  1. HI Hoogie, keep at it. I too am claiming, though on behalf of my mum who lives in Scotland. She's no longer with the Clydesdale (thank god). I also received the same reply as you (21st Sept) to my 1st request, and in addition, that nice chap Neil McKirdy also added "Please note that should you proceed straight to court action against the Bank in respect of this matter, the Bank reserves the right to lodge a counterclaim against you for damages suffered as a result of the breach by you of your contract with the bank." I'm assuming this is also part of the standard reply & I now issue the LBA? PS Am I also able to claim for Service Charges?(this might be a daft question, but I've just joined this site, so please excuse my ignorance!) westyorksred
  2. Hi to all, just been reading some of the posts re: Clydesdale. I'm claiming 988.08 in total on behalf of my mum who lives in Scotland. sent the 1st letter & received a stroppy reply along the lines of "...not our fault...", " we reserve the right to counterclaim..." . they've also given us 8 weeks to reply. I've also read that you can only claim up to 5 years. is this true? as my mum's goes back 6 &, if it gets as far as the courts, do we go for the first 750? (including interest) & then the remainder. and as soon as I send the LBA off, do I then post the claim?
  3. HI to all on here. this is my 1st post & could do with a little advice. I'm acting on behalf of my mother trying to reclaim charges from the Clydesdale bank, total 988.08 (incl int) we sent the 1st letter on 31st Oct & received a reply a week later. In it, the bank basically say that it's her fault for not being able to manage her account properly & that they're not paying up. they also add, at the end, that the bank "reserves the right to lodge a counterclaim against you for damages suffered as a result of the breach by you of your contract with the bank" they also say if they hear no reply after 8 weeks they will "consider the complaint closed" I believe that about 50% of banks will do this so, will our next move be to issue the 2nd letter?
