Hello again, this is what I had thought many thanks and yes ACAS have been kind of playing down my case. I will agree to settle for the amount that I have worked out from above minus what I have earned. ACAS did point out to the solicitor that I could not have send the alleged email which clearly she looked at more closely and had to agree. I will give them my figure for them to work towards, it would be good to settle as I feel that I cannot put this behind me and I need to move on. x

Hello all, Company has responded to ET date for hearing is November. There solicitor has made me 2 offers (stupid amounts) to settle and I have declined both of them. Do you agree that this is a good start? Is there normally a good amount to request or do we just 'wing it'. My case is strong so maybe I should just go to court. Does anyone know about settlements? Hi all, my former employer has failed to respond within the 28 days to the ET! Does this help me? Does it show that they know they have no proof that I did the alleged gross misconduct? What happens now? My ACAS conciliator is on leave until 9th Aug, I have only spoken to him once when he called to say that he left a message for the employer to contact him and at that time they had not bothered. Frustrated!!

On another thread there was something about a schedule of loss, what exactly should i put on that if i have to do one for the Tribunal?

I could not possibly work for the same boss...he has caused me too much pain and made others lie as they feel that telling the truth would be career suicide. The other job didn't work out as I was not prepared to work 16hr days so got shouted at. Working nights now for a great company so hopefull i will be there a while yet.

Thanks guys for your help. I have shown this email to a computer programmer who says he will stand in court and confirm that this could not have been sent on 12/02. At appeal I said that all they had to do was go to my pc and look at what was sent to my daughter on 12/02 as this is all the proof that was needed. I guess he didn't do this as he upheld the decision on balance of probabilty.

Hi all. Update so far...having looked at this email again and again that I apparently forwarded, I have now discovered that these 'attached emails' that supposedly I sent on 12/02 to my daughter did not exist on this date as they were either sent or received to me on various dates after the 12/02...proving that I could not have attached to the email sent on 12/02 as I stated. I have now received letter from Employment Tribunal accepting my claim for unfair dismissal. My questions now are: Will the tribunal look at my evidence and see that I could not possibly have time travelled and try to resolve this? Will the company back down and admit to sacking me on the balance of probability when they know they are clearly in the wrong? This had made me ill knowing all along that I was innocent and ex workmates will still not speak to me although I was close to 2 of them...been told not to by my boss I believe.

Whodini, I know how you feel, I have now lodged for an employment tribunal as was sacked for also doing nothing wrong, but like yourself appeal was upheld. Mental harassment is what all this hassle gives you so i totally sympathise. How can employers sack for GM when you present them with evidence/proof that they are talking rubbish in order to 'get rid of you'? I cannot afford legal rep so am doing it myself. Good luck.

Hello all, I have now heard that my sacking has been upheld following a appeal hearing on the basis of balance of probabilities. 'On balance you did commit the alleged misconduct and that the action taken was appropriate'. How can he still say that i sent this email to my daughter on 15/02 with attachments that I did not receive until after this date?? All of this is clear and on paper with dates etc and is an IT problem. Do you agree that this is unfair dismissal and I will possibly win at a tribunal?

Thank you, apologies for the delay but I am now working nights...yawn. I have an appointment with my fathers consultant this Monday, hopefully he will be able to provide me with some sort of letter confirming that my father needs constant attention....for instance this week his fingers have been numb and he has badly burnt his fingers while trying to make a cup of tea, he did not feel anything until hours later when the blisters appeared.

I have just spoken with Connexions who said that for my daughter to receive benefits, i would have to present myself as jobless..great!! and she also suggested that I put my father into a home so that my daughter can work (that is not an option) What is going on with this world, we are trying our best but to no avail....i did say that we get nothing unless we are alcohol/drugs abusers to which she agreed. Thanks all for your help but unfortunately it looks like unless i can pay the mortgage arrears within a month we will be homless too. Never claimed benefits in my life but might have to weigh up the option to sign on, and look after my dad,then my daughter can work.Or muddle on and hope i can keep my house.

The letter just says he is not disabled enough. Have appealed but no change.

Yes as the granddad is apparently not disabled enough he cannot get attendace allowance therefore my daughter cannot get carers allowance, but why not income support? On the direct.gov website it does say that 16/17 year old can get income support, has she been misinformed by the benefits agency and lost out on 6 months of money?

My daughter cares for her grandad as he has mini strokes and is waiting for surgery, he is totally deaf and very scared of being alone, she has to help with medication 22 tablets a day but he is not entitled to Attendace Allowance! She went to local job centre 2 months ago to claim some money and was told that she is not entitled to anything, she has had no income since December and I am not in a position to support her any longer as i have been sacked and have only just got another job, have not paid the mortgage in 3 months and we are now at the end of the tether. The lady at the job centre seemed to not know what she was talkin about as she even said that 17yr old cannot claim carers allowance. Can someone please help me

Hello all, I have just came back from a lovely weekend away and have a job offer!! At interview I did not tell them of the impending tribunal, only that I had suffered badly with my bosses treatment to me and had left. Do I tell them that I am taking legal action against my former boss as I was sacked,or do I keep my mouth shut?

All he said was that he would need to speak with the manager that had wrote the statements.

Yes i proved to the manager at appeal that my manager wrote them all.

Hello, forgot to mention that statements made by my former work mates have actually all been written by my Manager and only signed by them...will this be something that will go in my favour when i contact ACAS/Solicitor?

The 100 page email that they think I sent to my daughter contained lots of emails to and from members of staff,there was only 1 that was sent to my daughter! This was sent to my team leader on 03/03 but the last email sent to my daughter was on 02/03 as IT have printed off a list of all outgoing emails to my daughter, I think this speaks for itself? Hopefully I will receive a letter regarding my appeal very soon as it has now been 1 week since the meeting and will keep you all updated. Thanks x
