  1. No they say they don't have it, and I'm starting wonder if I actually received one, it was so long ago. Either way, the accident was in 2003 and I think last contact was in 2004. But I was never presented with a bill/debt until earlier this year.
  2. I don't have any letters or documentation, this relates to an accident in April 2003
  3. I've had a reply from MIB, they've skirted round the SB reference in my email. They've given details of their complaints procedure and sent a form for 'subject access request'. What do I do next? I still need to get my complaint into the OFT, but other than that I'm not sure of how to tackle this
  4. they've made a mistake regarding the description of the letter, which i'll correct in my next email. the letter didn't reference writing off any debt as there was no debt, i had been cleared in the civil claim. now onto my problem, i don't have a copy of this letter. at least i've been unable to find it. because of the timescale, i think it might have been disposed of. in fact i've been unable to find any of the correspondence with the MIB. my search will continue. So what's my next step? do i ask for copies of everything in my file that i am entitled to under the data protection act? do i go straight in with the Statute Barred approach? please help me, i'm not sure what to do next..... due to some issues at home, my flat roof decided to stop keeping the rain out, i am only just getting round to replying to my last email from MIB. i'm not very good at writing these letters, so i've come up with this draft. what do you knowledgeable chaps (and chapesses) think? feel free to add to, amend or advise as u see fit. Dear **** ******** Firstly i'd like to point out that the letter did not advise that any debt has been written off. There was no debt as i was found to be not liable. I still dispute this claim and do not accept liability or that there is any debt. Due to the age of this alleged claim I no longer have any reference or documents relating to previous communications from yourselves. It is legally up to yourselves to prove my liability, not for me to disprove any claims, but as I was not given the opportunity to defend myself in any court then I cannot be held responsible for any payments your organisation voluntarily made to the 3rd party. I would also like to bring to your attention that the alleged debt is time barred by the Statute of Limitations Act 1980, there having been an elapsed period of more than what is prescribed by the Act since the incident and no previous claim issued against me. I would like you to send me copies of all documents and communications, as permitted under the Data Protection Act, relating to the case. Also I require you to send me your complaints procedure by return of post and this is to be treated as stage 1 of the complaints procedure. I will also be informing the Office of Fair Trading to investigate this matter, how the case has been handled and the legality of the alleged claim. Yours sincerely I need to get this sent to them ASAP as a Milton Keynes number has been trying to contact me, i'm assuming its the MIB, i'm not answering it though.   6. Many thanks for your quick reply Bazooka. It's a relief to hear. I take it replying to them by email is ok?? Also I've never had to deal with anything like this before so don't be surprised if I keep asking for help with this.

Please help me. i had a letter from the MIB and Banner Jones regarding an accident i had in 2003, claiming i owed them over £17000 for a compensation claim they'd paid out. the last correspondence i had with the MIB was about 7 years ago when they sent me a letter saying that i wasn't liable for the claim, they'd had a witness statement from my passenger.
