Hi Gez There was no agreement, just statements with a covering letter. im pretty sure that doesn't prove i owe them, i just wanted to be sure. I believe i understand the case against me but im maybe being over cautious. Kasier

Just a quick update and some advice, I got my defence in and it was acknowledged, the deadline for that was Monday 12th March, i received a letter saying that IND/Robinsway have 28 days to respond, but today i received some of the info i requested for the cpr 31.14 but it was only 3 months of credit card statement dated April, May and June 2006 does that prove i owe them?

Yeh i guess it would be too good to be true :S yeh i'll check if i can still file a defence

Ok so i've had nothing through from them which is a little concerning, also they never responded to the 31.14, assuming the extension is true what can i do next. i'll ring the court and see if they either received the extended or apply for judgement.

no i didn't file the defence, IND agreed to a 14day extension, they said they would contact the court and send me written confirmation of this.

Ok here is the update, first i tried calling Robinson Way, they gave me this number 0161 839 7376 which doesn't exist any more, so i called them back and they gave me 0845 670 4455 to ring which happens to be IND?? so now i explain to them that i wanted to get an extension to submit my defence, they told me to ring the court to ask for an extension, so i rang the court and explained to them the what i've been told from IND, and they said i need to arrange an agreement with the claimant for an extension. So i rang IND back telling them what the court told me, so now they had to speak to their supervisor about it, after a lot of waiting and worrying as the deadline was creeping up they finally they called me back after the cut-off for submitting my defence saying they will only extend it another 14days, so accepted and asked for them to send my confirmation in writing. What a day, now that i have another 14days i want to get my ducks in a row asap this time, there was still no response to the 31.14, what would be my next course of action? Thanks

If they don't agree and I file the defence which I don't have any documents from Robinson way as they failed to respond to the 31.14 what happens next?

The 7 days is up tomorrow, so will give them a call, to either find out their response to the 31.14 and see if I can get an extension, if not then I'll submit my defence

Yeh I have a basic defence for an embarrassed defence saying they failed to respond to my CPR 31.14, but I'll give Robinson way s call to see if I van get an extension.

Ah it was on the 31.14 letter, so they failed to respond at all.

So i need to contact the claimant for an extension then contact the court saying that the claimant has extended? if extended will that be 28 days from tomorrow? Thanks

So, Monday is the last day to submit a defence, i have received nothing from the CPR 31.14 i sent Monday last week, who do i contact to get an extension for my defence, and what do next now that noone replied to my CPR 31.14? Thanks

I did the acknowledged service on the 13 feb, i have read the links you posted i think i understand them, i think i should send them a CPR 31.14?

I've now let them know i want to defend, what do i need to do now?

Yeh IND aren't named, Robinson way are. address for sending documents etc is for HEGARTY LLP?

Hi. I’ve just received court claim from Robinson Way Ltd / IND. I used to have a bank account and credit card with HSBC but stopped using it since beginning of September 2006. A few weeks back I received a letter from IND saying I owed over £6 for a HSBC Credit Card, then saying if I didn’t pay it would go to court which now I have a letter for that. Please can someone help I have no idea what I need to do or what needs to be done. Here is what the Court letter Says: (Date issue was 25th Jan 2012) 'The claimant is the assignee of a debt(s) from HSBC plc. Notice of assignment was provided to the defendant by the claimant in writing. Despite demand for payment the assigned debt(s) remains due. The claimant complied with section III and IV and annex B of the PD Pre-action conduct. and the claimant claims: credit card account number xxxxxxxxxxxx balance of 6,xxx as of x/x/07 interest under s69 of the county court act 1984 at the rate of 8% a year from x/x/07to x/x/12 of 2,xxx and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of 1.44 and cost.
