  2. Hi everyone I upgraded over the phone 7 days ago with Three to a new 2 year contract on iPhone 5. First phone I received was faulty in that the battery wouldn't hold charge longer than a few hours. Three sent another phone out. This one is defective in that the power button is permanently depressed on the right side of the button (like it has slipped down into the plastic) making it difficult to turn the phone on and off. After many hours on the phone to Three's terrible customer service I have decided I want to cancel my contract. I notified them of the power button defect within 24 hours. Can someone clarify what my rights are? I don't want to stay with Three and I dont want another 'replacement' (probably defective) phone. I want to cancel, receive my PAC code and move to someone else. After informing them I want to cancel a supervisor has informed me of a number of things (none of which are particularly coherent): 1. The issue with the phone is an Apple issue, not a 3 issue 2. I should have informed them of the power button defect more quickly than I did and not used the phone (I informed them within 24 hours of receiving the faulty phone) 3. They are claiming that I am not allowed to cancel my contract or receive a PAC code Can someone confirm to me what my rights are - and specifically if I am within my rights to cancel my contract?   3. Hi all I was absolutely shell shocked to arrive home today to a letter from Marston Bailiffs demanding £515 as the result of a 'Magistrate's court order' in connection with a fine. The client is HMCS Lancashire and there is a reference number. I have received absolutely nothing regarding this before - this is the first I have heard of this and I don't even know what the fine pertains to. Can anybody help? What should be my first port of call - do I try and contact the court or Marstons? Who are HMCS? Quite a fright to be honest, have never had anything like this before. Any help would be much appreciated.

Just out of interest (and probably my last question because a lot of my questions seem to have been covered elsewhere!) but does the fact that I wasn't the driver (and I definitely wasn't) make any difference also?   5. Hi I never knew that! So even if everything was correct and all the PCN details were correct, they still have no legal authority to enforce parking? If they did take one to small claims court (hypothetically where they had proof someone was parked in contravention to their 'codes') would they likely lose? Just out of a matter of interest would this be the same for say a privately operated NCP car park and would your advice to ignore a PCN issued by them be the same? Thanks!
  6. Hi crem Thanks for your reply. Forgive my ignorance but why is the fact they're a private firm any different and how come I can ignore them? I think they're a private firm, they're called Excel Parking and the NTO starts with "A PCN was issued to Vehicle registration xxxxxx which remains unpaid for allegedly breaching the car park terms and conditions in the Privately operated car park at xxxx street". They are threatening court proceedings and acruing costs so am obviously a bit worried! Thanks again for your help
  7. Hi It's not a council PCN but a private firm actually. So does that mean that legally I still do have the right of appeal? Thanks!
  8. Hi there, I received a PCN attached to my vehicle that had the incorrect vehicle registration number on it. I therefore assumed that it would be rendered void and thus I didn't bother appealing it. However today I received a NTO in the post that actually shows my vehicle registration number (not the same as was on the PCN) demanding that I pay up. Crucially, the letter states that I have lost my right to appeal because I should have appealed within 14 days. I didn't appeal because I didn't think it was my vehicle as it had the wrong VRN on it! Is this correct and do I have no recourse to appeal? Furthermore, is it legal for them to change the VRN they recorded on the PCN to my vehicle's (obviously they must have looked at the photos, realised their mistake and amended the PCN to find my address)? Thanks for any help! Matt
