  1. Letter received yesterday stating that although they don't accept any monies due blah, blah, blah they are settling the claim in full. God only knows why it will take them up to 14 working days to send the cheque though???

  3. Received letter from Halifax yesterday stating they don't accept that any monies are due and they will defend any claim. Claim for £2,647.00 plus £516.42 for interest and £120.00 costs issued today.
  4. Received Acknowledgement of Service stating that Cap One intend to defend all of the claim.
  5. Response received dated 20th November 2006 stating that not only can they not provide a breakdown of their actual costs incurred due to the fact that it's "commercially sensitive" but they are also claiming that the OFT ruling does not apply to them as it was "related to charges applied to credit cards and not bank accounts". Despite this the kind souls have offered me the princely sum of £562 being six months worth of charges applied to my account as long as I accept it in full & final settlement. To be honest I can't even be bothered saying that I'll accept it only as partial payment, I'm just going to issue the Letter Before Action as I don't need the money at the moment and I want the interest on the charges back from them as well. I guess I'll be issuing another CCS in 14 days time!
  6. Request for repayment of charges sent to Halifax 10th November, response dated 15th November received yesterday stating it will take approximately 4 weeks for them to respond to my query and enclosing a nice leaflet which had little or no relevance to what's going on.
  7. For one reason or another I've only just gotten around to issuing the CCS but it's done now so I guess I'll just have to wait and see what happens.
  8. It turns out that I did request it (I must have been having a young & naive moment). They have stopped taking the PPI from my account now.
  9. I got home last night to a letter from Mr Udy again offering partial settlement so it looks as though the MCOL claim will be issued on Monday. Oh well, if they want to pay an extra £200+ in interest plus my costs then that's up to them!
  10. Well, Capital One have until tomorrow to give me a full refund otherwise it's a claim through MCOL. I'm a bit pee'd off as I was hoping that I wouldn't have to mess around with a claim but I won't let that put me off. I'm away on Friday so they have until Monday before I can issue (I won't be telling them that though!) Best of luck to everyone else claiming their money back.
  11. Well it turned out that Royal Mail lost the SAR letter (even though it was sent by Recorded Delivery!) so I had to resend it on 2nd October. Thanks Royal Mail, you've cost me 3 weeks!
  12. I guess it makes sense but I'm not actually sure of what interest rate I'm being charged by Cap One. I'm not sure if it would be better to send the LBA today with statutory interest or wait and send it with contractual interest. Any ideas?
  13. I have stated that I'll be claiming the interest back and that it was already over £200, although this was statutory interest. What rate would contractual interest be as I won't be sending the LBA until 4pm today anyway?
  14. I arrived home last night to a letter from Cap One offering £374 in full & final settlement, however no cheque was enclosed just a form that I needed to sign accepting the offer which would be followed by a cheque. My LBA is due to be issued today so I'll just modify it slightly to say thanks but no thanks.
