debt collectors coming to my door for anything. What would be the best procedure to follow here? Simply calling them and argueing the fact that its not his debt and requesting the credit agreement? What then? Would courts or anything have to be involved if its considered fraud? I really do not want any of the hassle, but I dont want him paying back any of this debt that isnt his, just because he doesnt want to get his mum into trouble.
  4. Thanks for responding you two I contacted HSBC and gave them the new direct debit details in august, then every month after. I could not speak to Alliance and Leicester at all to do anything, as they would not speak to me without the phone PIN number for telephone banking, something that took months to arrive Its only now that I have both that and the online PIN (co-incidently, i've recieved 3 online PIN's over the past few days) that I can see my statements and know exactly whats happening
  5. Sorry if I've posted this in the wrong place, but im not sure where it goes as the bank charges section seems everywhere!! I have two bank accounts, one with HSBC, once with Alliance and Leicester. I also have a loan with HSBC, which they have taken out of my Alliance and Leicester account each month. Mid August 2007, I switched all my transactions from my Alliance and Leicester account to me HSBC one, including the direct debit for my loan. All my direct debits ect had then been switched to HSBC. I had around £100 left in my Alliance and Leicester account which I thought I would just leave for a rainy day. However September the 3rd, HSBC applied to my Alliance and Leicester Account for my loan. I accept that maybe I did not give them enough time to set up for the new account, so accepted this and called them to make sure it was set up for next month. Alliance and Leicester charged me £25 for rejecting the direct debit. 3rd October, the same happened, HSBC appllied for the loan payment from my Alliance and Leicester account again. I called HSBC again to make sure it was set up correctly, and complain. Again, I was charged £25 for the direct debit being rejected. 3rd November, the same happened, HSBC appllied for the loan payment from my Alliance and Leicester account again. I called HSBC again to make sure it was set up correctly, and complain. Again, I was charged £25 for the direct debit being rejected. 3rd December, HSBC applied for the loan payment from my HSBC account, it was taken, all ok. Except the I got a letter from Alliance and Leicester again advising the had rejected the payment, and charging me £25 again. Looks like HSBC had two direct debits set up, and applied for one payment from each account! I called HSBC, complained AGAIN, and asked them to take the Alliance and Leicester bank details off the system. 3rd January, HSBC applied for the loan payment from my HSBC account, AND my Alliance and Leicester account AGAIN! As you can imagine, Alliance and Leicester again charged me £25. Now, the £100 I had left in the account had been taken with the bank charges the past 4 months, but this time the £25 had pushed the account overdrawn, and they then charged me £125 for going overdrawn on their charges. I then recieved a letter stating that I had been charged this for going overdrawn, and that I should repay this as soon as possible. With no indication of any other charges on the letter, I could not repay this until I got paid, only to find out that they are also charging me £5 a day for being overdrawn! Im now looking at charges of over £200 because Alliance and Leicester rejected the direct debit. Something I should have pointed out earlier, A&L have all of their banking by phone or online, and you need PIN numbers to use these services, A&L did not send me a phone PIN until my 2nd request in December, and I just recieved my online PIN last week (4th request) Now from my point of view, HSBC have been at fault here for months and should repay these charges to me. Do you believe it will be possible? Especially with the big freeze on overdraft charges whilst its in the high court?
