  1. Nothing in the mail this morning, will look at sending a letter to confirm that it is no longer an issue as suggested earlier.
  2. Response from the OFT: Dear Mr jonah001 Consumer Credit Act 1974 (the Act) Complaint Against: HFO Services Limited Licence No: 555914 Thank you for your email received on 16 June 2011. I apologise for the delay in responding. I can confirm that the business you mention holds a consumer credit licence. Under the Consumer Credit Act, holders of consumer credit licences must be fit and competent to do so and the Office of Fair Trading (OFT) has a duty to monitor the fitness and conduct of all traders who hold such a licence. The OFT has issued guidance to consumer credit licence holders engaged in the debt collection industry. The guidance is intended to ensure that debt collectors treat individuals fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants. You can view our guidance at: [link removed] We have therefore recorded the details of your complaint, and we will consider this alongside any other complaints we have received with a view to any consumer credit licensing or other action we may decide to take. If we do take any action against this trader we may need to contact you again in the future. Unfortunately, we cannot disclose any details about any action we may take, due to legal restrictions on the OFT relating to disclosure of information. While we are very sorry to hear about the difficulties you have been experiencing, the OFT has no authority to become involved in individual disputes between consumers and traders so we cannot advise you directly in this matter. The Financial Ombudsman Service can help with most complaints about consumer credit products and services if the consumer has failed to satisfactorily resolve the matter directly with the consumer credit licensee itself. The Financial Ombudsman Service can be contacted at: The Financial Ombudsman Service South Quay Plaza 183 Marsh Wall London E14 9SR Telephone: 0800 0234 567 The OFT has published a consumer guide about debt collection which you may find helpful. The guide can be viewed on the OFT’s website[link removed] Thank you again for writing to us and bringing this matter to our attention. Yours sincerely David Annis Enquiries and Reporting Centre Office of Fair Trading
  3. Still no response from them so far. Will take it that they are far to busy or have dropped it.
  4. No response yet, just a quick update.
  5. Also sent complaint email to the OFT as recommended. These people need to behave better or get closed down.
  6. Ok,will brave up to confront the ex and try and get more details, also will send the "I know nothing" letter this morning. Thank you for the help
  7. Phoned Clydesdale Financial Services, on 0844 811 9000 they did a search on the account number and my name. apparently no such account exists for the postcodes I gave them. With out more details such as the loan type or if it was a card they could not help me? Would the next step be a letter of denial to HFO and a SAR to CFS? updated first post with this to keep things tidy.
  8. Sorry for the confusion. Let me try again, anyone who has taken out a a private car lease will know the stress of returning the vehicle. For me it was a constant battle over a 1 year period to not pay for "made up" charges based upon a 15 minute inspection from one of there people to the sum of £2300. As there is no specific sub-forum for this type of thing and because I want to help others who may also not be happy about similar situations I posted here. Sorry for any confusion.
  9. It didn't go to court at all, they just gave up I think. The FOS agreed to take the case, and wanted me to sign it over to them. This happened a few days before they (Audi) agreed to cancel the bill. I believe there solicitors handled it very badly and did not really attempt to resolve the issues , just threats.
  10. Just a brief outline of a case I recently won against Audi Solicitors and how it may help others. I had a private lease from Audi for a car over a 3 year period. It was not apparent that an Audi dealer had to service the vehicle so i used car-craft. Car-craft actually provided good value for money services and scratch repairs to the vehicle, this was after I clarified that they where an "Audi approved service centre". the issue came on the vehicle return inspection, bills where raised for non service history, and insufficient repair to paint work. additional mileage was added as was other issues. Lets get the car craft bit out of the way, they should not have carried out the work due to a bit of small print in the agreement that I am sure goes against current law, but they where cheap and did a good job in my eyes. The main issue was that the bill was immediately passed to there solicitors where a 12 month battle ensued in writing. I finally stated that I would not deal with them and contacted the FSA and the ombudsman. Eventually I received a letter from Audi stating that they would write of the £2000 bill due to good faith? this was followed approximately 4 days later with a letter from the ombudsman stating they could not support my case. Audi failings: they did not communicate with there lawyers, as an example I requested a copy of the paperwork I signed on take over ( this was the mileage issue) but they where unable to or refused to produce it. The car was taken from me and taken to a car auction, it was probably sold within a week. All bills for servicing was given to them along with the log book, this was in the car that was sold. there request for payment due to servicing issues resulted in me sending a copy of the first service and asking what was incorrect so I could recover the money from the first garage. I indicated once this was covered I would then approach the second garage and so on. Audi did not provided any paperwork to support there issues apart from the disputed inspection on handover report. I have copies of all letters and will provide advice if anyone wants it in a similar case.
