  1. Only from previous lenders who are all paid up. Not had any from Experto Credite or the now Aktiv Kapital who say they bought this debt. Its all very odd as MBNA passed it onto Experto Credite and then Credit ManagementAssocs and sometimes both together but they were all the usual blurb nothing ever threatening and always answered with the standard "account in dispute" and "not properly executed agreement" letters. Now it is with Aktiv Kapital I'm not sure what they plan to do as I have not replied to them yet. If I do or more when I have to what should I reply with. Thanks
  2. Used Noddle and apart from a poor credit rating which is to be expected and a few searches for car insurance (i think) there is a default registered 12/02/2012 by Experto Credite. Oddly none of my part settled debts show up which I assume is good. Any guidence on Aktic Kapital would be appreciated. Thanks

  4. Sorry if this is all disjointed, my thread is not about PPI but about Aktiv Kapital as my disputed debt has been yet again passed on. That said Aktiv Kapital state they have purchased the debt and refer to a previous company who I have never had any dealings with. My question really is, should I do a quick letter to them advising them that the debt is disputed, not properly executed or just ignore them. Thanks

OK so through the help and advice on theseforums I have sent a letter to MBNA stating the debt was not enforceable andaccount in dispute due to a not properly executed agreement, got no realresponse apart from being passed between Experto Credite and Credit ManagementAssoc and their usual we have your debt now please pay us letters and sometimesboth companies at the same time. One response was that having monitored mycredit file I'm better off now so please pay which is odd as I wasn't aware Iwas and certainly wasn't aware they could monitor it given I had not applied tothem for credit. I ignored all these and all went rather quiet until today. Today I received a letter from Aktiv Kapital which states they have purchaseddebt from Varde Investments (Ireland) Limited, a company who I have not heardof or from previously and I now need to contact them to discuss repayments. So my question is do I just ignore them or do a quick letter outlining myprevious correspondence to the previous two companies about the account beingin dispute. Any advice greatly received. Thanks

  7. Thanks for the replies. So in a nutshell, return to them and say it’s not a properly executed agreement, don't feel its enforceable. I appreciate that not being enforceable merely precludes legal action but I'm fair game for constant letters etc so perhaps a f&f offer ? Thanks
  8. There does appear to be a "stamp" on the IMPORTANT - DATA PROTECTION bit. Is that not enough for them to say it is enforceable ? Thanks again for the help.
  9. OK so I did a Section 78 request for my old MBNA credit card and sadly they sent it back with a copy ofmy original application form and the terms and conditions all within the time period. So my question is . . . was it properly executed, is there any wiggle room. They are playing hardball and like many I just don't have the resources to pay them right now and need to either reduce it, get a low repayment plan, written off or a low full and finalsettlement.   11. Ok so here is a PDF of the letter back. CMC001.pdf Its just very odd as they have not bothered me for ages, well over 6 months and I have not paid them a been in years. I will see what they come back with and maybe go for a full and final. Thanks for the response.
  12. OK so here goes. I had a CC with MBNA which is fairly ancient and like many others fell behind and eventually stopped paying. Usual letters followed and it was passed around a number of DCA's and after a number of years it went to CMC who wrote me a standard "you have not responded" letter. So I sent them a section 78 request and got this reply. I can't post a link yet as I have not posted enough but if you goto pcreloads.co.uk/CMC0002.jpg its a bit bigger there. So apart from the obvious wait until the 5th October is there anything else I need to consider. They seem to imply that they can continue to request payment.
