  1. Hi there, Got a letter from the Court yesterday basically saying that the judge orders that the claim is stayed until 16th April to enable both parties to attempt settlement. I returned my allocation q'aire a couple of weeks ago. Does anyone have any idea what this means, in plain English?! With many thanks Gizmosgal
  2. Hi there, Having successfully won against Halifax last year, I have been hit by more charges (when I was in hospital giving birth and I couldn't alter a standing order causing stuff to bounce). I called them to ask them to remove the charges but they said that, due to my action previously and them settling up, I had agreed to pay future charges and that they reserved the right to close my account if I incurred any further charges. Does anyone know whether I can begin the process of claiming these new charges back and if so is it in the same way? Many thanks Gizmosgal

  4. Hiya, Got letter from Barclays this morning refuting the claim - but 'as it would be too expensive to go to court' they will settle in full with interest plus my court fees!! Hurrah! Thanks for the advice to those who replied.

Thankyou Jonni, I am reading other posts here with disbelief - plenty of people have been successful for much higher sums at earlier stages - so why are Barclays being like this with mine when I'm only claiming £165?! I will try and get the bundle together but with a small baby it's hard enough to find time to post this, let alone all the work that I'll need to do. Thanks for the advice Gizmosgal
  7. Hi there, Having successfully won back £1600 against Halifax, I thought I'd try with Barclays for a paltry £165 (but still better than a kick up the bum!). I thought it would be easier but oh how wrong I have been... I did everything right with regards to prelim, LBA, Moneyclaim etc. and have now got a court date through for 29th Dec. I figure they won't show but I have to get the bundle to the court by 15th Dec. My problem is that I have a newborn baby and I really don't have the time to get the bundle together (i.e the hassle of editing, printing and photocopying all that stuff). I am very tempted to drop it the day before the deadline if they haven't settled by then, which obviously I'm hoping they will. My question is whether anyone else has been in the same boat - i.e have Barclays settled before they have to get their supporting docs in or do they actually bother going through this process? Any advice would be greatly appreciated as I am majorly stressed with this, thankyou.

Dear Mods, Can you please change this thread title to 'Gizmosgal vs Halifax - SETTLED IN FULL' as to my complete surprise this morning, Halifax having filed a defence, there was the full amount claimed sitting in my accounts!!!!!! So that's another success story - many many thanks to all who offered help and support, couldn't have done it without this site and have now got at least 6 other people doing the same! Survey filled in and donation on way. Best wishes and luck to all - Barclays watch out as here we come you thieving b'stards! Gizmosgal
  9. Thankyou for your replies - sadly I didn't make myself clear!! What I actually meant was that when I sent the LBA's, I miscalculated the charges at that stage. The info in the Moneyclaim was actually correct and so it looks like this will be OK judging by your responses. Gizmosgal
  10. Can anyone advise, please? Sent off 3 LBA's over 14 days ago and no response so filed Moneyclaim yesterday. Unfortunately when I checked the figures again I realised that for one of the accounts the spreadsheet of charges was wrong (some months put March instead of May and a few charges mixed up i.e. £28 instead of £30) I don't know how this happened, my mistake obviously. The overall claim for that account is actually less than I had informed them I was claiming but do you think this will affect the claim? Any advice much appreciated. Many thanks Gizmosgal
  11. Update - LBA's gone out 11th July, offers received on 2 accounts but not third, Moneyclaim being filed 25th July if not settled in full by then.
  12. Just an update to the thread - LBA's going out tomorrow. Standard letters received for 2 accounts but not the other one yet (may be lost in post, sent rec. del but no records of it)

Hi there, Sent 3 prelim letters off 1st class/recorded on 27/6. 1 was signed for next day and for that account I have received the Halifax standard response so plan to send the LBA once the 14 days is up. The other 2 letters have not been signed for and having contacted Royal Mail was told that I have until 15/7 before they can be classified as 'lost' and until then they are 'delayed'. My question is: was planning to send all LBA's out on Monday 10th, so obviously if I have to wait until 15th to see if the original letters have been received then that will not be giving them the required 14 days. Should I wait until I know they have been received and back date the 14 days from then? (don't want to lose on a technicality!) Any advice would be really appreciated. Many thanks Gizmosgal

I just called them to see if they would be reasonable and remove this latest charge for going 20p over, the lady said that nobody had ever tried to negotiate with her before (!) before very kindly removing this charge. I got the usual 'it's up to you to manage your account' and 'you should have called us to increase your overdraft' (what for 20p I didn't even realise I'd gone over by). I am still persuing them for the other costs though, but not having this latest £30 charge will stop me from going over again and recreating the problem, so I am pretty pleased with that. Gizmosgal
  15. Hello to all, No news to update yet, sent 3 prelim letters off (1 of which signed for today) so waiting to hear. Got another £30 charge letter through today for going 20p over my overdraft (I kid you not) and though I am mad (mostly with myself) I am taking some consolation in the fact that I will hopefully be able to recover these charges soon! Have also requested my statements going back 4 years with Barclays, not sure if there are any charges on that one but worth a look methinks! Am telling everyone I know about this fab site, and have even had moments of madness daydreaming about handing out leaflets outside my branch telling people to take action! Anyway hope everyone is doing good and hope to read lots more good news stories soon. Gizmosgal
