  1. Hi, I filed my claim late last year at Bow County Court, I had no reply from my bank(The Royal Bank of Scotland, Camden Town Branch) so I asked the court for Judgement, still no reply. I then paid my fee for a Warrant of Execution and have just been informed by the bailiff that they have seized goods i.e. four computers, one fax machine and a cash register including cash (sum undisclosed). I am told that if the sale of the goods including any cash seized does not meet my claim amount I am liable for the shortfall. If this turns out to be the case, is that it as far as my claim is concerned or can I go back to the court and claim again for the remainder. Seeing that the bank is more than capable of paying and have obviously refused to do so, allowing the bailiff take goods to the value instead. Yours Disgusted. here is my timetable of the process; I have had no response from the RBoS since I started. S.A.R - (Subject Access Request) for 2 accounts on 09/06/06 Phoned Bank on 01/08 & 02/08 LBA 06/08/06 Information Commissioners Office complaint upheld 08/12/06- contravention of the sixth data protection principle. N1 claim Bow County Court 30/10/06. Request for judgement followed bank ordered to pay by 10/12/06. Ask for Execution of Warrant 28/12/06. Bailiff EX77-interim Return on a Warrant of EXECUTION 10/01/07, quote 'The bailiff has levied on goods belonging to the debtor. The bailiff will remove and sell the goods if the debtor does not pay. If the proceeds of the sale do not cover the costs of removal & sale you are liable for the shortfall. The bailiff has levied on 4 computers, 2 fax machines,cash register & contents'.

  3. Thanks for you reply. Yes I did send the SAR and the Letter Before Action by recorded post, I have printed off the proof of delivery for both from the Royal Mail website.
  4. No reply from S.A.R - (Subject Access Request), phoned the bank and was told that they did not know anything about my letter. I explained that it was sent recorded delivery along with a check and that I had proof of delivery, I said I would call back next day. Follow up call, basically I was advised to send copies of the original SAR and that they would look into it straight away. My reply was that they had recieved the letter and the fee which were both missing and that it I was not satisfied with their response. I sent a Letter Before Action with copies of the SAR again recorded. I have confirmed delivery and still have had no reply. My undersanding is that I now go to court. Please advise. P.S.   5. I wrote to the RBS a Subject Access Request, enclosed cheque and sent recorded delivery (my branch, should it have gone to the HQ?) on July 6th, 40 days came and went with no reply. I phoned my branch and enquired as to why they had not replied. I was then Informed that they had no knowledge of my letter. I then sent copies of the original letters (two accounts) and a Letter Before Action, again recorded delivery on August 6th. I have proof of delivery for both letters, Still no reply. I understand that my next move is to send a letter of Non-Compliance N1, is that correct? I am concerned that I should have sent the letters to the Bank Head Office, can anyone clarify this for me please.
  6. I was recommended to this site by one of my work colleagues and as a result I have started my own claim against the RBS. True to form 40 days have passed with no reply. I followed the instructions sent payment with your template and recorded the delivery and am now about to go to the next step. I would not be able to do any of this without the information available at this site. I will keep you posted.
