  2. Strange though. I sent them an offer yesterday for what i was paying through my dmp - they didnt accept it, but what is strange they actually replied via email.this is my email: "Dear Sir/Madam, Acc/Ref No xxxxx Thank you for your letter of 01−07−2011. We are very disappointed that we seem unable to reach a satisfactory compromise in this case. As we have already explained, we can only afford £28.56 per month at the present time. This is the only realistic payment proposal. You have stated in correspondence your intention to commence proceedings in the county court against us. The commencement of legal proceedings under such circumstances could be counter to the ‘Overriding Objectives’ of the new Civil Procedure Rules. You will be aware that the Overriding Objectives underpin everything the court does. Moreover, paragraph 4 of the Protocols Practice Direction states that in cases not covered by an approved pre−action protocol, the court will expect the parties “to act reasonably…….. In trying to avoid the necessity for the start of proceedings”. We would suggest that your refusal to accept our offer could be viewed as unreasonable and we would ask the court to consider this matter with reference to the Overriding Objectives. The offer of £28.56 is of course still open to you to accept. Yours faithfully Mrs xxxxxxxx" and this is their answer: "Dear xxxx, Thank you for your email. Your offer of £28.56 per month has been rejected. This is becuase of the nature of your loan. You borrowed £300 on 29.11.10 for 28 DAYS ONLY. We are at a loss how you can offer us £28.56 per month and expect us to accept this. Please state WITH EVIDENCE what has changed in your circumstances since you took out your loan. Failure to come to an agreement with us will lead to ground recovery agents being dispatched to all addresses on file and proceedings will commence against you in your local county court.   3. this is the letter i got from atkinson&firth: "27/06/2011 Dear xxxxx we act for MH Bailiffs (MHB) who act as agents for Toothfairy Finance Ltd.We understand that despite numerous attempts to obtain the payment the debt remains outstanding.The pre action protocol under the Civil Procedure Rules has now expired.We are accordingly instructed to advise you that our clients now intend to issue court proceedings to recover debt and the additional cost that have been incurred due to your failure to pay the debt promptly.Proceedings will be issued against you after 7 days without further notice unless the payment is made in full or you contact MHB an come to acceptable agreement. The amount of the claim will be as follows: outstanding amount 1083.44 court fee 45 solicitors fee 150 in red: OUR CLIENT HAS INDICATED THAT IF 600 IS RECEIVED IN CLEARED FUNDS BY 17:00 01.07.2011 PAID VIA THEIR WEBSITE THEY ARE PREPARED TO CLOSE THE FILE. THIS WILL NOT BE EXTENDED OR NEGOTIATED." this is the letter from A&F. what do you think? any advice please? thanks. Gabi18

  6. hello, can anyone advice me please? i'm in the same situation as kb2011. i received a letter from Atkinson&Firth following the email from MH Bailiffs. i'm thinking to go the way as kb2011 did - but not sure who i suppose to write to: MH Bailliffs or Atkinson&Firth? i took loan in december last year and i've been paying Toothafairy £28.56 through my dmp with one company (but from now on i will be doing my own dmp as i cancelled my contract with company because they charged me too much) - they have never accepted my offer although they have never refused payments.my loan was £300 + interest £54 (for 14 days - it was originally my loan as i took it for 14 days). but for 4 weeks contract says interest is £108. which one should i take to make an offer to them? any advice please? thank you Gabi

Hello everyone, I've got a question: I stopped my dmp with company who charged me for that and decided to do it on my own.since I've started my dmp in December last year my wages went down because I'm not getting any extra money as I used to. I did my budget sheet and it shows I've got left about £70 instead of £200 on my plan with that company.Till now I paid every month £164 pro-rata to all of my creditors. What is your advice Guys?What shall I do first? I was warned by DMC that my creditors may not negotiate with me. Any help please? Thank you. Gabi

Tingy, I cant afford pay wonga this month. i've read some posts about minicredit and some people said it's better to pay them off because they are very difficult to deal with. if i will do it i will have to pay them £192 (I took £150). also i've read that just before payment is due I should write an email to wonga saiyng i cant afford make a payment because of my circumstances. with my dmp £164 and that minicredit £192 will be £356 which is quite a lot of money for me. also i've just gone through my I&E with DMC I had and I've noticed my income there is £200 more than I'm getting at the moment. I thought as I was reading posts here if I start my own dmp i could send to all of my creditors new I&E and the letter about change of circumstances. What do you suggest? I will then pay all of my creditors as it was with DMC. the only question: how can I do that if I haven't got their account numbers as DMC was doing that on my behalf and DMC didnt give on monthly statements me those details just the name of my creditor and amount of money paid. also what about the last payday loans I had to take?they are due 15th and 16th July. I'm opening the new bank account with co-op so wonga and mini credit(i took two of them while on dmp with dmc) wont be able to take money out from my old account. any advie please? Gabi

  17. Thank you Tingy so much for your advice and help. I thought I was the only one having this sort of problems till I found this site. I appreciate your help, knowledge and experience so much!!!!! My concern was if I can just start doing my own dmp.I was told by my Debt Management Company I can have serious problems with creditors. But I just dont wont to pay £45 a month as a fee!!!! I've got another question: my payment is due 16th July - I've already cancelled SO for my DMC on the day I terminated my contract with them. Shall I pay to all of my creditors as it was with DMC? What sort of time I have to send new I&E form to each of them?Which letter should be as the first one?Shall I inform my creditors that from now on I will be dealing with my accounts?As I said almost all of my accounts are with DCAgencies.where should I write? to the original creditor?or to DCA?what about getting CCA? thank you so much for helping me Gabi18
  18. Thank you for your advice. I'm a bit scared as I'm not a British Citizen and English is only my learnt language so dealing in that specific area will be really challenging for me. But I decided to have a go a try. By the way: is it important that I have nothing in here, I mean no house, car etc. I rent privately furnished double bedroom. Thank you once again. Gabi18
  19. hello everyone:) i'm new here. i've been reading this site for a few days - it's really helpful with a lot of information. i've just terminated my contract with DMC as I thought I could start doing my own dmp and don't pay them that monthly fee. i've been with them since december last year. i've got monthly statements from them showing how much money was going where. most of my creditors are payday loans, i've got one account with overdraft (Lloyds) and two credit cards (Lloyds and Capital One), and one loan with Oakam. all of my accounts (except capital one) have been passed do DCAs. I don't know how to start again with my creditors? My point is: I wanted to try negotiate with my creditors and ask them to freeze interests on my accounts and take my offer with reduced payments. In total I've got about £6k, I don't know the balances as I just kept receiving letters with amounts still going up and up. Also I think I made a mistake while on dmp. I had to take another payday loan - paid once but I wont be able to pay it this month. I din't inform about that my DMC. Thank you Guys for running this forum.   20. Hello everyone! I'm new here. i would appreciate any advice with my situation. i've been on DMP with DFH. I hsve just have terminated agreement(today) as i want to do my own DMP. i've got debts circa £6k: 6 are payday loans, 2 credit cards (LLoyds and Capital One), Shop Direct, The Money Shop, Lloyds overdraft, Oakam loan. Every month I paid into DFH £200 and £164.74 was going pro - rata into my creditors' accounts. DFH called me today after receiving my notice and I was told that the termination of my contract with them can affect THEIR negotiation with my creditors. What should I do first?I mean I made the decision about doing my own DMP and I want to stick to it. Any help and advice will be really appreciated. Gabi18
