  1. Hi Andy, Send the LBA letter keeping to the original timetable. If the interest you are referring to is the 8% court interest then it is important you don't add that until you file the claim with the court. If you are thinking of adding Contractual interest then my understanding is that are better starting again with a new prelim letter stating that are also claiming constractual interest, I am using 15.9% for mine, There is a spreadsheet for working it out in the library.   4. I am in the process of making a second claim against HSBC this time for my partners account. I have sent the LBA off and got an offer back, only took 30 days, not bad considering I gave them 28. Question is we are chasing £1965.50 plus Contractual Interest. They have offered £1760 and completely ignored the interest, I am not going to accept the offer, can any advice on best course of action to get the contractual interest out of them. Whiz_bit

I found in the past that HSBC tend to ignore the deadline you give them and respond in there own time, I have also sent an LBA letter to them and increased the deadline to 28 days as it took them 21 days to respond on my previous claim, this time they still missed my deadline taking 30 days to respond.   7. I am jut about to start a claim for my other halfs account, I have got all the charges worked out £1965.50. Do you know if anyone has tried claiming contractual rate of interest on there HSBC claim as I am thinking of trying it, will add £571 to the claim at 16% though I guess I need to work out exactly what HSBC are charging me?   8. After my success with HSBC I am helping someone on the road to claiming her bank charges back from Lloyds. She is presently paying off her debts through an IVA, including a loan from Lloyds and a credit card I think, I do not really know the details. She is about one year into the IVA. Does anyone know if this will have any affect on her claiming her charges back and if that will affect the IVA? Whiz_bit

  10. I got a letter from the bank today.... Thank you for your letter dated 21 August 2006 (my get stuffed I do not accept your offer letter) requesting a refund of your bank charges. Blah blah about T&C's of account and they would be able to resist any legal challenge. We are going to offer you £3295. Which isn't bad since I was asking for £3295 plus £124.99 in interest, so I think I will let them off the interest, I didn't even file my MCOL I was going to do that tomorrow. Whiz_bit

  12. I am trying to fill out the particulars of claim on the money claim website and I am getting stuck, I just can't quite get it to fit. I have : The Claimant has 2 accounts XXXXXXXX / XXXXXXXX with the Defendant,which was opened in 1994 and 2000.During the period in which the Account has been operating the Defendant debited numerous charges to the Account in respect of purported breaches of contract on the part of the Claimant and also charged interest on the charges once applied.Claimant contends that:a)The charges debited to the Account are punitive in nature;are not a genuine pre-estimate of cost incurred by the Defendant; exceed any alleged actual loss to the Defendant in respect of any breaches of contract on the part of the Claimant.b)The contractual provision that permits the Defendant to levy such charges is unenforceable by virtue of the Unfair Contract Terms in Consumer Contracts Regulations (1999),the Unfair Contract Terms Act 1977 and the common law. Accordingly the Claimant Claims:a)the return of the amounts debited in respect of charges in the sum of £3490.03 including any interest charged thereon;b)Court costs. Which is one line too many Can you people pass you experienced eyes over it and tell me whether it is correct and how I can get this elusive line? Also I have not added the 8% interest yet where does that get added? As always any help much appreciated. Whiz_bit
  13. Hi people, I am just going through the money claim website and have a couple of questions about the claim. Hope someone can point me in the right direction. 1. Which address do I use, I am assuming the branch will do? 2. Can I claim any extra charges since the letters I sent them or do need to imform them first? 3. Lastly in the Particulars of Claim how much information do I need to put in there, just that I am claiming my bank charges or do they want more detail? Any help much appreciated Whiz_bit
  14. I got an offer, £1990!!!! I wasn't expecting one until after going legal? Just finished my get real I want all the money letter which goes in the post tomorrow, I have given them another 14 days before legal action. So roll on the 4th sept. Whiz_Bit
