Update: I just come out of hospital yesterday, my carer called the DWP and they advised they have not received the file back from ATOS yet once it's back a decision make will look at it and come to a decision. Also were advised there is currently a backlog so will be a few week. Called ATOS and typical of them they were rude and said well it says on the letter doesn't it. If you want more info call DWP

Awe Thanks Leemac. Iv'e hardly slept all night and I just want to get this off my head. Guess the bank holiday aint going to help me much. I'm just anxious that when I call on tuesday that either they advise me that im no longer in the support group and have been placed in the WRAG group. Which would have serious impact on me or they will say we have not got anything on our notes yet which in that way would impact me because of the stress of not knowing and having to wait which will do me no good

It is very strange thought 1st to put you through so much stress thinking your going to have to attend a medical then cancelling it saying it is no longer required. I spoke the Old GP the one I named on the ESA50 he advised that he didnt not send anything and also even if the dwp did contact us, we would not be able to give any information as we no longer have your records as I am no longer their patient. My new GP which I just registered with after sending the ESA50 have also not sent anything so that is why i am so confused and anxious. I feel realy suicidal right now think I am about to go crazy and the worst thing is I can't speak to DWP till tuesday thankz to the bank holiday.

Also what the strange thing is that with the questionnaire the only thing i sent was copies of discharge forms for overdose admissions. They have not contacted my GP and I have also changed my GP which I advised DWP of. Looking at the timescale between sending the ESA50 and receiving the appointment it seems highly unlikely they would have been able to get anything from the GP and this letter has just come after 4 days of receivng the above letter.

It is no longer necessary for you to attend an examination at present. Your file has been returned to your local security office. We are sorry for any inconvenience this may have caused. I recently completed an ESA50 which I sent back a few weeks ago. I received a letter begining of this week to say that I would have to attend a Medical on the 13th June. Iv'e been very distressed because of this. Strangely I have received a letter today to say that my medical has been cancelled and file returned back to the DWP. Could any of you helpful people on here advise me of what this means. Does this mean my benefit will stop or did I complete the ESA50 incorrectly. I've been in the support group for the past year after winning my appeal at tribunal. This whole re-assesment thing has already started to impact my health.

Just got out of the hospital today morning spent the last 2 nights there guess I lost my head this all has got to me. Still feeling low. I have got an appointment luckily tomorrow with the MP well that what my friend has done for me. Can a MP be of any help to have DWP revise their decision Obviously having the MP go through the case history and evidence.!!

Fnx for your kind messages. My welfare advisor submitted my DLA application. I still have barely recovered from a long ESA appeal I just don't want to go through another traumatizing proccess like that and knowing about DLA appeal it could take upto a year. The worst thing today is my friend who cares for me has had family pass away today so i'm all by myself today with all these thoughts going through my head don't know what is what anymore.

Any Advice Guys I honestly am feeling so suicidal right now

Maybe somebody out hear can help, recently applied for DLA and it has been refused due to an ESA ATOS report from january 2010. I won my appeal for ESA in september 2010. Now my question is why have DLA refused me because of the report yet I sent a decision notice with my claim pack to say that I won my appeal and the ATOS report is incorrect. I have asked for a reconsideration what is the likelyhood that the decision would be changed by submitting a copy of the tribunal decision?? I submitted loads of evidence when i sent the claim pack, I submitted a doctors letter, a private doctor report which were used for esa appeal, discharge forms from hospital for overdosing suicidal attempts, 2 being very recent twice last month. SHould I drop the claim as I dont think I would be able to bare another appeal process which takes months to even get a hearing date.

Hi Zamzara, I have done exactly that and guess what after 4 days of arguing with the DWP today finally they gave in and put me in the support group after a angry call from one of the clerks at the tribunals service. Im so glad finally this nightmare is over thankyou very much for leaving a comment on this post. Wish me luck now to recovery lol

Hi Honeybee, Thanks for your comment I spoke to the contact centre about 3 times today and finally spoke to a decision maker or the appeal section and they advised me the same that we are looking at the decision as we speak and you are in the correct group which is work related. Its hard to understand if they are not disputing the tribunal decision and the tribunal have said that i have met the criteria for support group and therefore the decision they made is to put me in the support group why are DWP so annoying. Why can't they do their job right for once. If we made a simple mistake they would either prosecute or sanction benefit.

Well you will be surprised called DWP and were advised i've been put in the work related group and this is according to the decision. So I called my representative to confirm and he advised no the decision on the tribunal clearly states support group so I called the tribunal and luckily spoke to a judge who advised that the last paragraph does mean I should be in the support group. Im surprised at the fact that these schedules are made by the DWP so how could they be so incompetent not to know exactly which group I should be in. The DWP have asked me to ask the tribunal to forward them a letter signed by the judge saying I should be in the support group and highlight reasons and the decision will be ammended accordingly. Im quite upset and angry at the fact if they are saying they have gone by the decision of the tribunal and numerous body say exactly the same that I should be according to the last paragraph schedule 3 descriptor 10 (b) then why is it that the DWP are not doing the job right and putting people like me through another ordeal as the appeal wasn't enough to stress me out.

I have won my appeal but am unsure which group I shall be put into this is what the decision notice says. The Appeal Is Allowed. The Decision Of The Secetary Of State Issued On 12/01/2010 Is Set Aside. The Tribunal Considers Descriptor 16 (b) Intiating and Sustaining Personal Action Is Appropriate And So 15 Points Are Awarded. This Will Passport Mr (My Name) To Schedule 3 Descriptor 10 (b). What group will I be put into I read up and schedule 3 descriptors mean limited capabiliy for work related activity. Wanted to confirm with people who have knowledge on hear.
