  1. I just think that there are plenty of people out there that would go through with a claim against Egg if they had a Solicitor on their side doing the work for them. This would mean a lot more cases against them. People are afraid of going to court. period. and Egg are obviously playing on this. I know it needs you guys to ALSO fight them, for which you deserve great praise, but Im thinking of those people that dont have that much passion, time, or balls....yet still want to claim their money back. I have no problem in going to court, but wish Id started using this online Solicitor for the process for my £120 as I could have sit back and waited for the date without the effort. (time is precious to me. work long hours etc.) I understand you guys are enjoying the battle and again, im speaking about other people and the fact more people may come on board. More cases, more workload for Egg.
  2. Hi all. good points. But i was thinking of using them for EGG ONLY. As i am only claiming £120 What is the point of having such a fight for this amount. They are fighting back and no-one has beat them yet. I emphasis the word YET. I know you guys are doing a good job trying to break them, and I would too if it was for a larger amount. I have a far bigger claim to make from ABBEY and will NOT use anyone else for this. Mainly because I dont expect to go to court and have to put up with dates changing and typical Egg dirty tactics. good luck.

  4. Hi all. good luck with your claims. here is the letter and response that I sent/received from OFT regarding EGGs claim that the OFT are their best friend.(in their words). dear sir. I wish to make a formal complaint in respect of EGG plc. who have sent me a letter in response to my claim in which i state that they have been unfair in their charges to missed payments and fines. Egg claim to have negotiated special terms with the OFT, which suggests they have your approval to charge £16.00 to each and every customer for each and every missed payment and that because they have reduced their charge from £20.00 to £16.00 the OFT have agreed not to take any action against them. Is this true? that the OFT and EGG have an arrangement? I am shocked that EGG have taken this stance and feel they are abusing their position and attempting to frighten me into dropping my claim. I am sure that you are aware of this matter and would be grateful for a response. I am aware of the statement that the OFT have recently made via a press release and see no such arrangement. I would therefore, be grateful for a response to my complaint. (signed and addressed) RESPONSE Thank you for your e-mail about the charges imposed by Egg for missed payment. You ask whether Egg has an arrangement with this Office that we will not take action against them as they have reduced their charges from £20 to £16. I should explain that the £12 threshold for intervention is not a price cap. We are not saying that default fees should be set at £12 or that a court will consider a default fee to be fair just because it is at or below £12. We expect and are calling on the market to apply the principles of fairness set out in our statement, which leave room for different levels and models of charging provided they are based on limited administrative costs, and to recalculate their own fees In line with its current enforcement policy, the OFT will investigate the fairness of any fee set above the threshold. In limited exceptional cases, a card issuer may be able to show that it is fair and consistent with the principles set out in our statement to charge higher default fees. In relation to Egg's claim that we have approved a charge of £16, that is not exactly the case. What we have said in our statement of principles at para 1.6 is: On the analysis we have undertaken we have concluded that generally credit card default fees have been set at a significantly higher level than is fair for the purposes of the UTCCRs. The level of a fair fee will, however, be dependant on the precise business circumstances. Some exceptional factors, for example whether a card issuer requires (not merely allows) customers to give it direct debit authority to ensure a minimum payment is made, may lead to a lower level of instances of default. A card issuer operating a policy of this kind may be able to justify a higher level of default fee than one that does not because its relevant business costs are being recovered from a proportionately smaller number of defaults. However, even in the circumstances of this kind the card issuer may only recover the relevant limited administrative costs arising out of those defaults. In other words there may be circumstances in which a charge in excess of £12 will be considered fair by a court if it can be shown to have been calculated in line with our principles and a true pre-estimate of the costs they have entailed in recovering losses.     ok about to start the court process....and i will turn up. first i must accept their offer of £24 in view to them sending me the rest i am claiming and also to point out a few things. interestingly, if EGG have offered me £24 to reduce the fines i paid from £20 to £16 (6 defaults) then i will ask for them to prove the costs when it was £20 and ask the question ....were you over charging me before? how do i know you are not overcharging me NOW!!.....they really must prove their costs NOW as UNDERSTANDABLY I am suspicious. plus (more importantly) surely if their costs were a true reflection and they have now reduced them from £20 to £16 .... then they would be making a loss!!!! i will ask them to show what they have done to save money to pay for this reduction. to prove the £20 was a fair charge in the first place. which we all know is not true. interestingly also...... if EGG are only charging TRUE COSTS then why are they listening to the OFT at all. IF it costs £20 to them per default, then thats what you are gonna charge...because thats what it really costs. It would be FAIR to charge actual cost regardless of what it was. ....you would just need to prove it if questioned. anyway....onwards and upwards!!!

