  3. Hi Guys, I am hoping someone can help me with an issue I have. Its slightly convoluted but bear with me. On the 1st of Sept 2011, a bailiff came knocking on our door at 630 and my 8 yr old daughter opened it and the bailiff asked for my wife, daughter tried to shut the door and call mum, but she says he prevented her from shutting it. By the time mum came down he was in the porch and requesting for £440 for a ticket issued in Nov 2010, wife said she had not notice of it and wanted time to contact the council, he said they had been to the house a few times before but there was no evidence as such. We asked for a copy of the warrant which he said was on his PDA and we argued that it should be a hard copy. To cut the story short, we offered to pay £100 which he refused and then proceeded to take goods from the house including my PC and printer, a wii and xbox, tv and a few bits. I took out an injunction as some of the goods were mine not the wifes, and had a court hearing this week, which was dismissed. The points the judge stated were that it was not a legal requirement for the bailiff to produce a copy of the warrant when he took the goods? Does anyone know of any legal cases where this has been proved wrong? I am mindful to appeal, but have 14 days. The warrant itself which only appeared a week before the trial date states that "if your possessions are seized, you will be left a notice of seizure of goods, and an inventory (list of items seized) together with a copy of this warrant) The judge was of the opinion that this meant the first two documnets were legal entitlements, while the warant fell under good practice, I guess because of the word "together". Any help gladly recieved.
  4. Hi guys Have had my car clamped this morning for an outstanding ticket and have had to pay £670 pounds to have it released. I have contacted the Northampton TEC, who sent me an out of time dec form to fill in. What can I realistically do having already paid the fine, ids there any recourse to get my money back. There was a charge for £290 for clamping and £35 for HPI phonecall? Any help will be greatly appreciated, John
  5. Hi Everyone, I came across details of a lady and her website who may act on your behalf to get back extortionate bailiff fees, but I can't seem to find those details anymore, can someone please point me in the right direction.
  6. Got a reply from KJ, offering 3.5k of 5k. Those who have gone before, did you haggle? Also can I insist they pay into a different account?
  7. Update: After sitting down waiting for a court date, decided to call KJ, who is a very nice maan and says he will speak to his bosses and get back to me re. my 2 claims, about 5K in total. I expect to hear from him within the next 2 days.
  8. Have 2 cases with Barclays, about to send a questionaiare for the first one and waiting for their defence on the second.
  9. Today was the last day for Barclays to enter a defence on my first claim. Lo and behold at 10am they have entered one. I guess I now wait for details of their defence. Anyone ahead of me in the queue know what happens from here on?
  10. Today received an offer of £1100 for the £2629 woolwich claim. Will be going straight to court. Have filed the first claim, I am awaiting a barclays response. Has anyone got a result since refusing the 50% or initial offer?

    Wow!!

    Does that mean that Utility companies are not allowed to charge penalties? I got charged £120 for a so-called visit to discuss my arrears, though it was not a visit but someone threatening to cut off the gas?
  12. Just received an offer 0f £415 on charges of £960, will be going to court.
  13. Thanks for this great site, requested statements last week thursday they arrived on saturday paid £5 for the pleasure. Sent off the initial request letter on saturday total charges over the last 2 years £285. Will keep you posted. Also sent off a woolwich claim for £960, an account that I stoppped using about a year ago because of the cycle of charges and going overdrawn. Awaiting statements on my wife's account , that will definitely be in the £0,000's. After that will start on an old TSB and Halifax account, as well as Capital one and Sainsbury's. Will start a credit card thread for those.
  14. Hi, I am starting a Woolwich claim, I called today to ask for my statements, they said it would cost me £360 for all of them, is that right, £5 a statement? They have lodged a complaint for me contesting the amount. John
