  1. Ok thanks - I'll try to get that done asap. Just out of curiosity .... If I missed a payment etc & the bailiffs came knocking again, 1) can they take anything in the house or just what is listed (above) on their paperwork? 2) they've listed 2 sofas - they're quite big, so the only way to get them out of the house in 1 piece would be to remove the front window - can they do that ? or can I have them for criminal damage if they attempt it ? or would they employ a window fitter at my expense to remove/replace the window ? (these bugggers really get your mind working don't they)

Hi PT, - thanks for your response. list as follows "1 x sanyo tv silver 1 x darkwood coffee table 2 x brown leather sofas 1 x darkwood tv cabinet 1 x darkwood book shelf " For some reason he's drawn a box around the last 4 items. I did tell the guy at the time that none of the things on his list were mine - he said it didn't matter. Can I argue that as the house is rented part furnished these items belong to the landlord ( I don't have anything in writing to back this up - I rent from a family member ) I haven't double checked with the council & can't put my hands on the last correspondance right now but £992 sounds right ( total bill was under £1100 & I know I paid them either 150 or 200 direct). So if they've misquoted the outstanding amount to the council would it make their action null & void? G

  4. Hi all, more of my woes I'm afraid. Just as a bit of background: My business started going belly up early 2011. In March I had to cancel all d/d's & s/o's cos I had nothing to pay any anyone with. Ashford Borough Council was one of them. In April i got a regular job & made a one-off payment £150 (i think) against my council tax. I had planned to keep paying them but just couldn't afford it with all the other bills & business costs. In May ABC sent a letter to the effect that they were going to court for my arrears. I phoned them & was told to do nothing as the court would contact me regarding a payment plan. I heard nothing until a Bailiff from Chandlers turned up at my house one evening just as I was returning from a week working away. He presented me with his Bailiff Notice - A Liability Order from the Mag court for Coucil Tax - £992, Stautory Fee - £24.50. Total - £1016.50. He told me that I MUST agree to a payment plan THAT DAY, & I MUST pay a £25 deposit by debit/credit card or cash. I told him I didn't have £25, or any working cards, or anyway to get any cash outside banking hours. He refused a cheque and asked if I could borrow the money. I sent him away for a couple of hours and managed to borrow some money from my lodger (who took it from her float from work) Now, I know it was stupid, but I was dead on my feet, hungry, needed a bath & dinner & to get some sleep before going away agin at 5am next day ...... So when the guy came back around 8.30pm and said he needed to come in to fill in the payment plan, I let him in (like i said - stupid). So he filled in his form - which turned out to be a Notice of Distress & Inventory & Walking Possession Agreement - listing every bit of furniture in my living room (the house is rented- part furnished). Now with additional fees - Levy £54.00, Walking Possession Fee £12.00 - new Total £1082.50. The payment plan is set at £178 pcm on the 1st of each, for next 6 months because "that's the maximum term the council will accept". I told him I didn't understand most of the terminology & didn't agree with the bits I did understand, but he said it didn't matter, it's the standar form & I should just sign it. Having been here a few days now I realise that a lot of the above is wrong but is it illegal/unlawful ? My lodger was present for some of the time & will witness if required. The main problem is that I can't afford £178 pcm - if I could I would have paid the council direct - at the moment £40 pcm would be pushing it. Do I have any grounds to get the payment reduced, based on the lies & deceipt & general bullcrap I was fed ( & the fact that I was barely conscious at the time) ???? Please advise (oh, and sorry this is so long-winded) TIA G
  5. Thanks for the advice. "Prove it" letter posted. Update: Today received a letter from Bryan Carter Solicitors o/b/o/ Freds, threatening legel action & quoting the fees mentioned above if payment not made in full within 14 days. I assume I just sit & wait for the "prove it " to kick in ? In the meantime what, if anything, can I do about this: (quote).........So since then I've been paying it off bit by bit online. In October when I only had about £27 arrears left I got a letter telling me that they had waived the £27 & cancelled my contract, & that I now owed them £158 for early cancellation of the contract.   6. Hi all, newb here, I have alot of probs with NWB ..... where to start. Ok been with them for about 13 years (& every year they increased my o/d facility without asking). About 5 years ago I wanted a small personal loan for house improvements etc. They were eager to help & managed to talk me up from £3000 to £5000 (better interest rate & longer term) and suggested that I should have ppi. 2008 I went self employed at work - Nightfreight multidrop parcel delivery. So I approached the bank who were again eager to help & set up a soletrader business account with an overdraft facility etc. Long story short, the nightfreight work evaporated mid 2009 & I really struggled from then. By Jan / Feb 2011 after a catalogue of disasters I decided to cease trading, get a job, sell the van, cut my losses etc etc. By then my income was nil, personal a/c was at o/d limit £2500, business a/c was at o/d limit £8000 & there was nothing left to pay any bills or buy food etc. I had to borrow off my parents (from their pension fund). NWB business advisor was never available & wouldn't return calls. Meanwhile, the charges, fees & interest just kept adding up. In April I got a job (paying £6000 less thatn I earned 10 years ago!) & went about shutting the business down. Officially ceased from 30 Sept 2011, with only the last VAT return & income tax to sort - which won't be much. Meantime, personal loan hasn't been paid & has £1500 outstanding cos nothing in personal a/c - but charges fees & interest mean th o/d has gone to over £4000. Business a/c is at £6000o/d (within the o/d limit) but the a/c is frozen. (the personal a/c has now disappeared from my online banking page) October I spoke with NWB business collections & fully explained my situation to them & asked for their help in moving forward. They went through my income expenditure & then told me that I didn't have enough to pay anything against my debt & gave my a month to "come up with an alternative" otherwise they would "take action". I've just received several letters "Formal notice of intention to file a default and to take action to recover the debt" from NWB telling me that they are freezing & closing all my accounts (10 days after they actually stopped my debit card) and giving 28 days to pay up just under £12000. I have sent a data request for the last 6 years on my personal a/c, as I intend to claim back charges/fees/interest etc. As a sole trader can I also do this on the business a/c ? As regards their demands for debt repayment, what's my next move ??? - IVA ? Bankruptcy ? Please advise. TIA G
  7. Hi, a newbie here, I had Tmob (private) phone contract for about 5 or 6 years for me, then my other half, & then for a dongle thing. February / March this year my business went belly up & I got behind with all my payments. April I started a regular job & contacted everyone to explain my situation - most were understanding. Tmob told me I was a "good, loyal customer" & that it wouldn't be a problem. 2 weeks later they cut off my services. Some snotty call centre operator told me I had to pay up in full to get reconnected or pay in full to the end of the contract to cancel it- I politely told him what I thought of Tmobs customer service & attitude & told him I would pay everything I owed as and when I had it. So since then I've been paying it off bit by bit online. I wrote to Tmob to explain that I did not choose to cancel, so I am not liable for early canx fees, & that I had not been made aware of any early canx fees & that I hadn't signed anything to say that I agreed to this. (I'm a bit of a horder so I went through old Tmob correspondence & cannot find anything aboutearly canx fees). November I got a letter from Fredricksons demanding £158. having not received any response from Tmob I sent them a duplicate letter (still awaiting response) Today I have another Fred letter demanding £235 (inc courts, solicitors & interest) to be paid within 7 days or action will be taken blah blah bailiffs blah blah - you get the picture. Can they turn up & help themselves if I'm not at home ? Whats my next move - contact Freds 7 tell them the situation ?? Tell them to poke it as I don't owe that amount ?? I can't pay it all - should I enter into an agreement with them ? Or something else ? BTW I work away mostly mon-fri so any usually correspondence is delayed until weekends. TIA G
