  3. HELP!!! Received "Notice of Transfer of Proceedings" "A defence to this clime has been filed." It then goes on that it's been transferred to my local court and that I have to fill in an allocation questionnaire. However, yesterday I sent an acception of an ex gratia payment to DG Solicitors signed and dated 29/01/07, i thought that this would be ok, but then the above. Apparently I need to file the allocation questionnaire by the 14th Feb 07.
  4. I know, but there's always that little thought that something could still go wrong. If it gets to 31st just I just hit the "Judgement" button on the MCOL site?
  5. Well they've replied to my letter of 22nd November (!!!). Offered me £2581.00 in full and final settlement, which I have to admit is very tempting although their 28 day time period is up on 31st January. My full claim going through MCOL is £3454.33. What's everyone's advice?
  6. Ok, will get both done tonight. Will request receipt of the e-mail by return. Should I not receive one I will then give her a follow up call on Friday. "Following my receipt of your acknowledgement and intention to defend the above claim (will put claim number in subject), please find attached a full breakdown of my charges disputed since xxxxxx. The total claimed through Northhampton County Court Stands at xxxxx (charges + interest + court fee). I look forward to confirmation of receipt of this by return of e-mail. I trust this assists." How do you think that looks?

  8. Ok, so the acknowledgement of service arrived. It doesn't actually state that I need to do anything other than wait for a defence. Should I still send DG Solicitors my breakdown plus a covering letter with the total amount claimed, and if so, should I wait a while until we get closer to the 28 day period or send it ASAP?   9. Hi, Whilst i'm in the period of waiting for things to happen, i'd just like to take this opportunity to say thank you to everyone who has provided help and advice up to now. I think without the guidance i'd be sitting worried every day that something horrible will happen. As it is I feel suprisingly calm that things will go smoothly if I just follow your guidance (touch wood). So, thanks again. Matt
  10. Well the MCOL went today (had to wait to get paid to afford it first) Anyone got any advice about what to do from here other than keep my fingers crossed that they don't defend?
  11. Lateralus, I have calculated my 8% interest, was about £430ish, so in one way I wouldn't mind if it went all the way to final stages before they finally chicken out. But if they make me any sort of offer over £2,500 before xmas (yeah right) then i'd take it just to relieve all this stress. Honeygie, I think the amount I would be cliaming in interest would be about that too, but as I have sent two letters already i'm gonna stick with it. Thanks Both
  12. Ahhh, I understand now what you mean. Well my interest charges are fairly minimal they only amount to around £0.80 each month I had charges.

Thanks, I have noted earlier in my letter that if the claim went to the court stage I would claim the interest back but at this point I would be more than happy with the £3001.50 that I thought was gone forever. Not that I worded like that to them. Don't want to show signs of weakness, otherwise they will be picking the flesh from rotting carcass probably.
  14. I modified the ending slightly to try to get them to pay up minus interest which would be claimed at court stage. "I require repayment in full of the £3,001.50. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice."
  15. Well, no response from HSBC. No suprise. Have drafted a letter advising of my intention to pursue the matter through the courts. Maybe this will wake someone up and get them to at least responed to me. ----------------------------------------------------------------------- I will not lie down and take a shafting.

No, I don't think so. :o :o Reclaim bank charges: they're unlawful, so you can get six years money back | MoneySavingExpert.com The calculator on here worked it out and I included a print out in my letter from the template there. I used their template as it is the same ones a friend of mine recently used to get his charges refunded.
  19. Checked through 6 years of online statments and have sent a prelim today requesting £3001.50 plus interest of £452.83 (used moneysavingexpert.com form to calculate this - very handy). Lets see what happens now:!:

Just a quick note to say that when I took out my loan last summer to take my girlfriend away somewhere really nice for her birthday I had to literally battle with the guy on the phone for over half an hour to not take out any payment protection (insurance as you put it). My circumstances dictate that if anything really bad happened I would actually be ok with continuing to pay my loan but despite explaining this to him and going into further detail, which i cannot here, he was still extremely pressurising and forceful about taking out the insurance. I wonder how much they pay out in realtion to premiums paid? I am sure it will be an extremly tidy mark up for them given this pressure tactic that they are obviously forced to employ by their bosses.
