  1. Checked my credit file, Had a default from Arrow for £9.52.

     

    So i sent them a letter asking for a CCA agreement (was unaware mobile wasnt covered for this).

     

    They have responded with the following

     

    Thank you for your letter dated 29/03/2014 and acknowledge your request for documentation pursuant to the Consumer Credit Act 1974

     

    The agreement with Orange was not regulated by the above statute, being a service agreement for provision of airtime and/or telephone handset/equipment.

     

    We are under no obligation to provide documentation which has previously been supplied. This is evidenced by the payments you made prior to allowing the account to fall in to a default state.

    This account is currently being operated on our behalf by allied international credit, please direct all other enquirers to them.

     

     

    After some advice to go back at them, My next approach will be my SAR request - how ever mobile phone accounts are somewhat hard to over come, its very annoying to be default for such a small number.

     

    Any tips and advice would be most welcomed.

  2. Hi NCP, sadly for me nothing happened. I tried all avenues including the Ombudsman, trading standards and the advertising standards authority but they all came back stating they PDUK had done nothing wrong as the wording had been wrote in a way that suggested it will improve your credit report but doesn't actually say there loans will improve your credit report if that makes sense. I have since wrote to PDUK asking where they got the evidence from which allows them to make the claims they make and I just get a snotty letter back revering to the Ombudsman's decision and that they will not discuss it further. Im not sure if anything can be done to be honest, if you have any ideas please share them as I would love to get these wiped. James

     

    James, do you still need these removed. I have copies and screen shots of their site stating the following "This will help your credit rating" this information was on their website from mid 2009-early 2012. I'm currently using this information coupled with irresponsible lending .

  3. Hi everybody,

     

    I'm after some advice regarding this hideous company.

     

    Back in 2011 i received a notice to default letter, believed i paid the balance in full straight away.

     

    My credit file has a default date registered for the 14.09.2011 for £314 with a settled date of the same date.

     

    I never received any further correspondence from them after this point, no 'you've been defaulted' letters, nothing.

     

    Apparently, I never paid this balance on that date, according to them i paid it on the 31.01.2013 (Yet my credit file has the date of the 14.08.2011).

    I've contacted the CRAs telling them that the data is wrong, The response from capital one was that ' all the data is correct ', meaning the settlement date would stand?

     

    It was also pointed out that the default amount was wrong, because they had over charged interest between April 2011 and April 2012 (The account was refunded this, 96pence).

     

    So id like some advice on what todo as i've complained about this and its on going, but i thought id get some advice in to the following:

     

    1. Reporting incorrect data to the CRAs (Dates, Amounts).

    2. Overcharging interest.

     

    This matter is being delt with by somebody at the 'Executive Response Center'

     

    I'm looking for some advice as to if any what rules/guidelines/legislation they have broken, As i have a feeling this will be going to court,

     

    Ideally id like them to remove any trace of themselves from my credit file - as they clearly cant handle my data in an accurate manner.

  4. Capital one have supplied factually incorrect information to the CRA

    Default ammount is incorrect (£1 more than settlement figure I received )

    The settlement date has been supplied wrong.

     

    I have contacted them, informed them of there mistake and they won't change it.

     

    Also contacted the CRA who looked in to it, and capital one replied saying that "all information supplied is correct".

     

    When I have evidence it's not.(bank statmebts, corrosponace from capital one).

    Slightly odd question, have looked though the forum but cant seem to find anything on it.

     

    if the data provided to 3rd parties about you by your credit card company is factually incorrect, are they in breach of the DPA or CCA, If so do you know what section?

     

    Also who is responsible for ensuring the accruacy of the data displayed on the CRA, the supplier or the CRA?

  6. I personally think they are in breach of the mis representaion act as well as responsible lending.

     

    They also breach the consumer protection from unfair trading regulations section 5 s.5 (b) and s.5(q)

     

    Have an appointment this afternoon with a local consumer solicitor. They simply can't be allowed to misrepresent / inform customers that there product would do something. When it doesn't

     

    Now I have a few years un till these marks are taken off. I will use this time and explore all avenues.

  7. ah greenwood and their agents and what they get up to and suddenly disappearing for syndrome.

     

    send greenwood a CCA request.

     

    if the address etc on their copy of the CCA is not right

     

    then you can demand the default removed.

     

    'what' you actually do about 'what' you borrowed is your next problem.

    They have stopped communicating, I called the FOS for some advice and they opened a case against them.

     

    Receieved a letter from BCW , called them explaing the situation, and they refused to take a payment and have returned it to green wood.

     

    Based on the reply I get from the Fos, will dictate my next move. Personally I wish to take them to court, its about time these companies cleaned up there act.

    Has anybody actually succeeding in getting wonga Todo anything in relation to this,

     

    Took two £50 loans in a 12month period to 'do wounders for my credit'. Always paid in full and early. Didn't need them but based on the information they gave.

     

    Turned down for mortgage because of this, going to attempt to put a case together against them.

     

    Thoughts ?
