Hi Slick,
I had already replied to Esther but I will do as you suggest and send another e-mail anyway.
-
Today I received this reply from Esther at X4Less
Good afternoon ___________Please accept our apologies for the fact you have been contacted by Spratt Endicott
I will inform them today that they are not to make any further contact with you
Kind regards
Esther
She then e-mailed me again asking me to forward her a copy of the correspondence from Spratt's
-
Thanks Slick,
I will let you know if I have any further communication from any of them.
-
Thank you so much for your help slick.
I have sent the e-mails and have had an immediate reply from Spratts.
Dear _______
Thank you for the reply.
I can confirm that the email was sent in error to you and that your matter with us is closed.
Regards
-
Hi Slick,
While compensation would be nice I really just want them to back off and for this to all be over.
-
Hi Slick,
I have had no reply from Esther and X4Less. I wrote by e-mail, I just replied to her last e-mail.

Tonight I have received another e-mail from Spratt Endicott, exactly the same message as before...

Thanks Slick, I have done just that. I will let you know of any further responses.

Just as I thought this might have been over I have received an e-mail from Spratt Endicott today (at 18.40 - strange time?) saying they have been trying to contact me (they haven't) and asking me to give them a call which I have no intentions of doing so.
Should I just let X4L know that I am still being contacted and demand that this is stopped?
-
Should I reply to that or just leave it be now and wait to see if I recieve anything else?
I'd like to thank you both very much for your help and advice over the last six months, it has been very much appreciated!
-
I think we have a result!
Thank you for sending this evidence throughI have recalled your membership from CRS and removed the charges
If you receive any further correspondence from CRS within the next 5 working days please ignore this as it will have been sent in error.
Kind regards
Esther

Thanks for your advice, I have sent them the proof of delivery along with this...
Please find attached copies of my letters dated 28th October 2015 and 2nd January 2016, along with the proof of postage reciept, if you type the barcode number into the Royal Mail website there is your proof of delivery. These are the letters that you decided to ignore and claimed not to have recieved. I have already provided you with proof that I entered into a Debt Management Plan with Step Change in October.
I stress my continued disgust at Xercise4Less' treatment of it's customers, you have still failed to satisfactorilly resolve this issue or even address my complaints, having ignored me on three occasions. I demand that this is escalated within your own complaints procedure and I will be writing to your CEO if my account is not closed and all collections activity ceased.
-
I've had an e-mail from X4L this morning asking me to provide the proof of delivery which I will do tonight.
Good morning,Please send over the proof of delivery that you have.

Healthy Regards
Will

It looks like they have stopped responding to my social media posts insisting I message them.
Should I take any further action or just wait and see if X4L/Harlards/CRS/Spratt send me anything else? Would it be worth writing to X4L CEO or just a waste of time?
-
Thanks Slick,
I have replied to their post.
-
X4L have replied to my post on Facebook asking me to inbox them.

I have posted this on their Facebook - https://www.facebook.com/Xercise4Less/posts/1121294247937069

Hi Slick,
That statement is from here - https://www.citizensadvice.org.uk/consumer/changed-your-mind/cancelling-a-gym-membership/
If you can’t afford to pay anymoreYour gym should let you cancel your contract if you’ve had a change in circumstances that means you can’t afford the monthly payments. It would have to be something significant, eg you’ve lost your job or suddenly found yourself in a lot of debt. You’ll need evidence to prove this to your gym.
Talk to the manager at your gym. If they won’t let you cancel, you should say the following (or put it in writing):
“The Competition and Markets Authority advises that a gym contract is unfair if it doesn’t let a member cancel because they’ve had a change in circumstances which means they can’t afford the membership.”
I will make a post on social media, thank you.

I am thinking of sending something like this to X4L, but I will wait for your advice first?
I am very disaapointed that you have decided to continue to ignore me following the below e-mails.
You first ignored my letters dated 28th October 2015 and 2nd January 2016, claiming not to have recieved them despite me having proof of delivery.
Now you continue to allow Harlands/CRS and now Spratt Endicott to harras me, despite me providing you with proof that I entered into a debt management plan with Step Change (which you asked for in the below e-mails)
The Terms & Conditions when I joined state that the agreement can be cancelled due to redundancy 'or other loss of livelihood', and further to this, the Competition and Markets Authority advises that a gym contract is unfair if it doesn’t let a member cancel because they’ve had a change in circumstances which means they can’t afford the membership.
I trust you will now tell Harlands/CRS/Spratt Endicott to stop harassing me and put a stop on all collections activity.
-
I have now received a letter from Spratt Endicott threatening legal proceedings.
I have had no further contact from X4L since I told them that I wish to keep all communication in writing on the 17th March.
-
Will do, thanks Slick!
-
-
Thanks, there is no reason why my number should be incorrect anyway. My local club was able to call me when I first told them I had to cancel the direct debit and I haven't changed numbers.
-
Hi Slick,
The contact was by e-mail.

Just to update you, Esther has copied me into an e-mail that she sent to Spratt Endicott today.
Shortly afterwards I received the exact same reply from Spratt Endicott that they sent me last week.
