  1. nope there not charging me with evither of those this is what it said on the letter... That you on thursday 24th Febuary 2001 en route near kings lynn: having entered a train for the purpose of travling. did not have a ticket entitling travel byelaw 18 (1) of the railway byelaws made under section 219 of transport Act 2000 by the strategic rail authority and comfirmed under schedule 20 of transport act 2000 by secretary of state for trnsport on 22 june 2005 i think its the same thing?
  2. ive challenged the inspectors statment becuase it was false and his is perverting the court of justice. i wrote the letter for a mitagation and i have pleaded guilty so why wouldnt they accpect my plea as guilty as ive said i am guilty of the offense. but the sitution was a misstake so my lead to a mitigation
  3. the court send me 2 letters to sign the frist letter gave me 3 options saying... guilty and accept the evidence given and the court can decide what to do with the witness. Or guilty accept the evidence but want the wittness to be present third option was i plead not guilty i sign the frist opion but crossed out where it said i accecpt the evidence. second letter to sign was saying do you accept the wittness evidence OR you do not accepct the witness evidence which i signed also i form of my wages and out going/ savings to see if i can pay the fine i then wrote letter as a stement as i plead guilty i dont have to attend court and will hear and deal with the case on my absence under section 12 of the magistrates court act 1980. and the following satments and facts will be read out before the court witch decides weather to accept my plea.The court will not, unless it adjourns the case after convicting me and before sentencing me. i then wrote a letter to the court clerk/judge saying... Dear sir or madam I am writing this letter as although i accept i am guilty of having the wrong ticket this was a mistake on my part due to the following, On monday the twenty third of february i purchased the ticket at Sandy station from the machine the screen was very difficult to see this did not help me as i have reading difficuities (I include proof of this which has been written by the dyslexia co-ordinator at my college this has also been shown to the train company since the event), I intended to buy an off-peak return from Sandy to kings Lynn but by mistake i purchased an off peak day return, when i was approuched by the ticket inspector I produced my ticket when asked, it was then i was informed i had the wrong ticket, i explained to The ticket inspector i what had happened he said "can you pay the fine of £20 now, i said " i had no money".this was because i thought my ticket would get me home, as i assumed it was an off peak return and had spend my money on my trip, i also told The ticket inspector i was dyslexic, When i received a copy of The ticket inspectors (the wittness) statement i was dumbfounded as it dose not indicate the term of events of our conversation as it happened i would like to cover the differing points now, The first Question on the statment do you have a vaild ticket or authority to travel for your rail jorney at this time, the answer written is "No-i have a ticket from yesterday" This was not my reply, i actually said yes i brought it yesterday. The question, " was it your intention to avoid your rail fare today" was not asked, The ticket inspector actually said "do you have any money" which i answered "no" The section 'passenger comments' that i answer "i have a return from Sandy to Kings Lynn from yesterday" was due to my learning difficulities i sometimes express my self poorly,( This is also on the proof of my lerning difficuilties attached. When i signed the statement it was not filled in to the extent it was when i recieved the copy and The ticket inspector told me he would put down i was willing but unable to pay. I signed the statement due to my processing speed abilities, which caused me to react without really quite know what was going on till afterwards. I am sorry i mde this mistake, it has caused me nothing but worry since i have reccently found the confidence to do alot more with myself and this event has knocked my condidence greatly it is difficult when you cannot express yourself correctly or red very well, i do hope you understand this.
  4. im not part of a group but any help i do need ect... computer in class, extra time,a reader, headphones and software witch can read words for me is given. and i rarely use the train and at the time i only used it probss once every weeks for about 2 months.

  6. ill have to write to the clerk/judge as i only got the letter that there taking me to court and the court date is thursday 7th so i wont have time to write to the prosection office and im writing the letter for a mitigation but im pleading guilty as i did have the wrong ticket but hopefully with the sitution i have ill be given some remorse and allowed mitigation on the penalty but it more about proving my point to the court also even if i am fined and after reading trough the documents sent by the court i think my fine will be around £130 witch isnt that bad considering the worse but still alot of money to a apprentice carpenter >
  7. dose this mean i'll plea guilty and then after conviction they read out any following satements where the case could get dismissed or they come to there conclusion for the penltaly is that where i write i plea for mitigation in the court with the following points as i only have two options for conviction either guilty or not guilty and i will add the wrong evience from the FFC in may stament to the court but will not make it a police matter.
