  1. Hi. I recently recieved a court order from local county court regarding a 'Return of goods following termination'. The hearings December 10 but im slightly confused by what to do next. I got a Ford Focus on HP through Blackhorse Finance (£200dep,£236 per month over 48 motnhs. in May 2009, made regular payments, but at some point around november time i had issues with Direct debits out of my Lloyds TSB Bank account (Blackhorse = Lloyds) and for months in a row charging me over £200 a month in bank charges alone. At Point just after this i was struggling to afford the repayments as the £200 for the car repayments were being taken in bank charges therefore i missed a couple of months until the point they finally told me they could send me a payment book that i could pay cash in at local lloyds bank, so i started that. My last payment was in April 2009, which was also the point where due to having two babies on the way i moved out and moved into my own home with my partner, and therefore was struggling to make repayments since then, as rent and bills added up in my ougoings, all i recieved were letters syaing i revieced a £20 collection activity fee every month apart from one visit from Anglia on 1 June asking for the car back there was nothing else. Recently days before i recieved the court order i did recieve a notice of termination. This INCORRECTLY stated i had paid more than a third of the payments and that they would have to go for a court order in order to reclaim the vehicle. However i know that i have not made a third of the payments, so is this a technicality i could use to my advantage?? In addition to that, i am currently moving back away from my partner so would be able to make increased monthly payments of £300 per month (£300*36 = £10800) over 36 months and that would pay off the arrears outstanding in a period of time similar that the original agreement finished. Advice on my next step pleasE??? greatfully appreciated
  2. Hi There. I need some advice on a situation regarding Lloyds TSB and Blackhorse Finance (Part of Lloyds Banking Group). To Cut a long story short, I took out a car on HP Finance a year ago, with the direct debit instuction to come out of my Lloyds TSB Bank account. In July, i misjudged the arrival of my wages so my direct debit got returned (£20 charge to Lloyds TSB Bank and £30 charge to Blackhorse), yet the direct debit payment didnt go through. Unfortunately, Lloyds TSB found reason after reason to charge me onwards rising from £30 a month in August to £300 (IN 1 SINGLE MONTH) in December 2009. My Income a month was £900, (Considering i had £230car,£150car insurance, living costs as well etc) i couldnt afford to keep putting my wages into the bank account as i couldnt survive. Basically, the charges kept being taken out days before the car payment were due, hence my missing payments for the car finance when i had enough money in account for the payments only, so i fell behind with payments for car as well as keep getting overdrawn with my bank account. Currently, I have recieved a Demand for £962.96 from Lloyds TSB Collections Centre, Which i am refusing to pay, as the £962.96 is all Bank Charges, yet they have also taken over £1200 in charges out of my wages - Thats £2100 between June 2009 and June 2010. As a result of the charges, i have recently had a company called Anglia coming to reposess my car without any warning. I recieved a letter off Blackhorse Finance 'sent 12th May' and recieved it 26th May, asking me to contact them discussing my agreement. Easier Said than done. I tried several numbers for them, all 'Number is not in service' or 'You have the wrong number', eventually i found a number and spoke to a representative from Blackhorse, and after ages on hold and transferring me from department to department, i got told that i was 4 months behind and that i have to repay the £1400 'missed payments' within two weeks to have any chance of keeping the car. I queried the person explaining that 4 months (4*£236.58 = £946.32) and that the other £500 isn't correct. At the very most ive knowingly missed two payments. One was accidental and rectified by paying two in a month, and the last one was because i lost a week wages recently due to me being in hospital with my partner as she had gone into preterm labour. Blackhorse lady said that i can drive the car, but if it gets taken off me its gone - my choice and my risk, end of story, she doesnt know anything about the account and will get the account manager to give me a call back first thing Monday Morning. As a surprise, no call today at all, last time i spoke to them on friday, they said they would get someone to call me back that day but alas they didnt. Basically, Lloyds TSB have taken over £1200 in charges off me that should have been paying my Blackhorse Car Finance off, yet are still demanding £962 off me just in Charges. Meanwhile, Blackhorse are trying to reposess said car without notice. Had the car 12 months of a 48 month agreement. There basically saying i have to find £1400 within two weeks or i will definately lose the vehicle (and gain a reposession on credit file, so will not be able to get another). I've been well and truly screwed over by Lloyds TSB and need some urgent help Please anybody????? Thanks in Advance Number one (Of Millions) hater of Lloyds TSB ......... Maybe i should have been Islamic? Im not a racist but having read the Mail article i am angered that they pay at the most £15 a month in charges, yet i am a british national and have to pay in excess of £300 a month. I Cannot understand their logic but it angers me". I am waging war against Lloyds and will do what it takes....
