  1. OK - so what exactly do I need to send to TR?
  2. Hello. Sorry about the lack of update. As I might have mentioned, I'd only just moved home so there was a lot of sorting out to do. By the time I did, a judgement was entered in my absence and I was sent a forthwith judgement, asking for about 900 quid 'forthwith'. I contacted the court and explained my situation, they said if I had a reasonable chance of defending the claim, they could set the judgement aside. So I filled in an N244 explaining the reasons, sending relevant evidence, and they have set the judgement aside and will be heard in February. Throughout this time I had not contacted Turnbull Rutherford with my SAR but I have done that now. However, they want further information and identification. That sounds shady. So, to summarise, case will be heard in February. I sent the court all the correspondence I had and typed up my reasons for defending the claim. What do I need to do now?
  3. Nothing from Turnbull Rutherford. It has been 14 days. What do I do?
  4. TR acknowledged receipt of letters and said they were dealing with them. A week later they filed the claim. No reply to original letters. I'm sorry, but HFO own the debt. Surely they were equipped to handle the request?
  5. I'll type it up tonight. I'm keeping a file of all the stuff they've sent me. They did send a notice of assignment and a default notice but these were reprints, if not complete fabrications, addressed to an address I only lived at since a year ago. The notice of assignment was in 2008. I sent my CCA req to HFO but didn't get a reply. Turnbull Rutherford, though, have confirmed that HFO had received them but seemed to suggest that I should have sent it to TR. So as far as I was concerned, the account was in dispute until I received original documents. That hasn't happened, TR have filed a claim and now it has escalated.
  6. Hi sorry about the delay. I have been moving house so unable to get stuff scanned in. What I did do though, was follow advice given to another user re their experiences - following the link a few posts back, and sent a CPR 31.14 request to Turnbull Rutherford as well as my acknowledgement of service to the court. No reply from either as of yet - was all sent a week ago.
  7. I haven't got a scanner so I can't put up the particulars of the claim. I'll find a way though. It's just odd because they wrote to me a few weeks ago saying they'd received my letters and were going to get back to me in due course. Seems they've skipped a step in taking this action!
  8. OK. Interesting developments. A fortnight ago, I received a letter from Turnbull**** Rutherfords advising me that their clients had received my letters and will get back to me in due course. On Saturday morning I received papers from London City County Court for the Barclaycard debt. What now?

I've replied to them referring to my original letters - and I've attached them as well for EXTRA convenience - and informed them that since they have failed to comply with my request they are acting illegally and I wish to receive no further demand for payment. Basically, I've been looking back at their NOAs and they are hilariously bad. Can't take them seriously at all.
  10. Now then HFO - or should I say 'Turnbull Rutherford Solicitors', HFO's nasty older brother who went to law school - got in touch with me today. Basically, it makes no reference to my CCA request or the subsequent letter when they didn't respond within the allowed time. It 'constitutes a formal demand for payment' to HFO, and they have attached a copy of the notice of assignment by Barclaycard and a copy of the default notice. However, both notices are dated July 27 2010 and are addressed to my current home address. According to them, the date of default was in 2007, when I was at a different address, and the default notice was issued in 2008, when I was at another different address. So I'm fairly confident they were not the original notices. The covering letter opines that the debt which HFO is claiming is 'payable as evidenced by the attached notice of assignment and default notice'. But there is no CCA. What do I do now?
  11. They've gone deathly quiet. Even if they say they haven't received the letters - which Royal Mail say they have - HFO were intent on starting legal action if I didn't reply within 14 days to their original letter, so I should have heard something from them.
  12. I haven't had a response from HFO yet, it has been a week. Shall I send them I letter threatening a home visit? Or put a card through their door telling them they have missed a parcel and then give them my number to call?
  13. They had more than 12 days and I've heard nothing, not a peep, since I sent the CCA request. So I've sent the follow-up letter, which has been delivered to HFO according to Royal Mail. I spoke to Consumer Direct about it and they have advised me to complain to the CSA as they are clearly breaching their code of conduct. Furthermore, all CSA members have to publish the code of conduct on its website. HFO don't, yet Roxburgh, who operate out of the same premises, do.
  14. OK, just to clarify. I've read the draft letter and it says that HFO are effectively now in default. A default notice has already been issued as it's on my credit report as being in default. I have never seen the default notice mind you. The CCA request has been signed for by HFO yet they have not responded. Does this mean the debt is still unenforcable, even though a default notice has been issued some time ago?

  16. I fired off a CCA request on June 21, still no reply. I sent it recorded delivery - should I go back to the Post Office to enquire whether it has been signed for? What is my next move? I have had nothing from them since that contact. I looked at my credit report and they registered a default on there, its balance is £599 but that dates back to 2005.
  17. I can't recall. I had a whole load of debts from my student debts, some I paid off outright when I had 1k of bank charges refunded in 2007 and some I set up arrangements to clear. I can't remember which one the Barclaycard was.

They called back today - I told the operator that I do not appreciate telephone contact and would like to deal by correspondence only, he said he could not accomodate my request and HFO are 'well within their rights' to contact me. He hung up when I mentioned OFT and also Ofcom, as well as contacting the police to report a case of harassment. I've read about their tactics, none of them are going to work on me.
  19. Thanks for that. I'm more upset than anything as my debt is my problem, and I believe that if any matters have been discussed with my employers, that itself is a breach of the DPA. It's quite a gossipy office, and I'm on holiday at the moment. And thank you for saying I dealt well with the caller. I don't think I did. I lost my temper when I found out he had my personal information. Are credit agencies allowed to hand over so much info to DCAs?
  20. Hey. First post here. I guess some of you will have heard of, or had dealings with HFO services. They have contacted me this evening (after calling my employers) attempting to confirm my details regarding a Barclaycard debt - which dates back to 2005-ish. I can't be certain of the amount, but I certainly wasn't going to confirm anything over the phone. He tried to get me to confirm my address, job title, date of birth, telephone number, and I refused everything. He casually asked me how I'd managed to get credit in the past considering I had defaulted on a few accounts (I was a student at the time) which set me aback. How did he know that? He also asked me if the HPI agreement I ended last year was for a car. Instead of refusing to discuss things with him, I kinda flipped. He'd contacted my work, he had my credit report in front of him. How on earth did he get that? I asked him to send me a copy of the credit agreement - to which he said he couldn't, as I hadn't confirmed any of the details with him so he would be breaking the DPA to send me that information. Where do I go from here? I'm new to making DPA requests but I'd like to know what HFO have on me. Are they allowed to have access to my credit file? I took the credit card out in 2001 when I was a student - Barclaycard were giving out free supersoakers with credit cards on campus. I was 18. All my mates did the same, cancelled the card and were done with it. I should have done the same. All help appreciated. And if I've posted this in the wrong place, sorry.
