  1. Apart from the fees they've just refunded me, the only thing I have left is PPI which I believe they mis-sold to me, seeing as how I didn't want it or need it but the guy on the phone insisted I get it anyway.
  2. I was starting work soon but don't get paid till November. My plan now is to pay it off with money from my first paycheck (it never had a huge credit limit anyway) and tell them to shove it. I was going to keep it for emergencies but after this fiasco I think I'd rather not. And I'm sick of having credit to worry about anyway.
  3. So I am really ****ed right now. Barclays refunded me £156 of charges and £77 in interest. However as soon as they did this they reduced my credit limit also. So it's like I never got these charges back in the first place, and can't use the money for anything which is what I was hoping for. Is there anything I can do in this situation? Or do I just have to deal with it? :\
  4. Any help on the fees front? I gave them until the 7th before I complained to the Financial Ombudsman and OFT so I'm probably going to go through with that (although they didn't seem to bothered by the fact).
  5. I was told he was an agent not just ordering for people from his account but I'll get some more information and come back here with it. I'm pretty sure the debt was under the friend's name though. They are declaring bankruptcy soon as they have a lot of other debts but they just want to keep these lowlifes off their back until they can do it.
  6. I'm writing this post on behalf of my OH's father. He is being chased for a debt for CapQuest which was previously owned by littlewoods. His father was an agent for littlewoods, and a friend of theirs bought a laptop I believe, I don't know the details but the debt they're chasing is for the friend and not the father. Recently they've been sending all sorts of threatening letters to him (as well as to his other son who live elsewhere). The friend even wrote them a letter saying it was his debt and he'd sort it out but they refused to listen and continued to hassle my OH's father. The debt is possibly 6 or more years old, he's never paid a penny or admitted to owning this debt but I'm not sure if that means it's statute barred. I have advised them to send a CCA request since there obviously won't be one as he never signed any credit agreement, with it not being his debt, but wanted to post here and see what you guys think, as you've been really helpful in the past!
  7. Update. Barclays sent me a letter saying their "site was working" (I never said it wasn't, just it told me the wrong minimum payment) and that if any fees are charged they won't refund. I already scrounged up enough to make the payment to stop them getting their grubby hands on more money. I do believe they were just trying to be sneaky to add more charges to my account. They said I'll get a letter about my other complaint "soon", but I'm starting to think they're just going to refuse to refund me or ignore me hoping I won't do anything. It's strange because the thread I got the letter from people were saying Barclays were refunding all their charges in a matter of days, but it seems with me they just want to play hardball. I think probably because I insisted on charges being sent via cheque or bank transfer.
  8. Thanks HB. I'm not particularly comfortable with talking to banks and such on the phone but I may do this if necessary. They replied saying it'll be in about seven days before I get a response but the "minimum" payment was due on the 8th.
  9. Just a note, I'm still in good standing with my Barclaycard Credit Card...just about. So it started at the beginning of August. I tried making my minimum payment and the site went funny. I wasn't sure if the payment went through and I didn't want to pay again and go over with my bank, so I waited. It didn't go through and they charged me £24 for late and over credit charge (£12 each). I sent them an email stating that I wasn't happy about this, that it was a problem on their end and I attempted to make the payment. They offered to refund just those fees and no more if I replied saying I was happy with that. So I decided to take this opportunity to get all my fees back, said I wasn't happy with that and sent of a template letter via email. Confusingly they refunded those recent fees as well as one more out of nowhere, but no others, and haven't properly responded to my email about it. I definitely have more fees as I checked my statements, but they seem to be ignoring me and they have until tomorrow to get back to me until I send my complaint further. The part that's frustrating me though is that during this, my minimum payment jumped around. At first it was 24.35 but after I complained about their site and they refunded me my minimum payment went down to 12.35 which I paid just recently. I then checked to make sure it went through, it did, but now I'm being told the minimum payment was meant to be 24.35 and I haven't made it in full this month! Even thought the site stated the minimum for me to pay was £12.35! I've emailed them asking why this has happened as I only selected to pay the minimum amount and unfortunately I can't afford any extra. My payment was due in two days and they'll probably put on more fees and refuse to refund them since they're ignoring my other email. Sorry this is long, any advise?
  10. I believe it's possible it's been sent back in my case. I haven't heard anything but my guess is whatever clowns they've sent after me now are writing to my old address again, which would be the third time now. I don't have the energy to go chasing them and telling them where I live any more, they can keep wasting trees writing to a incorrect address for all I care. If they do happen to send a letter to my address I'll just let them know I have no idea what it's about and ask them to prove it. Again, I don't feel I should just be bending over backwards for these idiots.
  11. LOL what a joke, why should you have to prove anything? Surely if they're chasing the debt they should be checking that it's, I dunno, a debt?
  12. Okay, so. I was wondering if anyone had any advice for me. I forgot about it being a bank holiday weekend so when I paid my credit card I noticed it hadn't been credited, I flubbed thinking the payment didn't go all the way through and made the same payment again. Only to realise I could check and see that I already made the payment, it's just not been received yet. So I emailed them politely asking them to cancel the payment before it's processed, gave ref number. They asked me to get back to them with more info. I gave it to them. Now they're saying the account needs to be credited with the payment before they can "resolve this issue". They can clearly see there's a payment going in before this one, so can't they just refuse the second one? I emailed them again asking them that I know it's not been received (that was the problem of why I sent it again!) and to refuse it before it's processed. I know it's my fault for not checking but do they really need to have the money on the card before they can "resolve" it (meaning they'll probably try and argue it and keep the money there, no doubt, something I don't want to get in to) Just wondering if there's any advice, something I could word to them in an email if they come back with the same cookie-cutter response? Or should I just keep emailing until they relent or resign to having to battle with them when the money goes through? EDIT: This is a normal credit card payment. It's a card I'm in good standing with, not a debt I defaulted on, just a regular monthly CC payment I messed up on. Just thought I should clear that up.

