  1. please can a mod merge this with the other thread again and delete this one.... I meant sue MBNA they defaulted me illegally because they sent a default notice which said I had to pay £90 by a certain date I paid more than that (over 500 which I believed was the all that I owed)... they defaulted me anyway before the expiration of the default notice the FOS agrees that this was unlawful they also sent the FOS copies of letters which they claim they sent before the DN which 1) the did not actually send 2) the FOS agree does not constitute legal DNs anayway

I have spent over 60 hours dealing with this I work as a contractor so it is very easy to place a value on my time (£550 per 8 hours) I tried to change gas and electricity supplier and because of the default on my file I had to pay a deposit this embarresed me obviously if they can charge £25 for a slightly delayed payment then why should I not be able to get paid for wasted time. for illegal defaults against me. for harassment etc etc

MBNA defaulted me illegally and sold my debt illegally FOS agrees with that MBNA have lied to the FOS and it is easily provable FOS had not finished considering my response to their findings and MBNA issued me a new default notice (I believe I have paid the debt in full). and MBNA have begun harassing me again I can afford a lawyer... as a matter of principle I cannot let them get away with this... I want to take them to court please tell me what I need to do many many thanks

  5. right then... so I complained to the FOS. they agreed MBNA had sold the debt unlawfully and that they had defaulted me unlawfully MBNA provided information to the FOS which was clearly not true. and the FOS agrees with that MBNA has been instructed to remove the defaults which they have now done (but were on my file for nearly a year) I was offered only £150 as compensation The FOS did not consider my complaint in full: -- they did not consider my complaint that I still had not recieved the DP or consumer credit info I had paid for -- they did consider fully my argument that the charges (10×25 over 6 months) were unreasonable (and only 3 default sum notices received) Whilst FOS was considering my response to their findings MBNA issued me with a new default notice and began harrasing me again. So what do I do now? MBNA are clearly playing a devious spiteful game. I have suffered a year of stress and anxiety over this yet I am offered only £150. In addition my statutory rights have not been fulfilled. I have spent over 60 hours dealing with this. yet I pay my last two (of 60) instalments 6 months late and it appears reasonable for them to charge me £250 I want to take these people to court for damages. How do I do that?

I paid them the money and they did this Also I sent them the cheque on 12th April which they held on to and then issued a DN two days later they cashed the cheque and defaulted the loan and recorded this against my credit file I complied with the DN and they still did this I am seriously considering sueing them I have started work now and can afford a lawyer I want to make it rain on them because this is just unbelievable and causing me much stress

  9. yes I have received that letter I also note that both MBNA and Arrow head have seperately registered a default against my credit file How on earth can they do that? I have no relationship or contract with Arrowhead gosh this is making my blood boil how do I get them to remove this?

    Jacob vs MBNA

    It appears I am another victim of these people. I am saddened to see so many other people in a similiar situation. I have had loans with MBNA for 15 years. Each time a loan was about to be paid off they offered me a new loan. The last loan was taken out 5 years ago. I paid 58 out of the 60 payments. Unfortunately, I lost my job last year and was unable to pay my last 2 payments. I sent them this letter dated 21 December 2009 They demanded that I pay £18 a month which at the time I could not afford. At the beginning of this year I got a new job and informed them of this and that I would shortly be able to pay the full amount. They then bombarded me with threatening telephone calls. On the first Saturday after starting my new job they called me 5 times before 9am. I then wrote them this letter: date 12th April: I did not hear from them until they sent me a default notice dated 7 may 2010 On the 17th May they cashed my cheque which as my letter clearly indicates is for full and final settlement and is in any case more than the £90 they are demanding. they also sent me the following letter so even though they cashed the cheque which was for more than the 90 and by the 25th they defaulted my account?!?!?! I sent them the following letter on the 29 May: I have not heard anything back from them I have now received a letter from Drydens lawyers acted for Arrow global saying I still owe £273.77 and that my debt was sold on 14 May 2010 I am obviously extremely angry and upset about this. What do I do next? Who do I complain to? Do I need to get a lawyer to act for me now? all help would be much appreciated many thanks