  8. i brought the ticket from the machine thast why i made the mistake of purcasing the wrong ticket as the ticket office was closed at the time i mis read it and brought the wrong ticket without realising at this point AT kings lynn i got on the train the FCC stopped me - then i realised my ticket was wrong i didnt have any extra money to cover the cost as i stayed the night around my girlfriends etc etc and thought id have no problems coming home untill he stopped me i had no intention of skipping the fare and thats the evidence which is going to court which the FFC is using against me he got me to sign a piece of papper i didnt know what it was i was panicking and it was blank when i signed it on the evidence it is filled out and under the section which says " did you have any intention of skipping your fare today" he wrote Yes- i had no money but thoses where not my words and he did not write that when i signed it and i am denying this evidence currently writing a letter to the clerk where if feel it problaly best to plead guity as i did have the wrong ticket and then with the sitution i have a chance of them dismissing the case... my evidence is i had no intention of skipping the fair i brought it from a machine misread it due to my learning difficulties with evidence from my dylsic co-ordinator at my college also the false evidence the ffc are providing and the fact that becuase i thought i had the right ticket i had no money on me as i thought it was going to be a smooth trip home.. either ill get a fine or dismissle but i am not going to court as im pleading guilty and it will just cost me an extra £25 to get there so im trying to do the cheapest option do you think this is for the best?

  11. i think i may be guilty as i did have the wrong ticket it was just a mistake as i didnt have any intention in skipping the fair and it is correct i had a day return and came back the next day as i was ment to purchase a off peak return.
  12. the story is basically i got on a train with a ticket of for off peak day return i made a genuine mistake as i was ment to buy a off peak return i had no idea untill the next day when i was stopped i read the ticket wrong of the machine i purcased it off i thought i had the correct ticket, i had no intention of skiping the fair i only reliezed i had the incorrect ticket when i was stopped then he issued me with slip. after months whent bye i got letter from ffc to pled my case witch i did and after ringing them up explaining due to my learning difficultys i made this misstake the women told me to write another letter with proof doctors note or trained person which i did, i got proof from my dyslexia co-ordinator at my college after sending that off with sorry i didnt reiceve nothing back untill i got a letter through the court and the witness statment is wrong as the insepector (the witness) did not fill out the form at the time of stopping and made me sign a blank slip witch i didnt know what it was and he did not tell me and i could not read it and now the evience he is giving is a filled out note witch was never filled out when i signed it? what shall i do plead guity as i didnt have the ticket yet still write a letter to the clerk to explain tht the evience was wrong and that i did make a genuine mistake and had no intention of skiping fair?
  13. i have been given a letter that Frist captial connect are going to carring on my case i have rung them up to inform them that due to my learning difficulitys i misread the ticket of a machine a purcase the wrong ticket a off peak day return i brought insead of a off peak return and the inspector was ok with me paying the price diffence of £3 but i had no money on me t the time the women on the phone said i can provide a letter to prove my diffculitys witch i did from the dislyexic co-corditor at my college and wrote posted a copy of the letter and the details of what happen is it lucky that they will dismiss this case or carrying on with the case?
  14. 3 months ago i brought a ticket to go to my where i wanted to go i thought i brought a off-peak return but i brought a off-peak day return and came back the next day i was stopped and i didnt relieze what i have done untill the inspector said i had the wrong ticket in no way was i trying to do wrong and he said i made an easy misstake he offered me to pay for the right ticket but i did not have any money on me at the time i gave him my details and he noted in his book i did have a ticket but made the mistake of buyign the wrong one and the difference in price is only £3.50 he told me the letter would come in 2 weeks but took 3 months and i appealed my case but the case is still going to be going on i feel like im being bullied into paying a large amount of money for making a easy misstake i always have learning difficulitys and im only 18 i didnt understand what really going on i need help is there anything i can do about it i had no intension of doing wrong and they are making me feel like a criminal...