    Firstly. "Hello EGG. Hope you do look at these posts. I'll be seeing you in court some time...called thread hughes v egg so you could find it quicker." Hello all fellow EGG CRACKERS. Thought id start with the LOWEST and EASIEST one first, but appears this may be the Hardest. Not to worry...... My unfair charges were for £120. plus interest of a few quid. Sent 1st letter - response was "actually our charges are fair"...we'll close your account..policy stuff ...blah blah. Sent 2nd letter - response was same as above but also "OFT agreed not to touch us"...blah blah..."we'll refund £4.00 per charge to reduce amount you paid in fines from £20 to £16"....thats a refund of £24.....shall i?...shall i?...nah! my balance is at zero...so i think i'll put in a line about how i have lost faith with them so would be happy if the account was closed...and charges returned of course. gotta say...EGG send their letters out quick. just 2 days response time...this is the only thing Ill thank them for. Ill always remember the conversation I had with a member of the EGG team when I asked her not to charge me a fine that would be incurred in the future when I was clearing my balance today!!!.........she said "erm....bare with me a second"...and clearly went to ask someone if they were willing to...."im afraid we cant" was the reply.....(so they could have then..... I thought to myself).."ok" i said....."i'll log on to the CAG then...." put phone down. SO, ANYWAY. last letter dated 16th OCTOBER so they have clearly given me just enough time for 14 days to be up and get a response in. .........interesting to see over the next week how others will get on..good luck all. I will go to the next stage in just over a week. definitley going to court if it goes that far. how great would it be to set the precident for everyone else!!!
  8. 12/10/06 standard letter from EGG stating why they impose charges (to pay for their computers and staff apparantly) said they could close account. balance at zero so ........please do!.... onto the next stage....posting letter today. nice tohave had a quick response.

  10. thank you for your kind words. help is something we all need to get through. found it hard to calculate how much interest I have been charged by EGG from their illegal fines. worked this much out...... this claim is for £120. (past 7 months) A seemingly simple one compared to whats coming from ABBEY. ( past 6 years with lots more charges) As it is all online...I have phoned them up to check that i have no outstanding charges. I have just cleared my balance. they also gave me a phone number to make a complaint.0800 753 4393. and said I can send an email which will be replied to within 24 hours. link on web GILL- 17:17p.m. (phone contact)..nice chap...strange name!!..for a bloke! Customer Relations Office Egg plc Riverside Road Pride Park Derby DE99 3GG sending letter tomorrow. email tonight. phoning number tomorrow. OH NO....The maths!! interest on bill states cash interest 1.597 per month. i X'ed this by 12 and divided by 364 to get daily rate. i was always overdrawn from march till july when charged these fines. until i paid whole balance off JULY 25th. I worked out how much each fine had accumulated interest......wow...hope that makes sense....would be easier to not mention it on such a small claim....OH YOU CAN KEEP THE FEW POUND!JUST GIVE ME 120!! Preview 9th october-EGG-sent 1st letter and email requesting return of fines and interest £120 plus £2.86=£122.86 12th October. received letter from egg stating why they impose charges(computers and staff!)sent 2nd stage letter today recorded. hi.........erm....here goes.... my situation is that i have banked with abbey all my life (well at least 15 years). for the past 6 years i have paid charge upon charge upon charge. i hate banks!!!! they have done NOTHING to help me. Once abbey reduced my overdraft by £500 and still charged me fees on top of this from the previous month. half my wage gone just like that. ...of course this caused me to incur more charges the following month... ....they have screwed me for 6 years!!! The fact that they show no leaniency, fairness or understanding makes EVERYONE hate banks. and foreign call centres....but thats another story!! I was passed the info about this site a few months ago by a freind who knew of my money problems. he found out about it from This Morning.ITV. Not sure why he was watching This Morning...but i quickly forgave him when he told me about this sight. I have held back my claims until i got on my feet again.........and now......I AM READY! So, i think I'll start with EGG. They owe me just 200 or so pound. I have got my statements online, so can get straight on to this one without having to wait. Mint probably owe me the same but cant start that for a couple of weeks. ..but then....when I have fought and won a couple of battles......comes ABBEY. This is my WAR!!! they owe me a fair few Thousand as I have paid fines every month for the past 6 years. give or take a few months. I have already recieved 2 years of statements and will request 6 years worth soon. ........and so........its late so I will sign off tonight and let you know how my first battle goes....... thanks for reading this far....good luck to you also!!!!
