Is there anybody that knows about car repossession in Scotland. I phoned the finance company in march after missing 1 direct debit . I explained that my circumstances had changed and that I was struggling to make the payments. I asked if I could extend my loan of a longer time to reduce the payments & I was told no . I asked if they would be refinance me if I traded my car in for a much smaller & cheaper car again I was told no. I asked if I could give the car back & I was told I could not give the car back because I was in arrears . In total I had paid including £3500 deposit totalled to £8500 . I cancelled my direct debit I'm may . I felt that I had no other option. I couldn't afford it & I didn't know what tense to do. Meantime my business was failing , my health was failing & the stress was indescribable . I buried my head in the sand . I tried to sell my car to garages but I was not offered enough to pay off the finance and the arrears . I phoned the company asking for advice but the were unsympathetic & cold . again I asked if they would take the car back , again "no" was the answer. I received letters stating that I had to pay or the car would be taken back . After more phone calls someone said to me that I could give the car back & I would only be liable for the the shortfall of the money after the the finance company sold it, this was in October , so why wasn't I told this earlier. Well they said that I was , only the way they had told me , I think was wrong. I was told months ago that I would have to pay the arrears before they would take the car back . Which I have now been told that I would have to pay the money after the sale. I have been through months of stress . I have paid £8500 , I owe £6776.88 . Can the finance company repossess the car in Scotland , please help ,,,
