  1. Oh my goodness recieved a letter from the respondents solicitor without preduice asking me to withdraw as they feel my case is weak and I could incur costs etc is this scare tactics and normal or am I really flogging a dead horse here!

Finally recieved the list of evidence from the respondent today most of which I expected I have asked for a full copy of everything I notice however a couple of investigation meeting minutes with people I've never heard off and which have never formed part of or been spoken about in any meetings I've had which I'm finding really odd anyone heard off this? I guess I'll have to wait until the pack arrives but still odd
  3. All they said was because the internal appeal process hadn't been completed and Easter. Funny enough I went back and didn't agree to the extension and 3 hours later I get my appeal response which is full of utter madness and non truth I don't think I will win my case altough I should I should have never been sacked anyway that's how things are.
  4. Yes I said no , altough I have Lresdy been given a date for the hearing and dates to submit all paperwork before they have seen the ET3 they set all this on response to my ET1

  6. Hello Sorry to confirm the tribunal have recieved the ET3 form from the respondent so waiting for that to be sent onto me. In my origanial letter from the tribunal they have given me set dates to when I need too have sent to the respondent and vice versa things like statement of loss, statement, list of evidence to use etc this has all been set down until the date of the hearing. I recieved from the respondent solicitor asking me to agree to moving the dates back to give them more time, I have been waiting for a response to my appeal which still is yet to arrive. This is why I don't feel I should agree to this change. I have met all timescales.
  7. Hi All they have received the et3 form, but had an email today directly from the respondant solitor asking me if i would agree to move all other dates and push back by 1 month, i havent agreed to this due to the ongoing situation. what does this mean? sorry for spellings on my phone!
  8. hi all, my employment tribunal claim has been accepted, the response from the business was due a few days ago, I have yet to see/hear anything what are the normal timescales for this? I assume the tribunal sends this onto me but how do i know if it was sent in before the due date etc?

  11. Hi all, I'm getting myself confused to next steps so hopefully you will be able to offer me some advice. The ET have accepted my unfair dismissal claim and have sent me in writing next steps, the first one being me sending to my ex employer what I am looking for in resolution to the case. I did complete this section on the ET1 form itself which they will now have a copy. So I assume I've got to put in writing a letter confirming what sum of money I want and why/how I've made that decision? Is that right? Also I'm not sure to to send this too yet I've no correspondence person assigned. This has to done fairly urgently any advice would be appricated.
  12. Hi all I'm struggling to come to terms with my recent dismissal a decision which was too harsh, currently in the process of appeal and seeking legal advice for ET. Today I've had yet another job offer withdrawn due to reference I was honest and advised them of situation once I recieved the offer but still no luck! What should I do now? Doesn't everyone deserve a 2nd chance I'm finding life hard, I just want to move on it seems not only have I been dismissed from a job I loved and was good at but also it's damaged my future career it's not fair.

Hello all, just to add yet another twist, the new employer wants to see all my paperwork regarding the situation and dismissal etc from my ex employer, I have given them a higlevel summary of accounts but I do not want to go into full on detail it would take a long time! and plus I am of course defending myself against the evidence etc I dont think this is a good idea, I am going to ET and I think it could be used agaisnt me! I appriciate they want to make a judgement and see if they can continue but what is the point? I mean if they accept my version of events, and accept I am taking them (ex employer) to an ET for unfair dismissal, why can they not base thier decision to continue with employment on that, does that make sense/?
  15. I have rang ACAS again and spoke with them about this, their advice was to wait to hear back regarding the appeal before they get involved, so far enough thats what I shall do, this I guess will be after the holidays - but again to little to late for the new role!
  16. Hello The employer gave a factual reference, dates to and from, job title, and reason for leaving: I.e. Dismissal gross misconduct (I am mad at this as I’ve not yet had my appeal, and also I have in writing they have said they don’t have proof either way, so they have based their decision on assumptions and hearsay, not the facts in black and white) although the case is much more in depth then just that! So my new employer who I got the job with before I was dismissed have now withdrawn due to the above. I have called ACAS, and to be honest they were not that helpful, they said I could ask for an off record conversation to determine if I was able to organise a compromise agreement, which I did, however my ex employer did not respond, not even to say no, the next day I was dismissed. So I don’t know if to ask for a compromise agreement again now before the appeal or wait now until the appeal, and see what happens it’s too late in any case for my new job. I am seeing my solicitor on Wednesday about organising a employment tribunal case and he may send a letter to my ex employer regarding the reference. I am cross I had found a new job, ready to start in the new year, new start, etc etc but not only has my ex employer sanctioned me way too harshly they have also stopped future employment, I just don’t think this is fair based on the fact they were unable to prove any wrong doing!
  17. Hi All, it looks like the new jon I found will be withdrawn due to the reference in which was supplied. Can I ask my ex-employer exactly what information they would put on a reference I guess it changes depending on the questions asked? They are not wanting to enter into a compromise agreement at this stage so I wont be able to go down that road. Its not fair, they sack me but also stop me from getting a new role!
  18. many thanks, I think ill give them a call to find out, perhaps need to find out what kind of pension etc I have....it's not fair I get unfairly dismissed, the reference they send out means the new employer then withdraws the offer then i find out i loss all other benefits!

  21. What happens to your pension when you are dismissed? I paid in a % of salary for about 5 years and they matched this, do I lose all of this now?

Also the question about if i am looking for compensation only, job back, or job back with employer only lets you click on one option? i am keen to click on all 3?!

Morning All, I have been thinking about my current situation, Yesterday I was dismissed which I am trying to deal with and will continue to work through as best I can But moving forward I was offered a new job at the beginning of the week (Before I was dismissed) and I dont know what to do for the best, I got the job via a recruitment agency so havent apart from the interviews had any direct dealings with the new employer - Do I go to them, best honest, explain the situation in the hope they accept this and continue to take me on? Or do I continue with the process and cross the bridge of references once they get them back. I.E dismissal gross miscounduct which I do beleive my ex employer will make a point of stating this they have made a point of saying they will do on my dissmissal letter! So I am not sure what to do for the best, of course I dont want to start of with a new employer and then get sacked from them due to bad references etc but at the same time I dont want to have that conversation before hand either! Sorry for going on....
  24. i know! in my letter they have made a point on what they are putting or will put on any future references which i thought was odd where do i stand with references does it depend on what the new employer asks or what have you? i just was so happy yesterday getting a new job and now that wont happen either, but that aside i need to fight this i did not do any wrong doing
