The Banks solicitors put it into the defence, personally I think they have paid out on the bankrupt business account (which they settled on) by mistake (got the paper work mixed up perhaps) thinking it was the personal joint current account (which is at court at the moment), perhaps they still think that?
  3. Can anyone offer any advice on a court claim please. Bank of Scotland, court date set, court letter sent to us and it is saying have we sought permission from the previous bankruptcy people in order to make this claim. I am making the claim on behalf of my mother and stepfather (he was made business bankrupt one year ago). BofS have already settled on the actual business bankrupt account! and we are now claiming on a seperate personal joint account - what is going on?
  4. For anyone who is interested - Had a bit of a mishap over xmas, incurred £104 charges. Asked customer services for a refund and they offered to refund 2 of the 4 misdemenours, which I refused. Spoke to complaints dept, and explained I had already claimed successfully via court action recently, so would they refund these charges? They said start a new claim! So, I will! They certainly have not reduced there charges either, still £30 a pop, even though the credit card companies have reduced there's to £12. Is that what the Halifax means by "Giving you extra".
  5. FYI this lot have just sacked their previous legal representatives in favour of Eversheds. Q: I didn't exactly add much information on the court claim as others paid up purely on the basis on making a claim. But Eversheds have, and I quote: "The defendant refers the district judge to the contents of the particulars of the claim and the defense. The claimant has failed to particularise a cause of action or the alledged entitlement to damages as claimed. In the circumstances, the defendant invites the court to exercise it's power under cpr3.4(2) (a) and strike out the claim on the basis that the particulars of the claim discloses no reasonable ground for bringing the claim" The court says, District Judge Burgess, Maidstone, 6QZ71863 "Claimant do file and serve fully detailed claim explaining how the sum of £1204.03 is calculated by 15 December 2006" I have checked the forums guidance notes, but does anyone have a pre-used response that I could modify save creating a new one? I have a copy of GE Moneys own charges for the account to send aswell. thanks Lei.
  6. Thanks for the prompt reply Tom, I will send a letter to test the water. I'll post their response. If there's no response within a couple of weeks, you'll know I have had a visit from some shadey government officials and warned off!

Trust the government to be the worst offenders of all, treading on any small business they feel like, even putting them out of business to get there money or adding charges to peoples personal mortgages. Has anyone ever challenged their VAT late payment charges? they start at 5% of Entire VAT bill for that quarter and rise to 15% and stay at that rate for "months" and "months" for future misdemenours if they occur.   8. FYI all, Halifax made the call and offered to pay the full amount including interest and court fees, if I agreed to drop the case - payment received within five days. Assuming this arrives in my account when promised I will cancel the court action and make a donation to the site - many thanks. Lei.
  9. onto stage 3 with the halifax (waiting for a response to my refund demand), starting action against bank of scotland for another current account and a business current account and bank of scotland mortgage. I have a Q: Northern Rock/Co-op bank have just informed me by letter that from 1st Nov they will be making a charge to my credit card of £2 per month, have amended the %rate for cash advances and have "updated" i.e. changed for their benefit MY terms and conditions - none of which with my prior agreement!!! anyone know my status legally here or is it a case of "two fingers" to them and pay off the card/cancel?
  10. sent off the initial letter + £10 and received statements as requested BUT only for three years instead of six - After reviewing the initial letter there is no stipulation of six years, should it be changed ?
