    cheers lula Unfortunately although the figure that Im owed is£1500 it still leaves me about £1000 short. But it is good that I now feel confident, when dealing with all the various financial institutions, thanx to this brilliant site and all the support available on here. My way of thinking at the moment is to tell them that my actual overdraft ammount is in dispute due to their unlawful charges and will make an acceptable (affordable) offer when they pay up be before or after court. P.S. do you think that they would send me the cheque instead of taking it of my overdraft!!!!! (me thinx not!!)

    hello all

    Hello everyone Been a while since I posted basically I am at the stage of waiting for payday at the end of the month so I can file claims against shabby and crapital one. This will be swiftly followed by barclays, citi and mbna (cant wait). In the meantime abbey have informed me that my overdaft facility has now been withdrawn as of october no real suprise there! The problem I have is that although my charge refund will reduce my overdraft it will not clear it which is what they obviously will want. I have already come to an arrangement with my other creditors which is pro rata based on what I can affored from my income, and there really is not anyother money left to pay this. Does anybody know whay abbeys next move is likely to be with regards to this?
  3. got this back today Thank you for writing back to me about my final offer to refund fees weve added. Im sorry to hear that you feel my offer is unacceptable. As I alredy explained we are confident our fees are both fair and legal and Im disappointed to hear youre considering court action.Were still working withthe the OFT to resolve the issues theyve brought up.They havent told us that we are obliged to refund any fees, and weve offered refunds as a gesture of goodwill. This offer is open to you, however I wont be incresing this, as it is my final offer.Ive included another settlement form for you to sign and return if you decide you want to accept this. Financial regulations require me to advise you that this is my final response in relation to this matter. However, you now have the option to contact the Financial Ombudsman Service within six months fron the the date of this letter. I suppose the next step is to make court claim?? Will have to wait till pay day (3 weeks away) grrr! Any other advice or comments would be much appreciated Thanx

  5. that is DISGRACEFUL you have my sympathy with that one UNBELIEVEABLE! Had a phone call yesterday made an offer in line with what I could afford they refused made me an offer that I had to refuse, I suggested that they took me to court. Today I recieve a letter saying that they are sending someone round (i'll buy a cake!) dont know why they bother though cos untill they take me to court they aint getting a penny above what I'm offering. When arethese firms going to wise up that people are becomming more and more savvy to their bullying tactics and are not going to just buckle when they make these threats.
  6. hi everyone Posted a letter to mr Robert Udy about a fortnight ago asking for all my charges dating back to 1999 to be returned as they are unlawful under common law etc. Got a reply back today, the standard goodwill gesture where they take OFT ruling to mean that £12 is fair and reduce my charges to take that into consideration thereby offering £227. Sent a letter back stating that OFT did not say that was a fair charge, only that, that was a maximum charge that would probably include manual intervention etc not the automated type of charging that has been occuring on my account. Therefore whilst accepting any of my money back would now demand that all my charges be re-imbursed before the end of the month or I will make a claim in the County Court. Hopefully as that kind Mr Udy would say "Put this experience behind us"
  7. you can just tell by the tone of the letter the type of company that you are dealing with cant you! I guess that i will just have to fob them of with a few small payments for a couple of months until abbey pay me the thousands unlawfully taken from my account. I LOVE THIS SITE THANX AGAIN ALL OF YOU!!

  9. hi everyone just received a rather aggressive demand for £109 for payment of my sky (one of the many bounced direct debits at abbey due to charges). the stark options seem to apparently be. 1. instruct debt investigations (uk) limited to investigate your personal circumstances and assetts. 2.instruct solicitors to take legal proceedings againts you. 3.instruct our local collection agent to make a personal visit to your home address to collect the outstanding balance due. anyone out there that has had dealings with these very pleasant sounding individuals that can offer advice? Trying very hard to sort out my finances at the moment,made sensible offers in line with budget etc but this one seems to have slipped the net and i really havent got any spare money left at the moment. Any suggestions as to how to proceed with this one would be gratefully appreciated thanks:confused:

    hi everyone intend to recover money from mbna very soon. My question is this I also wish to claim from sony card as well but mbna took this card /firm over a few years ago do I have to do these two claims seperately? Also are they both addressed to mbna?

    step account approved today.!!!!!! abbey claim to start on monday !! plus capital one, mbna, sony, barclay et al!! The good thing about all of this is the way it lifts your confidece, the money is almost secondary its the uplifting feeling of being able to fight back that is sooooo gooood

    cheers baracad have just done so and been accepted provisionally hope its successful as I cant wait to get started on my claim as I believe that I am owed thousands. Mind you I still find it very hard to accept that abbey can help themselves to my wifes account that in her name alone even though itis in the same bank!!

Help appreciated as I do not want to proceed with my claim untill I am sure that the remainder or our funds are safe. thanx in anticipation chuff1

    thanxs for that my wifes account is in her name and totally seperate from our joint account. Just thought that it may be easier to use this account as I suspect that I may have problems opening another current account with my current credit problems. P.S. I will happily donate to the site as soon as things start to improve. p.p.s. Will try not to be libellous isnt easy is it!?
  16. At the moment we are being screwed by abbey with regards to charges. Does anyone know if they can touch my wifes account if we were to transfer our wages etc direct into that account, thereby stopping them ( edit ) taking your money every month? The account is a current account with abbey, the one we used to use before the bank (edit ) for our savings. Cheers guys think site is brill and when funds allow will be pursuing abbey with ruthless energy!!! chuff1
