  1. Recieved a letter from Weightmans today informing me of an Interim Charging Order that they have had put on my property. Order was dated the 13th of this month and the court letter to Weightmans dated the 19th. This is the first I have heard of this action that they have taken. There is to be a hearing at the county court on the 20th July about the Charging Order. Now the ICO/CO is against our property which was returned to the mortgage company in January. Obviously Weightmans have checked with the Land Registory who show me and my wife as the owners. My question is what should I do now? Any help or advice is most welcome.
  2. Northampton is just a bulk centre, they do the initial work then it goes out to a court local to you if there is a dispute.

  4. Hi In 2008 I had a bit of (well quite big really) breakdown, my business went belly up and all my creditors came knocking. Via CAB all of the creditors were organised on minimum payments etc, we can now fast-forward to 2012. Weightmans acting on behalf of Arrow Global (Guernsey) [original debt was an MBNA credit card] took it to court via a bulk centre. I filled in the paperwork and returned it with an offer to continue the minimum payment. They rejected the offer so the Court looked at it and decided that it was a fair offer. Obviously Weightmans then contested the judgment and it was transferred to my local court. Last week I received a Judgment for Claimant (after redetermination) stating the full amount (just under £12000) be paid forthwith. My circumstances; I have not worked since my breakdown and have no income of any sort. My wife does work but gains little more than minimum wage plus some benefits. Our property has been repossesed and is on the market at an asking price of £30000 below what we owe (not taking into accout any other costs that they may add). We own nothing of value and have no savings. I have in total debts of about £60000 (not including the mortgage shortfall). My Question: What is the likely response of Weightmans for enforcing the Judgment and how should I react to them? Many thanks in advance ERM
