  1. I used my address. My son lives here most of the time. The policy was taken out at this address and the vehicle is registered her. I stupidly didn't send them recorded, I cant even remember if I sent them Recorded, signed for. Do I send them all again to be sure? Do I copy in the debt collection agency?
  2. Hi, all three SAR's were posted on the 5th December. Haven. Close Brothers. UDrive. Close brothers asked for ID to be sent which I did, but I stupidly did not log when sent. I have had nothing from Haven. Nothing from UDrive. My son is receiving emails and text messages asking for the cancellation fee now £262.02 from them. There is now also a DCA, CRS, which is asking for £379.54 on behalf of U Drive Cover. I cannot respond as I have no idea which is right until they respond to the SAR. They give a policy number on the email but no registration. They give the cars description but no cancellation date. Says the balance is due in accordance with the terms of business which were agreed on the inception of the policy. Do I SAR them? My son swears he has never set up a new policy with UDrive when the old one expired and would not have done for over £3k as he would not be able to afford it. Girlfriend has spoken to them several times about payments. But until I can get a copy of all calls I have no idea what is going on. I am doing all of this with my sons knowledge. He works all day long and would not know where to start. His car is registered at my address and I type the letters and he signs them (obviously not with his real signature). He does live here sometimes but also stays at his girlfriends house.
  3. Hi. Apologies for the delay in coming back to you all and thanks for the info you have given. I have had no response from the SAR's I sent out other than the one asking for ID, which I have supplied. U Drive Cover Limited are now sending letters as attachments in emails advising the cancellation fee is £262.02. They are sending text messages with the same information. Haven (which I was advised was the insurer) have not responded to the SAR and this was 1 month on the 5th January. U Drive have not responded to the SAR I sent and this was 1 month on the 5th January. Do I chase them again advising they are 'in breach' or resend them again? TIA.
  4. Hello. I have just set up insurance for my son as his policy has run out. I have requested the proof of no claims and been advised by U Drive Cover that the proof of no claims has already been issued to 'Haven' his new insurance company and they are unable to issue another one. This is not the company I have insured the car with and he certainly has not taken out any new policy. His girlfriend has spoken to his insurers and the finance company 'Close Brothers' and a company who she thinks is 'Haven'. From what she can gather a policy has been taken out in my sons name, said policy is now cancelled, proof of no claims will be issued when a cancellation fee of £1200.00 is paid. Close Brothers advise they are investigating U Drive Cover. They say they are investigating Close Brothers. Both are investigation Haven. Nobody will confirm who the 'new policy' is with until the cancellation fee is paid. I have sent an SAR to Close Brothers, U Drive Cover and Haven Insurance (in Jersey??). Sent 6th December. Nothing from Haven or U Drive. Close Brothers advise they can not process until I send photo ID and proof of address. Once they have it, they will process my request. As I am not sure which of these companies is possibly doing something wrong as they all seem to be investigating each other, I am reluctant to send anything off to them. Is it normally to request ID and a utility bill for an SAR?
  5. Thanks for your help people. They have come to an arrangement to clear the outstanding arrears without getting any further in a mess. Now I know, I will make sure that the payments are being made. Landlord only wishes to deal with me now and that's fine. It has opened up a can of worms, but fingers crossed were going to be fine from here. Wont be doing it again at all. EVER!
