    I only came across this today. It seems I am in a similar situation to yourself. I took out my mortgage with my husband in 1982. I have been questioning my interest payments and payments for a while now and it was only in 2017 that I was informed my Mortgage with Santander was changed in 1993 and extended from 25 years to 43. I also copies of my account showing I was on interest only for months and capital payments for 201. Paper work is everywhere. I am still trying to get my head round it and I also have a complaint with FOS. I will let you know how I get on. Obviously, Santander didn't get through to all their customers. I am attaching a couple of files for you to look at too. I discovered them when I was searching the internet for any information I could get. The other one is ombudsman news issue 43. ombudsman news issue 35.pdI couldn't add that one as the total size uploaded was too big.

      I've not paid them since roughly last May (2022) . I was in credit. I'm in a slightly different situation than you as mine is a regulated credit agreement, i've told them to take me to Court. I'm not suggesting you do that BTW. They have never asked me for a payment yet.

       

      Couple of things may help you:

       when i found out that my term had been extended, i was told it was because when my mortgage completed i didn't pay the correct interest rate. Now when i got my SAR back, it included everything exept for the first two years mortgage microfiches. And the next two years had the interest rates redacted.

       

        What i did was send a request to mortgage operations to ask what where my expected payments for the first four years, and i rang up the general mortgage line and asked for my first two years statements and got them and it showed i made the correct payments asked for. I also contacted the SAR team again and they give me the missing interest rates.

       

        I then checked my original quotations and all their figures are well off. None of their mortgage payment calculations add up correctly. I came to the conclusion that they had a problem with interest rates and had charged people the incorrect amounts. Rather than tell anyone or correct the mistake early, they tried to hide it by extending the term and saying nothing.

       

      You may see on your statements.... "first movement on account  1st January 1993" , also on your statements it may show "original loan balance" as different to what you did actually start out with.

       

      I'll be very suprised if you get anywhere with the Ombudsman. Here is what they will tell you...what you are complaining about happened in 1993 (the term extension), so its outside their time limits of six years since the event. Then they'll say..... you've known since 2017, so thats longer than 3 years that you have reasonably known about it. I hope i'm wrong, but i doubt it.

       

      What you might be able to try if you havn't said too much to the Ombudsman already is if the balance on your statements is actually different than your real starting balance maybe raise that as a new separate complaint, with Santander first and then Ombudsman.

       

      The way i see it is that if your term just extended , which you know about, then the original amount should be the same. If the original loan amount is actually different than your real original loan amount then your loan has been reconfigured and you'll need an explanation. If that makes any sense ?

      Thanks for this. I wish you well with the FOS, they would absolutley not enertain me at all over the matter. I've also compiled a file which the FCA asked for, and i'm adding to it. There will be plenty more of us, but due to the length of the agreements and people not finding out till many years later most of us would be 60 years old plus.

      I have links to more news articles that are a bit obscure and hard to find, i can post them up for you if you want me to.

          Keep us informed how you go on. Oh, just incase.... make sure you send a Subject Access request to them so you can obtain everything. I got everything going back to my original application etc.....
