  1. So the CCJ is on file for 6 years whether I clear it now or 5 years from now? I have access to a small lump sum and was hoping to get this (and a few other debts) all paid off F&FS with it so that I can make a start on rebuilding my credit rating.
  2. Looking at teh judgement the claimant was Santander with address for payment being Howard Cohen. I'm assuming Santander would not be particularly receptive to an offer for F&FS where they have a judgement against me.
  3. Thanks Andy If I was to try to offer F&FS, who would i do that to? Scotcall were not aware that this was a CCJ related debt, so I assume they would not have the authority to make the offer? So would it be to Santander, the Court or Howard Cohen? Thanks again
  4. Hi all . First up, thank you all so much for the help that you offer. I am sure that I am not alone in thinking that I would be feeling much more desparate were it not for the knowledge that there are so many helpful people out there . I have posted previously about a variety of debts from a variety of sources which I have. I started with the usual advice of sending letters etc but for one reason or another I lost track of things and got a bit confused how far I had got with everything. The upshot of this was that I got a letter from Howard Cohen & Co. notifying me of legal action and recived my claim form from Northampton. I (just about) replied in time and contested on the basis that I had sent my CPR31.14 request to Howard Cohen but had not yet receievd a response.I then received an Allocation Questionnaire at around the same time that my organisation gave up the ghost so this remained unopened and a judgement was entered against me . The General Form of Judgement was dated 21 October 2011 and the Judgement for Claimant dated 22 November 2011.The total amount owing is £2,220, due to be paid at £125 per month, according to the judgement . The first payment was due December 2011 but no payments have been made to date. I think I had a couple of chaser letters early on from Howard Cohen but had not received anything since then until a letter arrived at the weekend from Scotcall advising that I owed £2,003 (the outstanding credit card amount excluding the court fees) and they were very disappointed that I had not been in touch to arrange repayment . My questions are: -I assume I need to send Asda/Santander a SAR as I have not yet done this . -Does anyone think I might have a case for getting the CCJ removed given Howard Cohen's none-reply? -I am in a position to offer a full and final settlement, but can this be done where there is a CCJ in force?   5. Thanks for the replies. As an update, I have sent CCA requests to the credit card debt chasers and am waiting to hear back, and emailed all PDL companies requesting £20/month repayment terms (and cancelled my debit card today). I also told them that I would not be repaying more than the loan amount plus one month's interest...I await their responses with great anticipation! In terms of my N1 - I have done my reply online (outside the 14 days but within the 28) stating that I will be defending, and now sit in hope that Cohen & Co are as rubbish as they seem to be from reading some other posts on here!
  6. Hello all, newbie here! First off, a huge thanks to everyone who contributes – a lot of the stuff I have seen has already helped, and it’s nice to know that I’m not alone in my situation. However, any advice on what to do next would be much appreciated. Briefly, I have: Egg Card - £2.5k – debt collectors chasing me Virgin Card - £2.5k – debt collectors chasing Asda (Santander) - £2.5k – Cohen & Co. Involved, I have received a Form N1 which I did not reply to within the 14 days (and still haven’t replied to). Help! In addition I have 4 pay day loans amounting to around £3k, including interest and charges. All are past their repayment date. I have been in touch with the CCCS and am in the process of setting up a DMP, and I have sent the standard CCCS letter/email to the 3 CC companies and 4 PDLs. The CCCS are just waiting for a couple more statements from me to work out my total debt before contacting the lenders. I have been able to get a loan from family which should cover two-thirds of the total above, and was hoping to make it stretch further by agreeing some reduced settlement figures with the CC companies. I mentioned this to the CCCS, but they said they would be obliged to offer it split amongst my creditors, so if I go down this route, i need to do it myself before setting up the DMP. Does this seem a sensible next step? If so, would you recommend I settle the PDL money or CC stuff first? Other questions I have: If the lump sum did cover the CCs and I am only left with PDLs, is there any difference between agreeing my own payment plan or through the CCCS? And how the heck can I get them to stop taking the money directly from my account?? In terms of reclaiming charges, should i do this before or after trying for reduced settlements? And can these be reclaimed from PDL too? And a really, really stupid question...if I am reclaiming charges and they agree to refund, but I have the balance on the card still outstanding does it actually get repaid or will it just be set off against the balance?? Thanks again all, and sorry for the lengthy post! Having written all this I have just seen that there is a substantial thread on F&FS which I am making my way through now! But any other help is much appreciated.