  6. Hi, looking for some information/advice/help. I stupidly signed as a guarantor for my son and his girlfriend in June for their house. One year contract. Review June 2023. When I signed the documents I told the landlord that I wanted to know the day after any due payment was late. This he agreed. I 'laughingly' told him I wasn't paying for any house I wasn't living in and not to leave it months before contacting me. Obviously was not listening to a word I said as he had just advised me today that there are £2600 rent arrears. August / September /October / November rent and it is due again in two weeks £695 pcm. I obviously don't have that money to lay out. Very unwilling to pop it on a credit card. I know I have been a stupid idiot for signing. Landlord wants to come to an arrangement and has reminded me that girlfriend has told lots of lies to him over the last four months and wants it paying ASAP and reminds me that this is my obligation to sort it. Son knew nothing of it before today and is as shocked as I am. Can anyone offer advice to the questions below. Can already feel the sleepless nights coming on................. Question one Do I offer him a weekly payment? I obviously have my own house to pay for. Don't think I can afford more than £100 per week. I am not defaulting on any of my bills to pay it. Question two Is it better to bang it on the credit card to stop any action? Question three How do I make sure that my name comes off it when it is renewed in June? Question four Do I need to see a solicitor to make him a formal offer of payment? Question five If he does go down the legal route, what would the process be? I know I have been so stupid but I though I had it covered when he agreed to let me know of any problems and to be fair, he has sent me screenshots of messages where the guy thought he was talking to me. I am gutted I have got myself in this situation and need to get myself out of it as soon as I can. Any help would be much appreciated.
  7. I am struggling with Studio in finding an address. They have an online form you can fill in but that's mobile number and email address. I have made up an email address for him to use for all this but not sure if I should fill it out and wait or keep looking for an address.
  8. SAR gone to Vanquis SAR gone to Capital One CCA request gone to Aqua Form printed of here and sent to solicitors acting for Aqua. What does he do about Studio and Sky? Thanks for all your help.
  9. Thanks - when I send off the SAR, what postal order do I enclose? SAR to Vanquish and Cap One? CCA request to Aqua #1 postal Order Reply form printed from here?
  10. Thank you. If Provident have gone, how can they claim it? I filled out a claim form a while back for compensation from them through a scheme. Obviously it got rejected on the first hurdle because I only ever had one loan and I never missed a payment and paid it off in full.
  11. Hi, quick update. We have found paperwork relating to Aqua. Looks like payments they were chasing default payments around June 2017. Balance on card then £2917. Balance now £3157. Just received a 'letter of claims details' from Mortimer Clarke Solicitors. It says fill in and return. Do I still send off the CCA Request? The card issued 04/2017 is still stuck to the letter so must have been in default then. Last recorded payment I can see from statements I have is March 2017. Vanquish 1. Letters from June 2017 show demands for payment but I cant find any statements. Vanquish 2. The £400 one is for two Provident Loans possibly prior to 2017 as the letter I have is chasing January 2017 and it is Fresh Start Vanquish Bank. It advises the debt was sold to them in December 2016. We have nothing at all for Capital One. How can I send to them when I have no account number? Thanks in advance.
  12. I am bailing him out because he is my son. If I find evidence of what you are saying, I wont be having any contract as it will the Police dealing with it, not me.
  13. Hi, sorry to be a pain but I have all the letters ready to send them off tomorrow but we don't have any reference numbers to put on them. I only have the Lowell References. Not having any paperwork for any of the debts means we cannot put any reference numbers on the letters. Son has searched but cannot find any paperwork either. Can I just send it off without any reference numbers on or do I just send it to Lowell? If I send to Lowell, do I include 5 x £1.00 postal order or just 1 x £1.00. TIA
  14. I will check with him when he last paid towards Aqua and possibly Vanquish. He doesn't remember having the Cap One. If he cant remember when he last paid, how does he find out? When does something become Statute barred? The CCA request goes to Aqua, Vanquish, Studio and Capital One and not Lowell and Cabot? Who are the main three agencies now? Thanks dx100uk
