  2. The payment has been made by direct debit to the National Westminster Bank so I doubt it has gone astray, however your other comments are very interesting and I thankyou for that. The more I think about this the more I think they are chancing their arm and will rely on the fear factor which I am lucky enough not to be affected by.
  3. Well that's the best news I have had all day, I can deal with a balance of £10-15k which is what it would be without the added interest! Thankyou:)
  4. As far as am aware the interest would have been frozen on judgement so must be statutory. I have done the calculation of 8% compounded interest over the period n question and after deduction the payments made it comes out at around £65k so that would also suggest it's statutory. I guess I'll now wait for them to contact me and I'll make them an offer in F&FS which hopefully they'll consider bearing in mind how much they have been paid so far via the CCJ. Incidentally I have a superb credit score and have never had problems with mortgages or loans etc. It amazes me that after 18 years they can hold out their hands, I always thought there was a 12 year cut-off, for business there is no obligation to hold documents for more than 6 years except if tax related so I would have honestly thought that the debt would have been written off by now.
  5. Yes, I wrote to the court and suggested a payment level of £10 per month which was accepted and a CCJ issued on that basis. However I no longer have those documents and I would suspect that neither the court or the bank would retain copies after this length of time
  6. In the early nineties I ran a business (sole trader) which suffered bad debts during the recession we had then, to cut a long story short I ended up owing the bank a sum of money (17k approx). IThe bank refused to negotiate with me and eventuallythere was a court case. I wrote to the court and had a payment of £10.00 per month accepted, and a CCJ was issued which has been paid by direct debit ever since. I have not had any contact with them since those early days. Whilst all that was going on I took out an IVA which unfortunately failed a year later with the adminstrator contacted all parties concerned to advise he was not going to take any action. Since that time all related debts were either written off or I entered into an agreement and they were eventually paid. Recently I have been traced and advised that this bank is now asking for settlement of the 'account' which I am told is sitting at around £64k, Can anyone advise my position as I have always thought that if I maintained the monthly payment it would just run on and on, I certainly don't have £64K to give them!
