  1. apologies, its been a while. All my statements have arrived from Abbey by me requesting them online. I had already sent the £10 cheque so they cashed that and complied with my request for all data on the account. The actually didn't need to do this as I had all the statements, but ce la vie, at least they complied. been hectic with work, selling house etc so plan on sitting down and getting to the next stage with Abbey, AMEX and Capital One. Abbey is by far the biggest for me to claim but Capital One makes me really angry - a card with £200 limit has charged £698 in 3 years!! NO WONDER i never get the thing paid off! anyway, will post more info when I get the next stage done. Iriahm x
  2. Am in shock! last night on my door mat were 4 Abbey statements that I requested. this is half of them, and hope that the rest are here tonight. Hopefully this is a sign of things to come and that they are slowly realising that they are in the wrong.
  3. an update; so far Abbey (Pam Speed) have written to respond to my online attempt to get my missing statements. They said that because they were so old they weren't able to issue them without charging me £5 or £10 cheque for multiple. doh, like i didn't know this and why couldn't they take it from my account? because their charges mean i have money til pay day on the 20th of next month! This is promising as they haven't sent me the microfiche argument....yet! So far they have ignored my other letters. They had a gentle reminder that their 40 days is up and ignored that so they are getting my LBA tonight with the charges I know about. everyone else: mostly ignoring me so its an LBA night tonight!!!

Hi Yasmin, just wanted to say that i'm going to be watching your case/thread with anticipation as I have just started a similar case to get default removed and claim charges back from (scrambled) Egg. I am at the early stages but your thread is inspirational - keep up the good work, not long to go now!

  6. Hi, i'm already working through claiming charges back from Abbey and a few other institutions but wanted to find out about RBS. I closed an current account in 2003 and recently visited a branch near where I work to get old statements as I know that there were a lot of charges that I would like to get back. I was told that there would be a fee and they would have to look into it. Lady called me back within 24 hours to say it was impossible as account has been closed for so long. I think i know the account number but they claimed that they couldn't find me on the systems.... Is this true? or should I write the initial letter asking for statements under data protection act? so far all but 2 of the companies i'm claiming from have replied to this letter so i'm getting used to being ignored!! thanks for any help....
  7. Update: Abbey - no response - funny that!? online request for missing statements 20/08/06 Capital One - no response Halifax - immediate response - free! Prelim letter sent 18/08/06 AMEX - immediate response - free! Prelim letter sent 18/06/06 Acknowledgement received 22 August - "we'll look into this" Next Directory - no response Egg- quick response - sent £10 for data enquiry 17/08/06 Ikano - no response Legal and Trade - quick response - free! No charges to claim. Logic Group - no response. GE Capital - no response. should I write to all non responders giving them a further week to send me the information i've requested or go straight to LBA? grateful for any advice
  8. thanks Karnevil. All non-responders have until I get home from work on Monday to respond. next letter will be ready to go into the last post at 7pm on Monday night! So far with 50% of my bank statements I've been charged £860. On one hand this is great to pursue, but on the other I live in Scotland so considering just splitting the case (£280 on one account in total and the rest on my other current account that i'm missing statements from) and going for the £750 limit. boyfriend received a phone call from (sh)Abbey this morning and i'm RAGING! I already have my mortgage with them and we are trying to port my mortgage into a larger one to buy a bigger home. All seemed simple enough (but I always pinch myself back to reality when dealing with (sh)Abbey). Phone call was to talk to me as there was a problem with my details. The mortgage advisor then goes onto detail EXACTLY what the problems were to my boyfriend. He knows all about financial situation and that i'm trying to sort everything out/get defaults removed etc etc but (sh)Abbey had no right to discuss my credit history with him. grrrr. When I have settled all the charges i'm claiming back I will donate to this site because i've found it so useful - already got some friends looking into doing the same.........

GE Capital - no response. The 40 days is up for this lot who haven't responded to me on Monday 21st August 2006 so let the games begin! Today I sent the prelim letter (copied from here, thanks!) to Halifax (£160) and AMEX (£75.00). That gives them until 1 September 2006. I calculate that most of the money i have ever paid to Capital One is charges. Somehow when I was at uni a £50 balance turned into over £500...head in the sand back then but it was scary! statement was charge after charge and they still want me as a customer - i bet they do!!! i make them a fortune! thanks and I will keep you up to date with Abbey as I do get the impression from reading other folks threads that they are prepared to play hard ball.... thanks, Ixxx

I read on the front page of this website on the left hand column the following RE defaults: If someone owed you money and didn't pay you, could you go and put a default entry in the credit register? No of course you couldn't. You would need a court judgment to do it. So, my question is..... I have 3 defaults registered against me although I have continued to pay the creditors etc and have good diaglogue with them. I never stopped paying them although i had a payment plan with them. Is there any way that I can get these defaults removed as there was no court judgement against me? grateful for any advice, cheers!
  11. Hi, just wanted to introduce myself and say Hi! I'm a MSE addict and was advised to come over here and find out more. On 14 July I posted of my letters to creditors for a data request. Abbey are by far and above my biggest claim but due to head being firmly in the sand I didn't keep many bank statements. I have some so can claim for something if they start playing games with the data request. I have heard back from most of my other creditors - AMEX replied with statements for free within 48 hours! its only worth £90 in charges but its £90 i'd rather have in my pocket! i'll be keeping an eye on others claims so keep up the good work and hope to get as much out of them as I can for all the times i've been standing in the branch in tears as I can't pay for anything, the staff keep telling me its all my own fault and that they can only refund 1 charge every 6 months for "good customer service" pah! good luck everyone!