  15. Hi. I have just had to pay out £1300 for my son as he hasn’t paid his Council Tax and the Bailiffs were ready to lift his car. I have gone mad and made him tell me if there is anything else going on. He doesn’t have a lot to do with the bill paying and to be honest this is the second time I have had to do it in the last three years. He has given me three letters that have come recently but from the look of them I don’t think they are the first ones ever sent. Cabot is for Aqua Mastercard – Outstanding balance £3157.30 – statement of account Cabot is for the same thing but advises the account will be with their solicitor in seven days. He is aware of the card. Had it when he was about 18/19 (he is 27 now). Lowell has listed 5 different accounts. Studio £153.82 – this was from before Christmas he knows about it, but thought it was being paid. His girlfriend advises it is sorted but don’t Lowell buy the debts? Sky £364.39 – he has lived in the house 12 months and never had Sky. Not sure if he had it at the previous address. He thought it was Virgin. Vanquish £400.00 – he is not sure if he ever had a vanquish card, he thinks maybe he did, but it would be years ago. Capital One £417.94 – he is definite he has never had a capital one card. Vanquish £1271.04 – if he had one, then fine, but he surely wouldn’t have two?? I have said maybe they added on things he hasn’t had so he rings them, and they have got him then. He would agree to pay them whatever they asked for. He is gutted he seems to be in so much debt and this bailiff visit threatening to take his pride and joy car has shook him up. I am wondering which way does he go from here? Does he start with a CCA request to see what is right and what is not? He is obviously curious about what they say he has that he knows he hasn’t. Or is there another way – CAB? – National Debt Helpline? Also how do I get a copy of his credit file. I take it sending off the £2.00 postal order to the agencies isn’t still possible? Also, he has asked me to put his car into my name. It isn’t a problem and will happily do that, but would I have to tax it when I swapped it over? Sorry the question is so long and thanks in advance for any help.
  16. Thank you. It is not typed up (amended where needed) and will be in the post first thin tomorrow if the post office is open, if not them Wednesday. When I have the info I will come back.
  17. Thank you. As they have not taken my sons complaint seriously and advised him if he is willing to close the case they will credit his gas account and electric account with £40. They have left them (1 child of 5 and 1 child of two) for over 24 hours on three different occasions with no heating or hot water after removing his smart meter and fitting a normal one and then not sending him a top up card. I cannot tell you the amount of times we had to contact them over a 10-12 day period. Messages, broken promises and things not done. They only seem interested in him closing the case. I want to know the series of events / failings that left them with no heating or hot water. What exactly is it I am asking for? I am not interested in processing of data and how long they keep it for, I am interested in what was done from engineer visits, telephone calls, whatsapp messages and online chat. The process of taking the message or phone call and what failed and made him call again. Does that make sense?
  18. Hi. Quick Question. Since British Gas are incapable of answering my question, does anyone know if I have to pay to send an SAR to them. It used to be £10, but some don't charge. I have repeatedly asked them for their subject access request policy with no joy. I am beginning to think they have no idea what I am talking about.
  19. Apologies if I am in the wrong thread but I am unable to see one relating to my 'problem'. My husband has full cover with the AA with me as a named person. The cover is for us both in any car we drive and has 'home start' and 'relay'. On 25th September, while on holiday in Cornwall, we broke down around 3.30pm. We phoned the AA who sent out a diagnostic mechanic who advised us the turbo had gone on our car and we needed relay. He said he would sort it with the AA. The next gentleman that arrived (in a transit van) asked us to 'pop the bonnet so he could have a look'. We advised we had already been diagnosed and were waiting for a relay truck. He said he had been sent to diagnose it. We told him we had already told the control centre what was wrong, advised them we were in a layby in the middle of nowhere, had no heat, no clean water, no toilet facility, it was getting cold and the mist was dropping quickly. They advised a tow truck was on the way to take us to a place of safety. He got onto the office, apologised for the mix up and said he would tow us to a place of safety. Due to Covid he wasn't allowed to have us in the cab. Attached his towing pole to the vehicle and towed us 18 miles to Bude where he left us a Morrisons at about 8.50pm. We again rang the control centre as I didn't think Morrisons car park was a place of safety as they had no timescale for us being picked up and Morrisons closed at 10pm. They then said they could possibly move us to a service area, relay us home - then they couldn't locate a truck. said They would get us a hire car - they couldn't find one open at that time of night. said they would put us up in a hotel until