  1. Heyup I want to send a cheque for 5 % but cant find the CAG address anywhere?? I cant use pay pal here in Abu Dhabi for some reason so can only send a cheque , someone post it or pm me please so I can make my donation to the cause. cheers

That was easier than I thought it was gonna be so dont get downhearted guys with all the BS and back peddling they do, follow CAG advice and guidance and you will win:cool: 5% cheque on its way guys , well done and thanks so much for making it possible. cheers Tony

They had offerd half but have now come back with this offer which is cool by me. 5% on its way as soon as I recieve the check and its cleared and I sober up Ha !!! another one up for the hard working man/woman in the street eh. Hope it comes before Xmas

Hi Guys, Yorks/Clydesdale have decided to defend aginst me and sent the standard defence that everyone seems to get, they are still asking for the case to be struck out due to the joint acct names BS. I will over the next few days answer the AQ and in the comments ask the judge to refer to CPR 19.6 (1) and refuse their request to strike out. Any advice on the next stage guys?? cheers:D

Hi guys, check out my posts tony ice v yorks bank on this subject, they tried the same with me but i looked into it and found CPR19.6 (1) will most likely nullify their objection as it states any one of the involved parties can begin a claim. Ive faxed/wrote to Clydesdale legal services and informed them of this and so far had no reaction
  9. Thanks Caro, as yet I havnt actually recieved any thing in the post from the court. How long does this normally take? I thought moneyclaim would wait untill the time is up for the defendant ( York bank) and depending on thier response or lack of it then send me AQ package etc, is this correct? cheers:)

Hi BF, I dont think you are concentrating quite enough mate, read my post of 12th Oct in reply to Caro and you will see that I did send full schedule of charges both with Request for payment and again with LBA. After this Clydesdale bank legal services dept claimed I hadnt complied so again I faxed them the same as I had sent to my local branch so in all thats three copies of charges summary they have had, Im using up a lorra trees here. My question now is am I right about CPR19.6? .Should I counter their threat to have the case struck out with a letter telling them I will counter their request for strike out with a consideration for CPR19.6 to be taken into account or do I have to have the claimant details alterd as Clydesdale have told me i have to. I hope Im being clear with this issue. cheers
  11. OK Guys, Ive done a bit of digging subsequent to my last post. CPR19.6 states Representative parties with same interest 19.6 (1)Where more than one person has the same interest in a claim – (a)the claim may be begun; or (b)the court may order that the claim be continued, by or against one or more of the persons who have the same interest as representatives of any other persons who have that interest. (2)The court may direct that a person may not act as a representative. (3)Any party may apply to the court for an order under paragraph (2). (4)Unless the court otherwise directs any judgment or order given in a claim in which a party is acting as a representative under this rule – (a)is binding on all persons represented in the claim; but (b)may only be enforced by or against a person who is not a party to the claim with the permission of the court. (5)This rule does not apply to a claim to which rule 19.7 applies. So in my understanding as one of the parties with the same interests I have the right to instigate the claim without needing to include the other party name. Am I right or wrong here??
  12. Recieved a letter now telling me I should have included two names in the claim as my account is a joint account so have failed to comply with CPR19.3 . I have to reply to them in 7 days telling them if I intend to have claimant details changed or they will apply to have the claim struck out as per CPR3.4(2) I wasnt aware that both names of my joint account had to appear on the claim ( moneyclaim online) . So does this mean I have to withdraw and start over again or can I amend the claim at this stage to include the second name?

I thought that I only would have to include the schedule of charges in the court bundle as and when a hearing is scheduled and Im request to file the AQS form etc.Is this correct? as there was nothing on the moneyclaim site advsing preemptory sending of docs to anyone. Ive allready sent a copy of charges with RFP letter and LBA letter Ive told Clydesdale that my claim is against my local Yorks bank branch and if they are handling legal matters for my local branch then this is their internal procedure and its their responsabilty to ensure the local branch send the docs that Ive allready sent to them a long time ago. What do you reckon??

Request for repayment 960.50 sent 20/07/06 LBA sent 13/08/06 Offer of 494.25 recieved from Clydesdale Bank 25/08/06 Response to settlement offer REJECTED letter sent 11/09/06 Money claim online submitted 03/10/06 Letter recieved from Clydesdale Bank 09/10/06 stating I need to provide them with account number/sort code and charges details. Reply fax/letter sent 10/10/06 informing Clydesdale my claim was against Yorks bank Thornaby branch and they surely know their own bank sort code! Also account number WAS stated in claims particulars and previously sent two copies of bank charges details to local branch.

Hi Guys, Ive spent a week reading all the posts, advice etc and will now get into the fray with my joint account at Yorks first and then help my lad out who was badly mauled by HSBC when he was a student in UNI. One question I have that I cant seem to find posted anywhere is: as far as being overcharged, when calculating the amount, have all you guys deducted what the OFT deemed a fair charge which if I remember right is 12 quid a pop and then claimed the difference being 8 quid a time ( in the case of a 20 quid charge) or have you just totalled up all the charges for being over the limit etc etc and hit them with the total without deduction for the " reasonable charge". Hope Im making myself clear. cheers
