  1. Many thanks for this. They have sent none of the above and the situation is that I am defending this against the backdrop of a court case that has been set aside and the claim stayed. I have not seen any of the court papers and have not put in a defence. In fact all the court keeps asking for is an allocation questionaire. Anyway having looked at the statements there are penalty charges but no PPI. How do I start to go about reclaiming these from the assignee? and is there anything specific I should be asking? Any help would be greatly appreciated.

  3. It is already at the court stage and yes there are penalty charges that I have yet to calculate. I have read 5 and 6 but can't see an answer. I have also read a number on threads that relate to this matter but again there does not seem to be any clear advice. From your experience can unenforcability be successfully used to defend such cases where prscribed terms are missing from the alleged signed agreement (single page, unclear agreement). In an ideal world I like to settle with a mediator to make this go away but the charges that have been applied by the DCA double the debt and make the amount unrealistic. Obviously I dont want to flog a dead horse if there is no way to defend this. Make thanks in advance for any advice you can give

  5. Hi, I have just received a microfiche copy of a credit card agreement that firstly is not possible to read, well the terms certainly are not, and is from 2004 and Im sure does not contain the prescribed terms. Can anyone point me in the right direction to defend this? many thanks
