  2. Unless of course they have taken more in unlawfull charges over the years than you have paid, in which case they owe you money. Happened to mate of mine with Lloyds, turned out they had charged over 1200 quid in charges for an original debt of 400. Guess what they owed him 800 quid plus interest
  3. Carrie, IF also sent me a list of charges free of charge, but what they didnt provide was any info on manual intervention or lack of it so if you want to be fully prepared then possibly a letter regarding this needs to be on file. Up to you though, sounds like you are on the ball with this

  6. Hi Carrie My advice would be to sit down and go through all the FAQ's on the site. start with your SAR if you dont have statements, to IF and anyone else you may be claiming. Dont rush things get everything in writing and go through the step by step stages. Get it right and you will get your money back and hubby will give you a pat on the back as will we all Claim

  10. Hi I'm in almost same boat - just received ist settlement after small claim - owed approx £5k, but decided just to keep on with the small claims - next one in day or so. Good luck with your Summary Cause - let us know how you get. not that you need luck C
  11. spot on Charlie, what do we have to lose and if they think they have to then lets do it. incidentally, have you asked Nationwide for the full amount now they have settled one claim (could be their stance is a bit weaker) or are you just going to put in the claims one after the other. I am in 2 minds with my own.
  12. I just used the English one at the time there wasn't the separate scottish one. Lots of threads say go for it as most banks dont know the diff between the scots law and eng law
  13. I was just doing the same, fruity, so i think back to small claims. sometimes you get more confused the more threads you read. I was quite definate in my mind to go back to BOS and say give me the lot now, but on reading various other threads you start to feel they wont anyway and it alerts them to the big picture before we go down the court route, so now i am in two minds as to what to do next for the best. And of course the banks read these too and see some dithering and unsure people.

Fruity "The persuer claims from the defender the sum of £749.99 with interest on that sum at the rate of 8% anually from the date of service for each charge together with the expenses for bringing this action." You then have to attach the spreadsheet (get from the template library) with the amounts, dates and the interest is worked out for you and that is your whole claim. Example would be - Refund of £750 plus interest of £22 plus cost of £39 court fee, total due £811.00 You can only charge this interest and court fee if you actually do take it to the small claims court, you cant include it in your LBA's etc. Hope this helps

  16. The spreadsheets for addition of interest in Scotland are in the template library. I used Scotia's example and filed for my refund plus interest at 8% plus costs. I got the whole lot back although there was some snide comment in their letter about the interest being MY estimate and they didn't have the time or money to check it. I also not sure of best route now re summary clause or England or continue with small claims. In light of their recent letter their case for future digging in of heels is weakened so am going to ask for it again politely and then sue if they dont respond. C
  17. Tink Have replied on another thread but for continuity on your thread i would say it is your claim, they have not settled fully, so you can remind them of the fact that you cannot advise the court that the defender has settled your full claim untill you receive interest as well. C

  19. T To answer your question, BOS paid the interest and court fee separately from the refund. However it was paid in on the same day and without pushing from me. I now have £5k to claim and have already worked out that another £1k in interest would be due by going down the court route. That might therefore still be an option as if they purely settled now (some chance !) i obviously would not be able to charge them the 8% interest. I am therefore going to write to them again in light of their settlement as it will have both shown i am serious and weakened their future refusals. I am going to as a gesture of goodwill offer them a further 7 days to reflect, provide me with a full refund and i might just not take them to court. C

Now that BOS have refunded my first small claim do i continue down the route of £750 chunks or try to claim the £5k in an english court. My LBA for the further amount is up in a week or so. Any advice greatly appreciated
  21. Stay firm cause you are right - if the claim included the 8% interest then that's what you want

  24. I filed court papers on the same day in Kilmarnock Sheriff Court and was given the same hearing day 12/9 as you. Today i received the refund letter for the full amount & the 8% interest and the court fee. Yours will be soon
  25. Received letter from Bank of Scotland today. They are not admitting any liability and will refund my total claim on a purely commercial basis.
