  1. I don't have a copy of the original agreement all I have is a copy of the CCJ. Should I phone and ask for a copy of the original agreement - they must have one? What is a set aside a CCA or SAR? Sorry to sound so stupid but I've never come accross the terms before.
  2. Can anyone give any advice. I have a CCJ instalment order of £50 per month (since Sept 2010) which is paid by standing order each month - no payments have been missed. The amount is £9900. Yesterday I received a Notice of Transfer of Proceedings from the court. As I had no idea what this was for or about I phoned and they told me that the claimant was putting in a Charging Order. I haven't heard anything from Turnbull since setting up the CCJ instalment with them. When I phoned them to see what the problem was they advised that as the instalment was not enough i.e. they wouldn't get their money quick enough, they were applying for a charging order. They also then told me they were adding interest of £50 per month as well. This was also news to me as I thought that once the CCJ amount had been agreed then that was the amount to be paid back. I have no idea how to proceed with this so if anyone has any help pls let me know.

Hi - just had a read through of the charging order article and I notice that you say that if an "instalment order" is in place a "charging order" cannot be applied for - I've got a ccj with an "instalment order" which has not been defaulted on at all and have just been told they are now going for a "charging order" plus charging me interest which is more than the instalment! Have you any advice for me??