morning and then hire us a car as long as we had a debit and credit card with us. We refused that one. At 10.15 they advised us our vehicle would go into storage. We would be sent home in a taxi (Bude to Manchester) and our vehicle would follow later. The taxi and the tow truck would be with us by 11.00pm so we could load the taxi and give the key for our vehicle to the recovery company. Our vehicle would follow usually within 48 hours but could take up to a week. Taxi arrived at 11pm - no sign of the tow truck. Phoned the control centre who advised there had been a delay in collection and could we leave the key near the vehicle for them to collect. Tired and fed up, we did, and headed home. I had already spoken to the manager of Morrisons and told him our car may still be there in the morning. Didn't want a fine for possibly parking overnight. We arrived home 13 hours after breaking down. We had a couple of phone calls to advise it had been picked up and was on the move. Last call was Monday 27th September. On the 1st October I rang and was told it was at Keele Services and was out for delivery that day and would be with me around 7pm. I said I was going out and to post the keys. This was agreed On the 2nd October I rang and was told they had no idea why it hadn't arrived and they would call me back. They did but still had no answers. On the 3rd October I was told it was at Sandbach Services and would arrive between twelve and one. I told them I would be going to the services it was parked up at and sit in it until they sent some one out. He said it was not good and took an 'official complaint' from me. They would look into it thoroughly and come back to me in a couple of days. Even if nothing come of it, they could see where the communication fell down and ensure it didn't happen again to anyone else. The car arrived back on the 3rd October - a full NINE days after we broke down. The driver rang just after 12.30 to say it was on the drive and he had posted the keys through the letter box. I could of pushed it home quicker. Sorry for the essay but I need to know if the AA would be subject to a S A R? Would that give me any information as to what happened? Or why it took so long? Is nine days acceptable when relay is supposed to get us and the vehicle home? Is one week acceptable to wait for somebody to come back to me with their findings on my 'official complaint'. Am I the only one who finds this mess unacceptable? If they have to abide by an SAR, is it just a normal one I send off? I just want some simple answers from them but I don't think its going to happen. Thank you for reading my story and thank you in advance for any help you can give.
  20. I am just going to go with the cashing in of the policy as it is. nobody can seem to answer my question. Most advise it is down to the company it is going to. Dont really want to tie the money up any longer. Did you ask a site team colleague regarding the HMRC overpayment?
  21. I have googled it thank you. I realize I am taxed on it. I am currently in dispute with HMRC regarding an overpayment of tax credits going back to 2004/2005 and 2008/2009/2010. Will they have any rights on this money at tax point? Can they take all the payment to offset the claimed amount?
  22. I am about to turn 55 and have been giving some thought to my pensions. I have three that are under £1000 and give practically no return as a pension so going to cash them in. I have one that has a cash value of £11,000 and a transfer value of £16,000. Just spoke to an advisor and I am a little confused now. I understand the tax free amounts and the taxable amounts. Would I be able to do a pension transfer for the £16,000 into another pension pot with another provider (getting the extra £4,000 bonus) and then cash in the value with the second provider? Is there a time limit on how long it has to sit in a pension fund before being taken out? Example - I have one for £800. Could I transfer the £16,000 into that one. Then cash in for £16,800? As opposed to cashing one in for £800 and one in for £11,000? Thanks in advance.
  23. We are back on with this again. Received a notification that the deduction from my wages has to commence immediately. Pity they obviously haven't read my previous letter to advise I was made redundant at the end of July. Curt reply to my previous request for the breakdown of the calculation for the over payment. Crested the Government Gateway ID ready to make the complaint if I don't get the info I have requested. Not exactly sure who I am dealing with now. I have been requesting information from Preston but the latest reply has come from BX9 1ER so I have sent a copy to everyone. This just says they have sent a final decision notice during the relevant tax years with the details of the over payment and they consider 3 months to be a reasonable time to contest it. I had 3 month to dispute it. As the date has now past, they will not consider my dispute and will ask for the money back. That's not me being brief with details, it is more or less word for word what it says. I cannot believe how unhelpful these people are.
