  1. Yes I submitted a defence I thought that was the right thing to do, but like I said I have no idea what I'm doing and it's really stressing me out now.

  4. I made the first request over the phone when they called me, they haven't called back since and I made another request by email yesterday, when I received the letter saying they intend to pursue! If they are pursuing the claim does it mean it will go to court now?
  5. Hi all, I took out a loan back in April 2008 with welcome finance. Just after I took out the loan I fell ill and spent some time in a mental health unit. I only made 2 repayments on this loan, therefore I beleive this debt to be statute barred. BW legal are trying for a CCJ, I have absolutely no idea what I am doing! I spoke to BW when one of their reps called me, I advided them I beleive its statute barred but he was adamant it is not, I requested proof and a copy of the credit agreement signed by myself. He said he would get this sent out but I have not received it, this was a month ago. I went online with the claim pack to file my defence, stating I believe the debt is statute barred. I have since received a letter from the courts stating they intent to pursue the claim. I emailed bw legal yesterday and again requested proof of any payments made and a credit agreement, I also cc to the courts. Just after some advice on wether I am doing the right things on defending this claim?
  6. I had a suspended possession order granted to the council back in 2010 for non payment of arrears, since then I have paid my arrears religiously at the amount set by the court. I had another baby last year and we currently have 5 people living in our 2 bedrooms home! I have 2 boys in 1 bedroom aged 11 and 7 and me and my partner share a bedroom with our 10 month old daughter. I requested a move from the council but I was told I cannot move due to the suspended possession order. My housing officer stated though if I had spare bedrooms this would be a different story! They have recently closed down our local community legal advice centre so I am really at a brick wall with getting some advice on this. I have trawled online looking for something but I can't find a thing. What I really don't understand is they are moving people that are being hit with the bedroom tax wether or not they have arrears or a suspended possession order yet because I have no spare bedrooms I cannot move! Surely it would be just the same paperwork if I were to move? Is there anyone out there that knows anything about this sort of thing?

  8. I have 2 items with perfect homes and have always kept up with my payments. Since friday my partner moved in and this change of circumstances has put all my finances up in the air, meaning i will be living on next to nothing until we are asessed as a couple. I went into my store today to make my payment and advise that i will be unable to make any further payment until my partner gets paid on the 26th, i told him that i would make £100 and would not be able to make any further payment for at least a further 3 weeks when hopefully my finances will again be in order, but i would bring the account up to date in full when they are. He did a bit of working out and said there would be nothing he could do about the late payment fees of £3 per item, totalling £6 per week. I argued that is not fair as there was nothing i could do to prevent this, and there should be some leniance on their part when this sort of thing happens, only to be told they are a weekly payment store and as an employee he had to reinforce this although he could see it from my point of view. Anyways he said he would have a word with the relationship manager to see what they could and call me tomorrow , but to be honest he didnt sound too promising. I have a feeling they are gonna call tomorrow to say therees nothing they can do and i will be charged this extra £6 per week, is there any legislation on this sort of thing that i can throw at them when they call tomorrow, should they say they cannot help me. I mean i am not trying to evade payment they are fully aware of my current situation and i have proposed to them how i will repay the arrears. I am also worried if they threaten to remove the goods until i can start repaying again.