  11. I don't think the agreement was for a loan, but am not sure, perhaps a store card if they do one, or an agreement for electrical goods? As for the phone call, I have suspicions it may have been fed to them, especially if they have been sending letters to my old home, but don't want to jump to conclusions. Anyway thank you for the advice so far, I will contact Barclay to see if they have record of the CFS agreement first thing and feedback on here in the morning.
  12. On a separate note, how did they obtain my partners mobile number? it is not something that is out there for anyone to use?
  13. I have a long standing Barcley credit card all in good order. But I am at a loss to what this is. I probably do have some debt from prior to mid 2006, after that I recieved a redundancy payment which paid them all off I was led to beleive. I have had good credit since I walked out in 2009. I will contact Barclay to see if they have details using the account number they sent me. Recently I looked at my credit report and noted something possibly from September 2005 and something from Jan 2006? but now cannot find them again. If it refers to one of these then it would support the "scare him as the 6 years is nearly up thing" Many thanks for the advice and help so far
  14. I have vague memories, but have heard nothing for years, mostly the other half dealt(hide) with the finances. However it could be from around 2003 to 2006 as this was a particular bad financial time. I have lived with my current partner for about 1 year and have not received anything from them till now. I also cleared a smaller debt with them about 2 years ago gaining a bad mark against my bad credit history, I then found these forums a bit to late. But hopefully not this time.
  15. The above is a copy less personal things that where written in the letter, the envelope indicates it was posted from London with a postage paid stamp of PB550239, this number is traceable to a company I believe. If you require more details please ask away, as for the hard luck story, my ex ran up 1000's in debt and i buried my head in the sand for years. Eventually I gave up and walked out about 2 years ago, and now these debts are finally catching up with my name, there is the potential that I never actually signed any agreement and she forged my signature. ( i worked overseas a lot) but that is a seperate issue that could have other impacts such as her denying me access to my children.
  16. From HFO Services LTD Dear Sir, your account with : Clydesdale financial services I have attempted to contact you several times recently with the offer that HFO has for you in connection with your account. The current balance is £2500( ish) your debt is now due for immediate repayment and we require to initiate payments within 3 days. After 3 days the account will be escalated to legal desk for legal action against you for the total balance outstanding, with applicable court costs and solicitors fees. Your dossier indicates that you can make contributions towards this outstanding debt. Once HFO obtains judgement against you, we will seek to enforce our judgement by way of a Warrant of Execution. Court appointed Bailiffs will visit you at (my address) currently registered in he name of Po Box ***. Teh baliffs will sieze teh assets which will then be sold at public auction in order to pay your debt. Or HFO may also instruct its solicitors to secure an Order to Obtain Information against you, which means that you will be asked to produce financial documents. If it is found out that your financial situation is better than what you represented, the court might consider taking a stern action against you. I would wish for us to avoid such an outcome which makes paying off your debt a far more expensive proposition. Please contact me for an amicable resolution to you case. yours sincerely
  17. Hi, Just received this after a telephone call 2 nights ago. firstly the call, this was to my partners phone asking to speak to me, when I spoke to them they wanted me to provided name address and date of birth which i refused. I wont give that information out to any one who calls. They stated they had tried to be in touch and had sent letters to me. I stated that they had not sent anything and if so then it needs to be addressed correctly. and that i did not want them calling that number again. A letter arrived this morning stating i owed money (£2500) and they would send the Bailiffs in 3 days if I did not pay. I have read the other threads and will contact Clydesdale Financial services ( Barclay I believe) to find out when my ex-wife failed to make the last payment. then will send the CCA request, does anyone have any more advice for me before i start? thanks for any help UPDATE 1.
