    Hi Andy The date of the summons 16/11, I sent acknowledgment and checked on MCOL it was received on 5/12, I hope I have worked it out that I have until the 18/12 to submit a defence.

     

    Thank you both for your replies, I am probably really late with this, but due to illness, I am only sending the CPR off today.

     

    I am very aware that time is tight.

  2. Sorry been too poorly to reply or look into this, this agreement to pay 1.00 per month was in May, lasted for 5 months I could kick myself for not contacting them earlier, but I did forget about it, I have been looking at all the paperwork I hold on this account,

     

    I asked for a CCA request in 2011 from MBNA,

     

    1. I received copy of the executed agreement

    2. Up to date terms and conditions

    3. A copy of the most up to date agreement

     

    With this is 6 pages ( copy of agreement ) but no name, only address, I have been looking around this site and cant see if this is correct, could someone advise please.

     

    Should I also send a CCA request to Arrow Global now ?

     

    Can I state in my defence that the amount is in dispute, due to the outstanding charges I am claiming ?

     

    Getting really confused now any help gratefully received.

  3. Help need please, just need to know if I am doing the right thing here.

     

    Claim received on 16 Nov, sent acknowledge and has been rec on 5 Dec.

     

    Particulars of Claim:

     

    The Claimants claim said amount, being monies due from the defendant to the Claimant under the regulated agreement betwenn the defendant and MBNA and assigned to the Claimant ( Arrow Global) Notice if assignment has been provided to the Defendant, the defendant has failed to make payment in accordance with the terms of the agreement and a default notice has been served,and the Claimant claims the sum of 4..... together with costs of this claim.

     

    I am going to send a CCA request to Arrow global, and a letter claiming refund of charges,

     

    and a CPR31 request to Blake Lapthorn

    I have heard nothing from BL before this,should I have received a letter ?

     

    Is this worth doing or shall I just agree and ask for time to pay ?

     

    Any advice gratefully received

  4. Hi I will try to give more detail, the amount I have been trying to claim is quite small in comparison to the debt approx 350.00 including interest, but it would help to get this down a bit.

    Dept originally with MBNA was sold to Arrow Global in Jan 2012, came to an agreement with Drydensfairfax for payment of 1.00 per month due to unemployment, I sent first letter requesting refund of charges in April and had a response at the end of May, standard letter saying no. I also received a letter dated the same date from Drydensfairfax, ( as I sent letter disputing the amount claimed and copy letter of charges reclaiming) stating that they have heard from their client who advises that they have not received any query from MBNA regarding outstanding balance. they did ask for copies of correspondence with MBNA.

     

    Unfortunately due to other issues going on in my life I did not follow this up, I know I should have.

     

    The solicitor is Blake Lapthorn, I dont have PPI on this account, I will check my credit file

    I have received a county court claim from Arrow Global,

     

    this is a debt from MBNA/Virgin,

     

    I have sent acknowledgment of service,

    giving me extra time to file my defence,

     

    stating I dispute all the claim,

     

    its for 4100.00 plus costs of 80.00,

     

    I have sent letters months ago requesting refund of charges which MBNA are refusing,

     

    I need help please going forward,

     

    should i send a CPR request to Blake Lapthorne, a

     

    nd send another letter to MBNA/Virgin asking for refund of charges.

     

    any help gratefully received.

  6. Hi, My husband has been signed off work with stress for 6 wks now and only has 2 wks left of company sick pay, before it drops to half pay, which to be honest we cant afford. He had postponed the grievance and disiplinary for a few weeks, but as we want to get on with our life now, thought he would instigate getting his grievance heard, well what a waste of time that was, they really weren't interested, it seems obvious that they dont want him there anymore, he was told at the grievance that the disciplinary will still be going ahead, although they havn't had an investigation yet!

    I am talking about a large company, with a rubbish HR dept.

Hi, My husband has the grievance, and disciplinary hearing, this is all very confusing anyway, but as the grievance is about the manager, can the manager then chair the disciplinary hearing, the outcome would already have been decided by him! Yes I do mean constructive dismissal , my husband is about to resign, as he feels is cannot work there anymore. Sorry I cant go into all the details on here for obvious reasons... what do you mean by wait for the employer to do the dirty work!

Hi, Thanks for your reply, we already have the policy and procedures of both, we have also looked at the Acas site, nothing has been done in accordance with their own, which is also in accordance with the Acas code of practice. Hubby has also been of with stress with all this, for a few weeks, but want to see an end to this, so went back to work just for the grievance hearing, but dont know what to do now. as we think they are trying to get him out.

Hope someone can give some advice, my husband is going though a bad time at work, started with huge workload, now being bullied by his manager, all of which led to a disciplinary hearing, without anyone hearing my husband side of the story, the first disciplinary was heard by the manager in question, with no investigation held, my husband dealt with this ok, he has now put in a grievance against said person, this has also now been heard, all a complete mess. My first question is should a disciplinary be heard by the person who is bringing the disciplinary hearing, as I thought it should be an independant person, also no investigation has been held. Also they have not acted in accordance with thier own policies and produres, My grievance has now been heard, although it clear that they were not listening to anything I had to say, another disciplinary is going ahead with the same said person chairing it. I am thinking this is a c/dismissal case. We are going to seek legal advice with this, but wondering if anyone had some views on this.

Ok will send CCA and start reclaiming charges, small problem with the overdraught, in that we do have an overdraught, hubby's salary gets paid into HSBC, only just covers the overdraught every month, should I still cancel it, and change hubby's salary into new account, CC is in my name, HSBC bank account is joint, will this make a difference?

  11. I dont have PPI, but I do have a few charges, late payment, overlimit charges, I will start the claim to get these back, as we still bank with HSBC i have been putting this off, I have now opened another account diff bank.

     

    I have not heard from Metropoliton, only from DG, I have given up speaking on the phone to anyone, everything in writing.

Hi, I have an outstanding credit card debt with HSBC, they have ignored all my previous letters to them offering a payment plan, they are the only ones, anyway way I have received a letter this morning from DG Solicitors saying to avoid legal action I must pay in full within 14 days, (if I could do this I would have done a long time agao) I understand this is from HSBC in house debt collector, any advise what I should do now, ie what letter do I send, if any, has anyone had any dealing with DG Solicitors ? thanks to anyone who who replies.
