  1. Hi, Can anybody offer more advice on PPI. If an agreement displays PPI repayments - however, these have not been debited from my account and I do not have an insurance policy document - Is the agreement enforceable? Thanks P
  2. Hello, Thanks Costa for the referral (I've been reading your thread and I hope all went well today). Can anybody offer further advice? To date I've completed the allocation questionnaire, I attached a 'draft order for directions' to the court requesting the credit agreement and the supporting documents etc. Cobbetts also attached a 'draft order of directions' and requested that the claim be stayed for a period of 28 days from the date of the directions being approved by the court for the parties to attempt settlement. Now I have received a letter from Cobbetts stating a claim for the sum of £***** (as per particulars of claim), however I have no idea what this figure is made up of. Then the letter states that to settle the claim quickly, their client would like to offer the following. Basically a reduction of a few thousand ££££££. Or I can pay the initial sum of £***** by monthly instalments. I'm calm yet frustrated with the way in which I have been handled. The time, energy and stress involved is so destructive to other elements of life. For 8 months Natwest, Incasso, & Cobbetts ignored my forwarding address. On the allocation questionnaire I made reference to this, and now they have acknowledged this and address their letters to the correct location. Come on - That's naughty! My attempts to communicate with the Bank prior to being in this position were ongoing without a response from them. I was instructed and believed that all of my accounts had been frozen. However I've recently received my current account statements after numerous requests and this account was in credit until a couple of months ago, and they had debited loan repayments after they had told me that the accounts were frozen. Also a direct debit had been set up on this account which I didn't authorise. I had not received monthly statements for my current account since July 2009 and could not get access to my account. Also I'd made a number of over payments on the loans, due to the confusion of direct debit bank details. Surely this is unlawful? Cobbetts have not provided me with the information stated in my 'Draft order for directions'. So, I'm thinking all I can do is amend my defence to suggest this, and duplicate my need for the Credit agreement and relation doc's etc. Can I counterclaim for the time, loss of time spent on my business, expenses etc. Can anybody give me further direction?   3. Hello! Is anybody there . Can anybody help me fill out a court allocation questionnaire?? I've been out of the country for a couple of weeks and have come back to a Court Allocation Questionnaire which needs to be completed within the next few days! Ouch! I sent off the CPR request and received a response from Incasso stating that 'No further action with be taken... until the case has been reviewed'. (Or words to that effect – I’ve left the letter at home so can’t quote exactly now I also filed an embarrassed defence. I've now received notices from the court stating that: The Claimant must contact the court within 28 days after receiving a copy of your defence. After that period has elapsed, the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay. The allocation questionnaire makes suggestions about fees and attempts to settle… Any advice would be greatly appreciated!! Many thanks Pep

  5. Hi there, Yes, I'd be classed as self employed and they haven't provided me with any signed documents or any documents regarding the claim. I've now filled out the acknowledgement of service. The N1 form was dated 18th May. So, I should now send a CPR request to Incasso. Is there a template for this? Many thanks Pep
  6. Thank you for the quick response. I didn't sign a personal guarentee, not that I know of and can not find anything with a signature on. I'm a soletrader. The claim form states Defendant: xxx xxxxx (my name) T/AS XXXXXX XXXXX Particulars of Claim The claimants claim is in respect of monies due pursuant to an account maintained with the claimant. and the claimants claim 1. £27,XXX.XX 2. Costs
  7. Hello, Please, can anybody help me? In advance - Sorry for the long thread - I was sending this to the Financial Ombudsman... I’m being taken to court by Incasso LLP – Natwest. I opened a business bank account with Nat west in August 2007. I took out 2 loans with Nat West: 1 x £10,000 in 2007, 1x £15,000 in 2008. At the point of taking out the second loan for £15,000, interest rates were quite high. I asked for advice regarding interest rates and if it was a good time to take a loan and to which repayment options would be preferable. The senior member present at the meeting suggested that I could transfer the loan to a lower rate of interest should it change in the future. I was surprised to be offered an extra £15,000 at this point as I had few credits entering the account and I had started to claim working tax credits. In February 2009, interest rates dropped considerably. I wrote to my business manager asking for him to reassess the interest rates, as Nat west were then offering a much lower rate. I received a response from my business manager saying that it was not beneficial for me. I then pointed out that I would be making a saving of over £6k I received a response stating - ‘you are absolutely right, please let me know if you’d like to go ahead with a new agreement’, to which I replied – ‘YES – please go ahead and arrange’ (by email) . Five days later I received an email stating that – Unfortunately the underwriters are not agreeable to reviewing the term of the existing loans. This is due to the minimal credit turnover evidenced on the account. This was an influencing factor which made me decide on a fixed term loan – I stated this in a new email to my business manager, but received no response. I wrote a complaint letter to Nat west, including all the correspondences mentioned above. However, I received no response. I decided to change bank accounts in June 2009. I’d received a letter from my new business bank suggesting that NatWest would not transfer the direct debit for 1 of the loan payments. I tried to find a new loan provider in June 2009, however was unsuccessful. From this point things become very confusing, and stressful. The leaseholders of the office space I was occupying went into administration, I was looking to lose £1500 deposit, along with having to find new premises, reprint stationary etc. Plus, I had problems with a supplier and lost a substantial amount of money and progress. Carrying out all business functions as a one man band was very stressful. I moved out of my house and rented my rooms to compensate for the loses. My address had changed, my office addressed had changed and I’d informed my bank manager by email and sent letters to NatWest. However they didn’t update my details. I returned to my house to pick up post to find letters regarding missed payments for both loans between May - August. On 26th August I cleared these amounts outstanding. I’d also incurred £310 bank charges. 2 letters dated 27th August then arrived from my business manger to my old address stating communication had broken down and that I should make arrangements to transfer my accounts. Plus I had 28 days to pay off the loans or my accounts would be transferred to Experian Ltd, Equifax Europe Ltd and Call credit plc, credit reference agencies. By the time I’d picked up these letters this period of time had expired. From September 2009 until now no repayments have been made on my loans. The above events had made things very difficult for me. I called NatWest many times via the dedicated loan line however the line was always busy, when I did get through I was transferred from person to person, I called my business manager however he was not available, I’ve written letters – to which I’d received no response to my questions. However, I received many letters stating - ‘we are aware you have been in contact with us regarding your current situation, and to arrange a repayment plan’ (last letter received on 6th April 2010). On 23rd April I received a letter from Incasso LLP, requesting payment for £27K (amounting to more than the 2 initial loans amounts) to my previous address. I had 14 days to respond. This time had already elapsed by the time I picked up these letters. I wrote to NatWest again including copies of all the other letters i had sent to them but received no response. This time I did received a response – to my new address stating they will contact me again within 10 days regarding my complaint. They are yet to respond and the 10 working days have passed. Last week I collected post from my previous postal address and there was this court claim letter for the amount mention above. They are taking me to court and charging me £300 for it. I’m confused; I have always had a high credit rating however these events have caused me great stress, time, money loses and concern. I’m unable to make these payment now. Can anybody offer advice? Can anybody help me fill out the claim response forms?? Many thanks Pepper
