  3. Just as a bit of encouragement for all Natwest credit card customers, this afternoon I called the call centre and requested a refund of an overlimit fee. (I was encouraged by my efforts to get a refund of £350 from Smile bank and thought 'why the hell not go for the whole lot???') I know it is only £18 but every bit helps! The call centre worker said a point blank no at first, saying thats what I agreed to in my t's and c's, but after I quoted what I had put in the letters written to Smile from this website, he gave in and offered to refund the £18 as a 'gesture of goodwill' only since I was a good customer, and not an admission of any wrong doing on the banks part, and if I was a bad customer he would certainly not be authorising the refund (by 'bad customer' I assume he means the other unfortunate people attempting to get back more than a measly £18) Comedy thought: He also advised me that 'quoting these laws' were not the best way to get a refund, to which I asked him to tell me what he considered the best way???!!
  4. This £350 has now been returned as per my other thread today. Thanks to the website for all your help!
  5. I received a secure message yesterday evening saying sorry for the delay and thank you for giving them a further opportunity to resolve the matter (ie without going to court) and a refund of £350 has now been returned. Good luck to everyone else trying to claim back!
  6. Wow, that has inspired me! I could do with a free holiday! Right then, first thing Thursday morning if i've not got the money back i'm going to moneyclaim.gov.uk to start the claim. I'll keep the site posted with how I get on....
  7. Firstly may I just say this website is simply outstanding. I am attempting to claim back £350 from Smile (from daily excess charges and service charges) and wondering if anyone knows of any successes of this?? I sent the standard preliminary letter over a month ago, then got the general reply saying the bank charges were as I agreed to in the t's and c's, and therefore perfectly legal (of course) I then sent the 'letter before action' over 14 days ago. I received a secure messsage back saying they have escalated it to a manager and will get back to me in 7 days. Both time frames have now lapsed, so it is time for me to start the court action technically..... I notice from another thread, one user (matlow) was successful in getting his/her money back from the same sort of Smile charges and said they didn't even need to go to the small claims court. I have today sent them one final secure message giving them until Wednesday 19th April to pay up or i'm starting the court claim (which strictly speaking I didn't need to do since I had already given them 14 days timeframe) but I was inspired by the fact that matlow did not have to get as far as the court process. I would love to hear from anyone who knows of any successes with Smile, and at what stage they coughed up with the refund??? And any tip/tactics that you have found that can help? Thanks! ps If I do manage to get my charges back I would love to make a contribution to the funds since I couldn't have even attempted to do it without you people.

Congratulations in getting your refund! Just wondering, at what point in your quest did you actually get the money back? I have sent the standard preliminary letter, then got the general reply saying the bank charges were as I agreed to in the t's and c's, perfectly legal, blah blah blah. I then sent the 'letter before action' 14 days ago, and have received a secure messsage back saying they will get back to me in 7 days (which has just expired today). So it is time for me to start the court action tomorrow..... I notice from your other thread you posted saying on 31st March you were going for the court papers. And on 7th April you had the money in the bag. Did you get as far as the court action? When did they cave in and pay up? Thanks
  9. How did you get on with claiming back the charges? Just wondering because I have just got to the same stage and wanted to know if you were successful????