So if another DCA should come and hound me and if I can't send a CCA (though I've heard they've worked with others so I'm confused) what should I be advised to do in response?
  15. Letter today! Dear Madam, We thank you for your recent letter and return your payment of £1.00 as we are no longer instructed in relation to this matter So did Natwest take the account back before I sent the letter, or is it more likely BC gave up on it seeing the CCA request letter? If it's the former no doubt I'll be getting letters to my old address again. That's the second DCA that's given up on this debt now. ETA: If a new DCA comes along, is the account still in dispute, or do I need to send yet another CCA request?

  18. Any help or advice? I'm really confused. Sending CCA letter today as I was unfortunately busy over the weekend and I'll post any updates on that but I wanted some advice on why this debt isn't on my report if anyone can.
  19. So after checking my credit report I am thoroughly confused. I had a credit card with Paypal which I could no longer keep up with payments. They sent Howard Cohen onto me who then APPARENTLY issued me with a CCJ which I filled in and I'm now paying them £5 by standing order every month. However after checking my report it says I only have a Default from them, and not a CCJ. The default is from C L FINANCE LTD which I'm guessing is Howard Cohen? Did they lie and trick me in to thinking it was a CCJ to get me to respond? I'll try and find all my letters from them soon but I thought I'd post here to see if anything similar has happened or what you guys think.
  20. The report is with Experian. It shows all my previous addresses, the credit card I defaulted on, another card I currently own and in good standing but nothing else. The debt was with Wescot previous who were sending letters asking for money last year and previous, I wrote to them and they replied saying it was given back to Natwest and then I got a package of letters from my old address about two months ago and Bryan Carter where the new ones chasing it up. I'm pretty sure about the debt age as I got the account in 2008 and they stopped it around 2009 for not putting money in frequently (I had to pay rent and student loans were really late so there was nothing I could do). I also remember going into the Natwest branch to try and sort it out and she put me on the phone to some rude woman who kept saying "pay it all now or you'll be defaulted!" but I just entertained her and never spoke on the phone again since I like to keep everything in writing. I am very confused though as it seems I have no debt with Natwest or anyone else apart from the credit cards I previously mentioned. I know Experian have all my details as well as they have all of my listed previous address and where they were linked from (one which actually says it was linked from Natwest). What does this mean exactly?
  21. Okay, I've just checked my credit report and nothing from Natwest is on there? Are OD not counted towards your credit? I remember when Natwest took my OD from me they threatened me with a default but the only default I have at the moment is with a credit card I owned and couldn't keep up payments (which is all sorted now) and it mentions another credit card I have which is satisfactory as I'm keeping up with payments on it and haven't been late. But not a mention about Natwest or anything else.
  22. Oh right, sorry. Lack of sleep. My guess would be around £30 is made up of interest as the debt was for £1250 roughly and it's gone up to £1280 before it was passed to BC. The OD was interest free until Natwest demanded the full payment so £30 is all that's been added I believe. BC are threatening to add about £150 to that though in court fees and solicitor fees if I don't pay the debt and they issue me a CCJ. The letter I'm sending is asking for a breakdown of all interest and charges as well so if they manage to send that to me then I'll know for sure, but I doubt they have anything if they just bought the debt.
  23. I already know what the debt is for though as it states it's from Natwest and the total is from the debt I owe Natwest. I signed up with Experian though to check my credit report but they said they need 48 hours after I filled all the forms in. I am going to send that CCA letter though as I think that is probably my best course of action. If in the unlikely event they do manage to provide a substantial CCA should I just offer to pay £1 a month and send that to them each month as a token payment even if they refuse the offer and demand it in full? Are BC just a regular DCA? They can't send me to court or anything I presume? I can't imagine they'd take me to court if I was sending monthly payments even of £1 though.
  24. No this is the CCA letter I'm going to send tomorrow. I did send a letter and it did say "I am writing regarding my debt with my bank that you are currently representing." and " discuss repayment possibilities with you." This was before I did my research so I guess that is acknowledging the debt? It doesn't acknowledge the debt with BC in a way though I guess you could say since I said "with my bank" and not "with you" .
  25. Oh well, I should have checked here first before doing that I suppose. I'll still send the CCA request as I doubt they have it. This is the letter I'm sending: Dear Mr Carter, RE: Account ref # With reference to the above, I would be grateful if you would send me a copy of this credit agreement and a full breakdown of the account including any interest or charges applied. I understand that under the Consumer Credit Act 1974 [sections 77-79], I am entitled to receive a copy of any credit agreement and a statement of account on request. I enclose a payment of £1 which represents the fee payable under the Consumer Credit Act 1974. Note that these funds are not to be used for any other purpose. I understand a copy of any credit agreement along with a statement of account should be supplied within 12 working days. I understand that under the Consumer Credit Act 1974 creditors are unable to enforce an agreement if they fail to comply with the request for a copy of the agreement and statement of account under these sections of the Act. I look forward to hearing from you. Yours sincerely Name Not signing it and sending the £1 as a postal order and the whole lot recorded delivery. I shall do this tomorrow if I am able.
