  1. Ive now received a reply back from Lowell. They acknowledge that they've received my letter and note my attentions to defend the claim but say that they have yet to receive my AOS? The letter also confirms who the debt is for, when the account was opened and the contact number. The letter also states that as it is a telecommunications account they are not obliged to provide me with a copy of the agreement or the default notice. They confirm that they have requested copy statements which will be forwarded to me upon receipt. The letter shows the date and amount of the last payment, when the account defaulted and the balance. They have also sent a copy of O2's letter to me stating the debt had been passed to Lowells and the original letter from Lowells stating they are taking over the debt. So where do I go from here?
  2. I've just finished filling out the CPR 31.14 request but I'm unsure what i write in the area that says 'in this case issued by you out of the (Name) county court'. Do I need to put the full address in or just the name?

Can't remember but probably yes Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? Again not sure Why did you cease payments? Couldn't afford repayments due to change of circumstances What was the date of your last payment? Don't know Was there a dispute with the original creditor that remains unresolved? No Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? No

  5. Hi, thanks for the quick reply. Ok if I do this to give me extra time what do I do Next? As I said in my previous post I can't remember all of the details, what if I am liable for the debt? If so then wouldn't I just be delaying the inevitable?
  6. Ok things have now got more serious. True to their word Lowells have now sent me court papers for the debt. The issue date was the 30th Nov and it says I only have a short time to reply. How long do I have to reply and what should I do next? As I said in my first post any help would be grateful but please keep it simple so I can understand exactly what I need to do. Thanks
  7. Sorry for the late reply. Unfortunately I can't remember much about the debt as my memory has suffered after my last breakdown, as far as I can remember it was because I failed to pay to pay the monthly payments for some reason and so they are charging me for the full contract. Just to be clear are you advising me to ignore the letter as it's just another form of threat-o-gram? Also I don't think I have any details regarding the contract so can I still request a SAR from O2?

I've received a letter from Lowell solicitors today over an old O2 debit from 2012 I think, for just over £570 including their costs stating they are going to commence legal action against me in the county court bulk centre. It's says I must contact them or make arrangements to pay in the next 14 days or a claim will be issued without further notice, if a claim is issued I will then become liable for the costs. Could someone please advice me on what I should do next? If you can help could you explain it all in the simplist terms as I'm not very good at understanding these things.
  10. Thanks for the reply. I received the first letter from G24 about 2 weeks after I parked there in May, I ignored this and didn't get another from them until about a month or so after that. I then heard no more until DR+ contacted me last month.

  12. Hi guys looking for a bit of advice. In May I overstayed in a car park for 20 minutes while waiting to have my kids faces painted at the Smythes toy store, at the time I didn't know that there was a time limit for the car park only found out a few weeks after when a letter came through showing my car entering and leaving the car park and requesting I pay a £60 parking charge. After reading up about these things I choose to ignore the letters, last month I then received a letter from DRP saying they had been requested by G24 Ltd to recover the charge which had now gone up to £160, once again I ignored it thinking they were just bluffing. I've now received and even more threating letter stating that this is a notice of intended court action if the sum of £160 is not paid by the 18/12/15, they then go on to quote the Beavis v Parking Eye Ltd where they say the parking charge was legally enforceable, and if it goes to court I would Be liable for additional costs from the creditors plus court fees and solicitors costs. So what should I do? Ignore it? The photo of my car entering the car park doesn't even show who the driver is, I've also since been back to the car park and there is a s small sign on the entrance and a few put up in different places around the car park. I can't afford £160 especially this time of year and it's starting to worry me. Hope some one can help, thanks.
  13. Hi, I'm hoping someone on here can give me advice on what I should do next regarding my broken samsung tab3. I received the tablet free from talk talk when I took out a mobile contract with them in September, about 4 weeks ago it wouldn't charge and when I took the charger out of the tablet a small piece of flat metal fell out. I contacted talk talk who said it was down to samsung to repair and put me through to the Samsung repair department. I sent the tablet to Samsung repair and received an email a few days ago stating the damage wasn't coverd by the warranty and it would cost £93 to get it repaired, I phoned them up to query this and was told something must have been pushed into the socket to damage it, I explained the only thing I had put in the socket was the supplied charger. I was then told to contact samsungs customer services and explain it to them to see if they could help, the person at customer services was less then helpful and just kept saying they stand by their engineers report. When I asked to either escalate the problem or to complain all I was given was the head office address. What I would like to know is what do I do next? Contact talk talk or Samsung again?

