  1. Hi so the original default stays but what about further defaults applied when the loan was paid in full
  2. hi yes as that would be the six years but if the CCA didnt meet the standard can they legally apply defaults and contiue to apply defaults even when the loan was settled in full?

  4. Hi I previously had an unsecured loan with nationwide , went into arrears when i moved and got behind with paperwork when i realised i contacted them and paid the loan off in full . They had written it off apparently. Since 2014 i have continued to receive default notices every 6 months thought was as loan should still be running , however i now realise how damaging these are . I have phoned them to ask why i am still receiving these but they didnt know why , having looked at info re defaults and the damage they cause asked if they would remove these from my credit file, i have also asked if they would remove all defaults recorded against my name as this loan didnt meet CCA requirements when went into arrears and they refunded interest as didnt meet standard required. Thinking that if loan didn't meet CCA requirements they can't legally record default against my name . They have said will initiate complaint and was going to follow up with letter is there any templates or advise you can give, can i ask for compensation for the incorrect information they have recorded against me ?
  5. Hi thanks the average would be £40.00 (added a year and divided by 12 ) for the ppi will do the same for the balance. Thanks again will do over w/e, should i sent back my figures with letter or ask for their detailed breakdown first?
  6. Hi Thanks will use the other and work out again. I have statements for over 2 years worth 03/04, but some missing for 01/02. So from reading would use an average. i would then use the running sheet for the statements i have , which would be best for using average payments as wouldn't have balance etc ?
  7. hi Thanks will write back and ask for the detailed breakdown, i think i've read in the FOS that they should provide this and provide the balance so will try to find again. If they can not provide statements does that raise another issue Another question sorry they have given total of payments (which i doubt as even with an average is less than i believe paid) Refund of payments - £1234.32 Interest charges on PPI premiums £378.63 8% Simple interest per annum - £1129.06 Total £2742.01 I have found the foscis sheet which i have completed and this comes out with an amazingly higher figure of over £15,000.00 and i'm not sure as this is a huge difference!!! The interest on the ppi premiums appears to me to be very low given the credit card was charging 1.67% per month with an average balance at the time of approx £4000.00 Would appreciate your thoughts. bee
  8. Hi Have send off to the FOS and waiting , however have received letter from barclaycard stating they have reviewed the complaint and now upheld and made an offer . They do not say how they have calculated and i am concerned that this may be incorrect as they have twice sent my SAR back ,so have sent off again. I have written and asked them to provide information for the offer they have just sent back letter saying that info is based on the statements . Surprising as they couldn't find this for the SAR!! Phoned and they said they didn't have the statements . Have re sent the SAR again but they say it will be returned again. wondered if you have any advise on where to go from here? thanks bee

Hi looking for some more advise , have received a reply , standard letter thanking for my request under data protection act , stating unable to process with box ticked for account closed for more than six years and details no longer retained. They have sent back all my letters and copy of original request and postal order. The account with Morgan stanley was taken over by Goldfish and then barclarcard so i think it is still running though i camncelled the ppi in 2007 as they were charging about £97.00 a month .PPI was therfore not paid when goldfish and later barclaycard but how do i go about asking them to locate this information , bearing in mind they originally said i had ticked the box for PPI when they didn't uphold my complaint? bee

  12. Hi just got a reply back from the SAR saying they were unable to locate an account based on the information provided. I sent the details, name, account number, previous address . They have returned my request letter and the postal order. Strange as they stated they had identified my application was by post as mentioned before and did not uphold my complaint. Do you have any advise as to what i do now?
  13. still not had any response , sent the letter with all the copies of application for loan , for loanguard, copies of bank statements and the spread sheet for calculations. No reply i have sent them another letter as now weeks since the last letter. I presume if again no respnose i go the FOS and join there waiting lsit or do i put in a formal complaint?
  14. Hi Thanks for the above , will photocopy the agreements and send back with letter, was thinking can i request they reply within say 14 days ? If they then still wriggle i will go to FOS but if i give a time to respond i can then refer on quicker. By completing the spreadsheets i assume i then wouldn't have to send them years worth of bank statements(could be costly) showing the payments as on the spread sheets you record the dates payments taken . bee
  15. Hi Looking for some more advice. Have at last received received information from my SAR only taken 83 days!!! and have not received any copies of loan agreements, or applications!!! They have provided a sheet 'Loan Information which interestingly states in a column headed Insurance Premium Nil next to each one!!! Followed with 'where possible we have included documentation relating to your loans with PPI' , but none provided.followed by' If you require any further dat pertaining to your loan(s) without PPI please advise us accordingly and we will endevour to locate the loan agreement(s). Do i continue to chase this paper work ? or do i send them the soc (presume that is spreadsheet) with the copies of the agreement i have and copies of my statements which prove it was paid. Raises questions as to how they can record such inaccurate information.
  16. Thanks Freelance good to know others in the same boat. Wills do the SAR as IMS suggests and see the info they have , i have my statements and interestingly have ammended terms and condirions in the file but not an application. I also cancelled this policy in 2007 as i would have been unable to claim as self employed but didn't know i could claim back untill recently. . Bee

Hi Thanks was just checking this again will send my letter/ info back to RBS in first instance the Mortgage Loanguard Protection is shown as £9.81 (free for the first three months) So i am assuming this is added in the total amount paid over the term in the section Total charge for credit (including all term assurance premiums, charges, fees and interest.)

  19. Thanks, will do the SAR , was reading on another thread, said to mention info relating to Morgan Stanley . Do you ammend to ask for copies of application specific to Morgan Stanley? i think it was processed by phone , though a long time ago but do not recall completing an application form. Also though they say final decision and to refer to FOS you can challenge them and they will respond? Bee

Hi Received final response from Barclaycard to say identified my application was by post ( i do not recall completing)' and ... accurately described the scope of the policy, and was sufficient to provide you with all of the information necessary to inform you of the terms and conditions of the policy.' As a result we are not able to uphold your complaint. As self employed i would not have been able to claim and i do not recall reading or completing. Should i send a SAR first and refer to the FOS at the same time or wait for the SAR? bee

  22. Hi Have received reply to say they have checked Mortgage application and didn't tick PPI therfore not paid. I have the loan application form and can't see PPI anywhere on it on a tick box, i have the mortgage quote from mortgage centre which shows insurance premium paid monthly included in total amount for the loan which talleys with the amount i paid on the mortgage. They have said that doesn't mean i paid it which seems a bit strange. They say if i have evidence to send to them, they have still not replied to SAR, but have sent a letter to say they are trying to locate documents. As they say they have checked the mortgage application and this was an Equity Release loan application sound like they have checked the wrong document. Should i send them the info i have or just forward to the fos?
