  1. I know!!! At first he said i had made the error and issued it to RBS but when I pointed out that Barclays put in a defence he realised it was the court!
  2. Hi I Did, what a joke!! I got there and obviously Barclays hadn't turned up so the Judge called me in. Turns out there are hundreds of these a year and mine was the first ever that judge knew of that had got to court and this was because the court had contacted Royal Bank of Scotlands solicitors and not Barclays, so Barclays did not know there was a court date!!! The Judge has adjourned it for 28 days and said it would be very unlikely I would be back at the court as the banks always settled, however he didn't want to tempt fate! So now I am waiting to hear from the court or Barclays as to whats happening! I did all the paperwork you said (thank you) I had loads and didn't need any of it in the end but least its ready incase i do go to court again. So doesnt look like there is anything to worry about and the judge reckons the bank will just pay! Thanks again

  5. No i havent received anything from Barclays Apparently they have not yet turned up to a case, thats what im hoping. Someone has advised just to take it with me and hope for the best. Have you seen the statements and defense to do theres quite a bit!

Hi, Thanks, I wouldnt have thought so if you give them enough notice, my letter says if you tell them with at leat seven days notice they will do it without you and take into account all your evidence but then you are not there to argue your case. But i have been told by Money Saving Expert that Barclays have never turned up to a case yet!!! Fingers Crossed :o)
  7. hi the letter says: DISTRICT JUDGE JAMES has considered the statements of case and allocation questionnaires filed and allocated the claim to the small claims track. The hearing of the claim will take place at 10:30 on 12 February 2007 at Aldershot & Farnham County Court, 78-86 Victoria Road, Aldershot, Hampshire GU11 1SS and should take no longer that one hour. The court must be informed immediately if the case is settled by agreement before the hearing date. Each party shall deliver to every other party and to the court office copies of all documents (including any experts report) which he intends to rely on no later than 14 days before the hearing. The original documents shall be bought to the hearing. A statement of each of the parties and any person who is to give evidence must be filed at court and served on the other party 14 days before the hearing. A statement must set out in detail the evidence that the party or witness will give at the hearing. the court may not take into account of a document or a witness' evidence if the document, statement or report has not been served in a resonable time prior to the hearing. Thats it, i havent received anything from Barclays which they have submitted so does that mean they havent done it either? Thank you
  8. Hi I am going to court on Monday againts Barclays for £200. I was sent a letter by the court saying any documents I wanted to rely on had to be handed to all parties 14 days prior to the court date. I havent done this as i didnt realise i had to until now and now I am concerned I have made a big bistake. Could I just take copies of statements etc with me? Thanks
  9. I didnt realise i had to do it, supply parties with documents i am going to rely on, and now i have only got 4 days and it is too late to submit them. Do i need to take documents with me? Thank you
