  1. am obsessed by this site, but am very worried now, heres my summary: 9/10 request for repayment 25/10 LBA 10/11 offer of £2000 against a £3000 claim 14/11 DG intend to defend 29/11 DG request breakdown 1/12 I supply breakdown 8/12 A & Q issued Form N149 I received it today 12/12 deadline for me to respond with £100 fee is 27 December. Am stressed now. Foolishly thort it would be a simple process. Will have to rob peter to pay paul for the latest court fee! Wrong time of year for all this. But I do no that I have got this far so got to continue now as already paid £120 in court fees. However, having said that, at the hearing I'm not sure I will be able to put my case across, I have no legal representation, I would not have got this far without the site, I feel I will be lost on my own. If I lose will I have to pay the bank costs. On the court form they have not indicated they are counter claiming? i wonder if this means I wont have to pay their costs if I am unsuccessful. Now wish I had accepted the initial offer, what do you think, anyone with a similar experience?
  2. oh my god but don't panic, you still have at least 3 weeks to do something, but you will have to put in some hard work yourself. Keep reading all the different threads for inspiration and I am sure you will at least suceed with some sort of adjournment for your first court date, which will buy you some time. Contact your local Welfare Rights Office usually at your local council or similar dept at council. Once you have started your claim against unfair bank charges you should be able to use this as some sort of lever against your court date on 22nd Dec. Whatever you do decide to do, don't do nothing. Believe me in the field I work in, too many people bury their head in the sand and don't do anything until the day before the court date, it really is too late then. You have loads of time, although to you it won't seem like it. GOOD LUCK.
  3. hi trevor been following your case, any progress yet. I am a business account holder with lloyds tsb thinking of claiming too but its daunting, like to know how you get on
  4. cheers, thanks for advice will ensure I research thoroughly before the next step.
  5. I have just realised after reviewing all my paperwork that I have claimed the wrong amount from smile I have stupidly calculated interest at 8% which I now realise to be incorrect. I have sent my final letter to smile asking for £2300 plus interest which put the claim over £3k they secured messgaed me to say I would have a reply by 2nd oct, no reply rec'd and although I have secure messaged them twice since the 2nd I have still not heard anything. I want to enter a mcol but should I send them a letter saying realise mistake I have made and give them another 7 days to cough up? Be really grateful for any advice
  6. Yes you can, look at the barclaycard forum, basically you follow the same rules as bank
  7. hI all Fairly new to all this and need some advice. Sent sar to Barclaycard in june and got the standard micro argument back again. Sent alanfrom Derby template letter stating the smith vs lloyd case and received a response from BC saying that case fully supports Bcard decision!!! Clearly i have made a mistake somewhere!! I have basically sat on their response and not done anything since mid July however i really would like to send them a letter with estimated charges which I have calcullated to be £880 can someone give me some advice on what letter to send, would I just use the standard LBA template? also do I still need to send a schedule of charges?? Really appreicate some advice as I want my money back!!!!!
  8. Help!!! I am a total newcomer but have been avidly reading all the posts re barclaycard. I have sent a subject accesss request and got the usual micro argument back I then sent template of alan from Derbys letter quoting the smith vs Loyds bank case and barclaycard basically wrote back saying that case actually supports Barclaycard positiuon so why you quoting it!!!!! Clearly do not want to make another mistake and do not want to pay the £3 charges for missing statements so want to sent in an estimated claim (around £880) , what letter should I send? I got my last letter from BC on 21st July and have basically sat on it - please help as i want my money back!!!!!!!!
