Parking charge notice for parking on public highway?
magic77 replied to magic77's topic in Private Land Parking Enforcement
It is odd if that road is private but the one round the corner isn't as it is part of the same complex. I'll start my appeal as I didn't do it intentionally, thanks for your reply. -
I've just got a PCN from a private company AM in Maidstone for "not displaying a permit" in a supposedly private residential area. I parked there a week ago and read the signs which said something about the roads being public but the pavements belonged to the housing so were private and that if you parked your car on the pavement you'd be fined etc. Obviously I didn't park on them. Then a week later when I parked there again, I got the ticket. I found out the signs had been changed a few days earlier. Looking similar I hadn't read them again. What I can't understand is that according to the council's website and this has been confirmed by Highways, the road is a public highway and not private. In addition there are no residents permits. I am at a loss as to how this company can issue these tickets, although they are a member of BPA. I was not in a bay or in any designated area and there were no markings on the road itself. Any advice will be gratefully received. Thanks