I'm pretty sure, though I might be wrong, that we were still using calor gas for the heating at the beginning of the year but at £130 for two bottles that only last 3 weeks we stopped using them. You could be right though and thats whats bumped the bill up, still surprised by how much though. Ok its looking more and more that the bill may be correct and if so I do owe BG that amount which I have no problem with. My concern is that I can't afford to pay it back in one lump sum and also can't afford the DD payments they've asked for as mentioned in my first post. If I am paying them what I can afford i.e.£120 a month can they still force a pay meter on me?

  18. I did try and do it online after the phone call but it wouldn't accept any lower D/D than £198. I had 3 D/D that were cancelled for some reason and as i said the other two companies were fine about setting them back up again. I agree that sending a meter reading every month should make things much easier but other things sometimes get in the way and I can be quite forgetful, but still I wasn't expecting such a huge difference. I appreciate that we probably may use more electric than average as we have no mains gas and so have one oil filled electric heater in the front room and an immersion heater for water but over £600 more! I was just surprised at how much more we have apparently used but also the BG stance of either pay it all or have a key meter fitted, no middle ground. As I said in my previous post I was willing to stretch, and it would have been a stretch, to £120 a month, £40 extra than what I had been paying but that still wasn't good enough. Like many people I'm on minimum wage and things like this worry me sick, if they keep increasing the price but my wages don't increase then I'm never going to be able to pay it off and I will be in debt to BG for ever
  19. Hi All I was hoping somebody might be able to advice me o how I should proceed. In December a number of D/D failed due to my money not being in the bank on time and with the hussle and bustle of Xmas and new year I didn't really notice but as soon as I did I contacted all parties concerned to reset up the D/D and everyone except BG were very helpful. Our previous D/D had been £80 a month which was slowly bring down the amount we owed them (about £200) plus paying the bill, when I tried to set up the D/D again they refused unless I gave them an up to date meter reading as it had been estimated since last Feb when they got their last actual meter reading. I rang them back with new meter reading and was shocked to find it was over 3700 units different to their estimated reading, once this was added to our current bill it came out to over £800!. The other problem was because we had missed another D/D in June because of similar problems they wouldn't or couldn't set up a D/D. The options I was given was to pay the whole bill or go down the key meter route. Obviously there is noway I can afford to pay them over £800 and I don't want a key meter, eventually after he discussed with the billing dept he told me he could reinstate the D/D but it would be for £198 a month, again I can't afford that but to show willing I explained I could stretch to £120 but was again refused so once more I was left with the two initial options. I finished the phone call by saying I would pay BG £120 at the end of the month when I get paid and then the same amount each month and possibly more if I have any spare money. I was still told this wasn't a good enough solution but would stop me from being disconnected and the debit passed on to DCA for this month. But I would have to either pay the bill in full or have a key meter, no other options. Can BG do this if I'm trying to pay off my debit? Any help would be appreciated.
  20. WOW thats a lot of info in the second link and to be honest couldn't really get my head round any of it. I'm starting to fill out the FOS form and have got to the bit where I need to explain what my complaint is. On my first attempt I ran out of room as the text box seems to have a limit on it and so now I'm a bit unsure of what I need to write, I want to cover the details of the complaint without leaving out any important details but also don't want to fill it up with rubbish. Any help on how and what I should put down would be gratefully received.
